Councilmembers of the Town of Fountain Hills will attend either in person or by telephone conference
call; a quorum of the Town’s various Commission, Committee or Board members may be in attendance at
the Council meeting.
Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory
exceptions, parents have a right to consent before the State or any of its political subdivisions make a
video or audio recording of a minor child. Meetings of the Town Council are audio and/or video recorded
and, as a result, proceedings in which children are present may be subject to such recording. Parents, in
order to exercise their rights may either file written consent with the Town Clerk to such recording, or
take personal action to ensure that their child or children are not present when a recording may be made.
If a child is present at the time a recording is made, the Town will assume that the rights afforded parents
pursuant to A.R.S. §1-602.A.9 have been waived.

The public is welcome to participate in Council meetings.
TO SPEAK TO AN AGENDA ITEM, please complete a Request to Comment card, located in the back of the Council
Chambers, and hand it to the Town Clerk prior to discussion of that item, if possible. Include the agenda item on which
you wish to comment. Speakers will be allowed three contiguous minutes to address the Council. Verbal comments
should be directed through the Presiding Officer and not to individual Councilmembers.

written comment, and check the box on whether you are FOR or AGAINST and agenda item, and hand it to the Town

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Town Council, and to the general public, that at
this meeting, the Town Council may vote to go into executive session, which will not be open to the public, for legal advice and
discussion with the Town's attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S.
§38-431.03(A)(3).

Staff Summary (background)
This report presents the results of the Primary Election held on July 30, 2024, where the positions of
Mayor and three Councilmembers were on the ballot. Out of 18,060 registered voters in the Town,
10,193 ballots were returned, giving a turnout rate of 56.44%. According to Section 2-3-3 of the
Fountain Hills Town Code, candidates must receive a majority of votes to be declared elected. For the
Mayor's race, the following candidates received the highest number of votes but did not achieve a
majority and will advance to the General Election on November 5, 2024:
Ginny Dickey
Gerry Friedel
For the Councilmember race, Gayle Earle received a majority of votes and is declared elected. The
following candidates, who received the most votes but less than a majority, will also move on to the
General Election on November 5, 2024, for the two remaining council seats:
Peggy McMahon
Rick Watts
Mathew Corrigan
Clayton Corey

RESOLUTION 2024-26
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA, DECLARING AND ADOPTING THE OFFICIAL CANVASS OF VOTES CAST IN
THE TOWN OF FOUNTAIN HILLS PRIMARY ELECTION HELD JULY 30, 2024;
DECLARING THE ELECTION OF ONE CANDIDATE FOR THE OFFICE OF
COUNCILMEMBER; DECLARING TWO CANDIDATES FOR THE OFFICE OF MAYOR
AND FOUR CANDIDATES FOR THE OFFICE OF COUNCILMEMBER SHALL PROCEED
TO THE GENERAL ELECTION TO BE HELD NOVEMBER 5, 2024.
WHEREAS, the Town of Fountain Hills (the "Town") held a primary election on July 30, 2024, for
the purpose of electing a Mayor and three Councilmembers; and
WHEREAS, A.R.S. §16-642 requires that the Town Council canvass the returns of the Election
no later than twenty (20) days following the election; and
WHEREAS, the Town Council, having canvassed the returns of the July 30, 2024, Primary
Election, finds the returns to be as stated in this resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1. That the recitals above are hereby incorporated as if fully set forth herein.
SECTION 2. That the total number of registered voters was 18,060; that the total number of
ballots cast at the Primary Election was 10,193; and that the total rate of return was 56.44%.
SECTION 3. That the number of votes cast and the names of the persons voted for, including
the number of votes received in each precinct by each candidate for Mayor and each
candidate for Councilmember were as set forth in Exhibit A and Exhibit B, attached hereto and
incorporated herein by reference. The number of provisional ballots in each precinct was as
set forth in Exhibit C, attached hereto and incorporated herein by reference. The number of
ballots rejected in each precinct was as set forth in Exhibit D, attached hereto and
incorporated herein by reference.
SECTION 4. Pursuant to A.R.S. § 9-821.01(F), the following named candidates, equal in number
to twice the number of seats to be filled, having received at the July 30, 2024, Primary Election
the greatest number of votes cast for the office of Mayor, which number was less than the
majority of all legal votes cast in that race, will be the only mayoral candidates at the General
Election to be held on November 5, 2024:
• Ginny Dickey
• Gerry Friedel
SECTION 5. For the Councilmember race, it is found that one candidate, having received at the
July 30, 2024, Primary Election a majority of the legal votes cast for the office of
Councilmember, is declared to be elected to that office as determined by A.R.S. § 9-821.01
and Town Code 2-3-3:
• Gayle Earle
SECTION 6. Pursuant to A.R.S. §9-821.01(F), The following named candidates, equal in number
to twice the number of the remaining two seats to be filled, having received at the July 30, 2024
Primary Election the greatest number of votes cast for the office of Councilmember, which
number was less than the majority of all legal votes cast in that race, will be the only
Councilmember candidates at the General Election to be held on November 5, 2024:
• Peggy McMahon
• Rick Watts
• Mathew Corrigan
• Clayton Corey
SECTION 6. This Resolution shall be in full force and effect immediately upon its adoption.
SECTION 7. The Mayor, Town Manager, Town Clerk, and Town Attorney are hereby authorized
and directed to take all steps necessary to carry out the purpose and intent of this Resolution.
PASSED AND ADOPTED by the Mayor and Council of the Town of Fountain Hills, Arizona this
13th day of August 2024.
