Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory exceptions, parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the Commission are audio and/or video recorded and, as a result, proceedings in which children are present may be subject to such recording. Parents, in order to exercise their rights may either file written consent with the Town Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made, the Town will assume that the rights afforded parents pursuant to A.R.S. §1-602.A.9 have been waived.  REQUEST TO COMMENT The public is welcome to participate in Commission meetings. At the conclusion of the Call to the Public, individual commissioners may (i) respond to criticism, (ii) ask staff to review a matter, or (iii) ask that the matter be placed on a future Commission agenda.   4.CONSIDERATION & POSSIBLE ACTION: Approval of October 24, 2022 Meeting Minutes       MOVED BY Commissioner Rory Wilson, SECONDED BY Commissioner Ron Ruppert   Vote: 6 - 0 - Unanimously   5.CONSIDERATION & POSSIBLE ACTION: Approval of December 12, 2022 CSAC Meeting Minutes       MOVED BY Vice Chairman Carey Reddick, Jr., SECONDED BY Commissioner Stephen Barnes   Vote: 6 - 0 - Unanimously   6.UPDATE: Dark Skies Observatory/Community Garden New Location       Mr. Snipes informed the commissioners that the Community Garden was in the process of moving to its new location to make room for the future Dark Skies Observatory. He and Ms. Goodwin had met up with the community garden group to discuss some of the items that they were leaving behind, which included some of the trees. There was discussion with them as to how the trees would be maintained until the observatory gets brought in. Commissioner Rudolphy asked if the town was paying for any part of the cost of the move and Mr. Snipes shared that the community garden was using funds that they had to use.   7.UPDATE: Mayor's Youth Council Teen Takeover       Youth Commissioner Sruti Peddi was absent from the meeting.  The Mayor's Youth Council  report will be moved to the February meeting agenda.     8.UPDATE: Community Center Mold Issue       Mr. Snipes updated the commissioners on the remediation work that had been completed at the Community Center and how everything has been put back together and operational. Recent rains have not shown any areas of leakage that had been a problem in the past, confirming the window sealing was completed in a fashion that has been successful.  Commissioner Rudolphy asked if this meant all issues were resolved as there was significant work that needed to be done. Mr. Snipes confirmed as far as the remediation of the mold issue in the identified areas that work was completed.    9.UPDATE: Sidewalk Infill Project       The sidewalk infill project has been moving forward and work is currently being completed around Desert Vista.  Mr. Snipes informed the commissioners that he had also had an area of the sidewalk replaced at the park going up from the amphitheater in an area that had been slippery and replaced with a coarser coated  cement.    10.UPDATE: Golden Eagle Park Tour - February 16, 2023       Commissioner Rupport confirmed that the Golden Eagle Park tour would take place on February 16th of February at 3:45 PM.  He asked Mr. Snipes if Ms. Goodwin was going to have either the town engineer or Justin Weldy join the tour to show the multi-uses of the park and how it serves the community as far as flood control and recreation. All right, we're going to get an Update on the Dark Skies Observatory and Community Garden’s new location. SNIPES: So right now, they're in the process of moving the community garden. They started on that about a week and a half ago now and Rachael and I met up with them to discuss some of the things that they were leaving behind some of the trees and if and how we would want to maintain those until the observatory gets brought in. And so, we're looking into that to see if there's any ability to try and salvage the trees at least as long as we can so it's not just a Transcribed by https://otter.ai - 3 - vacant lot out there when they get done moving. But it looks like they're on their way at least to getting everything moved over there for that to be done long before the observatory gets in. So, that's using some of their funding that they have to use. RUDOLPHY: Is the town paying for any part of the cost of that move? SNIPES: No, they're using the funds that they have to spend by a certain time in order for them not to lose those funds. VARELA: Any other questions? Nope. Okay, thank you for that update. Okay, the Mayor's Youth Council, since our youth member is not here, so we're not going to get an update but there it is in your packet and I do know that I believe at least in the past that they do look for some volunteers and also some prizes. In the past, I've donated a gift card to my forget where maybe Starbucks, but she said or somebody told me that that's what they look for. So if you