Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory exceptions, parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings are audio and/or video recorded and, as a result, proceedings in which children are present may be subject to such recording. Parents, in order to exercise their rights, may either file written consent with the Town Clerk to such recordings, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made, the Town will assume that the rights afforded to parents pursuant to A.R.S. §1-602.A.9 have been waived. PUBLIC HEARING, CONSIDERATION AND POSSIBLE ACTION: Resolution EMCFD 2022-02, approving the Final Budget for the Eagle Mountain Community Facilities District for the fiscal year beginning July 1, 2022, and ending June 30, 2023. Mayor Dickey opened the public hearing. David Pock, Chief Financial Officer, mentioned there are no changes to the Eagle Mountain Final Budget from when it was presented last month during the tentative budget. There is $14,200, and there are no expectations to spend those funds next year. These funds are budgeted just in case any expenditures do arise. Board Member Scharnow inquired about the final disposition; will this continue from year to year, or will it go away? Mr. Pock stated that they spoke with outside legal counsel regarding the CFD; it will need to remain open for 5 years past the payoff of the final bonds. At that time, we can determine its disposition. Having no further comments, Mayor Dickey closed the public hearing. Staff Summary (Background) The Eagle Mountain Community Facilities District was formed by the Town Council in FY1996 for the purpose of constructing infrastructure in the Eagle Mountain subdivision. The Town Council serves as the governing Board for the District. In the past, the annual expenditures for the community facilities district were for repayment of the bonds that were issued to pay for the subdivision infrastructure. The last bond payment was made on July 1, 2021. As such, there will not be a property tax levied for the community facilities district in FY24, and only administrative contingency expenses of $18,900 are included in the Tentative Budget. Related Ordinance, Policy or Guiding Principle A.R.S. § 48-723 Risk Analysis If not approved, the District will not be in compliance with state statute.