know anybody or you have any businesses around here that you can get a donation from I'm sure they would greatly appreciate it. REDDICK: Who would we provide those items too? LOPUSZANSKI: Ryan Preston is handling the Mayor's Youth Council, so if you want to reach out to him, he is the one that's working with the Coalition for this event. REDDICK: Thank you. VARELA: Okay, and I think I did just drop it off upstairs one time when I did it just in an envelope and I put Mayor’s Youth Council. All right. Great, thanks. Okay, Update on the Mold Issue at the Community Center, please. SNIPES: So, they have completed all the remediation that they needed to do. Everything's put back together, and we're back up and operational. With all the rains and stuff that we've had, we haven't noticed the leakage that we've had in the past so that's a good sign that the window sealing was completed in a fashion that has been successful. VARELA: Thank you. Comments? RUDOLPHY: But I thought that there was significant substantial work that needed to be done you just saying everything was resolved. So…. SNIPES: As far as the mold it's there the remediate that that remediation is complete the substantial work that needs to be done is so they've done some patchwork on getting things to stop for now, but the bigger long-term problem is where the greater funds are needed to do that we don't have those numbers or what all that entails at this time. RUDOLPHY: Okay, thanks. VARELA: Okay, Update on the Sidewalk Infill Project. SNIPES: The sidewalk infill has been moving along around Desert Vista at this time, they've been doing quite a bit of work over there. I don't know for sure when that's all supposed to be done. It's pretty close. I know. I think that they're supposed to be out of here. By the end of this week. I had them do some work in the parks as well. During that, we replaced the sidewalk going up from the amphitheater which was one of the most slippery of all the sidewalks that we had in any of our parks, and saw a lot of slips and falls. And so, it was pretty challenging to get it coarse enough to keep people from slipping and falling, but yet, not so coarse that he didn't Transcribed by https://otter.ai - 4 - feel like he could walk on it. So, we were trying to really come up with a different plan from how they had groomed it before to how it’s groomed now it's pretty rough. So hopefully it'll hold up for us and provide us with many years’ worth of safe travels up and down that hill. And it's the reason why that's always been a no-bike zone up through there was that it was so slick that wheels would slide out from under you when you made the turn. So, hopefully, this will help. VARELA: Are there other areas that are going to be worked on next? Or are we waiting for more funding for that? SNIPES: I'm not sure where Justin is on the infill project as far as how far in he is on his budget. But I know it's a year-over-year project and I don't know for sure where he's at as far as funding goes. VARELA: Okay, thank you. Any other comments, or questions? Thanks. Okay, Golden Eagle Park tour, February 16. Who's going, Ron? RUPPERT: Yeah, we've gotten responses back from everybody. It looks like we're going to be on there on the 16th of February at 3:45. I guess just meet over in the parking lot. One thing I was going to ask tonight Kevin with Rachel was I was going to see if either the Town Engineer or Justin Weldy join us over there to show us the multi-use of the park. And how it's, you know, serves the community as far as flood control and recreation. And, you know, talk about, you know, immediate improvements that you guys did over there and future improvements, and we're really looking forward to it. SNIPES: Yeah, I'll definitely I'll reach out to them and see if they can join it. And if, if not, I've at least been a part of all the meetings and how they're going, how what we're planning on doing for all of that project and how it will affect the park and as well as the water flows that go around so… RUPPERT: And I'll send an email out, just as a reminder RUDOLPHY: And tell us again where we're supposed to be meeting? SNIPES: Yeah, I was just going to say why don't we meet at the restroom parking lot so, the middle parking lot of the three. You said the parking lot, but there are three left in the middle, the middle one there by the restrooms. VARELA: All right, thank you. Okay, Future Agenda Items. Is that for us to discuss what we would like to see? Okay. Does anybody have some future agenda items that are around town? RUPPERT: Well, Rachel asked us last meeting if we would come up with some, you know, different ideas, some even past projects that weren't either approved or were put on were tabled or something in the future. And I think that that's what that was. VARELA: Okay, I thought you had one specifically that you mentioned, did you or no, no. RUPPERT: I’m sure there are a couple of dozen. VARELA: Yeah, no, I know. I just was thinking that for some reason I thought you did. REDDICK: I'd like to table if we could for our next meeting the project that Rory and I worked on in regard to the outdoor workout facilities that we presented that was presented to the council that has not been brought back to us if I'm not mistaken. No, I guess we're going to take whatever you throw our way, and we'll work on it. Okay, can we get an update then on upcoming events? SNIPES: Well in your in your packet there’s our next major event the Irish Fountain Fest. We do have our green dye in for that and we'll be going green twice on Saturday the 11th as well as at noon on St. Patrick's Day. We'll also be running green at night for those two days as well. We're using the lights to turn the Fountain green for those as well. Eggstravaganza is on there and it's moving over to Four Peaks Park this year. We've always done it over at Golden Eagle in the past but with the way that it's grown and how Four Peaks is advanced, they decided to move it over to Four Peaks this year. So, we're looking forward to that. Music Fest is coming up on April 1st. They got all their bands lined up in entertainment as well as food and beverages and so that should be a that eventually grown a lot over the last few years and it's really turning into something neat. Concerts on the Avenue we'll be back again in April. Unfortunately this fall we tried a lot to have Concerts on the Avenue but Mother Nature was against it every Thursday she decided to make it rain so hopefully we'll get to have a few of those this April and then we got the Recycle Recreate Earth Day celebration. I think this is the second one of these that we've done. And it's a neat event with we're collecting a lot of stuff upstairs for like your tubes to your paper towels or toilet paper or cardboard boxes for them to make different things out of so if you have anything like that and you want to bring him in. Linda would be happy to have that. On our final one, there is a Movie in the Park over it Four Peaks. I don't know if that says what they're showing yet or not. Nope, I don't see it on there. Do you know what they're showing by chance? LOPUSZANSKI: I believe it's a “Puss in Boots.” VARELA: Okay, comments, questions? All right. So, Volunteer Opportunities. Obviously, everything on this list probably would need volunteers. Okay. Anything else that isn't on this list that you have a need for? SNIPES: Off the top of my head, I don't know of anything. I know that they're looking for volunteers for the fair in February. Trying to think of what else, anything else you can think of? LOPUSZANSKI: There's also the Expo that's on Thursday. So, they are still in need of some volunteers if anybody is interested. And then as Kevin said, it is the Fair. So that Friday, Saturday, and Sunday, there are shifts at the Town Tent. So if anybody is interested in getting more information on that Kim Wickland can provide you with all that information and what the availability is for any of those shifts. VARELA: Great, thank you. This is kind of crazy that it's going this fast. But all right, so our next meeting is going to be on February 27th and we have a presentation by David Pock, who's the Chief Financial Officer. So, try to be here. LOPUSZANSKI: So, with the presentation by our Chief Financial Officer, as requested you wanted to know what those money buckets were and kind of how the budget is all put together and our timeline in that. Strategic Plan Task D included "Create and publicize an Environmental Plan for Fountain Hills."Following Council approval of the new Strategic Plan, staff began reviewing options for implementing the strategy to create and publicize an environmental plan and reviewed those options with the SPAC.  Through this review, it was recognized that the voter approved General Plan included just about all the items desired in the environmental plan, but not organized in a manner which was easily read and used.  The one item which was missing was discussion regarding becoming a biophilic community.  Biophilia focuses on connecting people with nature and the environment through our built designs and communities.  It was determined that the environmental plan could be created by pulling the elements contained in the General Plan together into one document, adding some clarifying content, and adding a section regarding efforts to become a biophilic community.  Town Council approved the Environmental Plan 2022 at the February 21, 2023 meeting.  Attachments Environmental Plan 2022  Form Review Form Started By: Patti Lopuszanski Started On: 02/22/2023 04:24 PM Final Approval Date: 02/22/2023  T O W N O F F O U N T A I N H I L L S E NV I RONM ENTAL P LAN 2 02 2 P r e p a r e d B y : John Wesley Development Services Director Introduction Environmental Plan 1. Require all newly platted or re-platted hillside properties to provide a Hillside Protection Easement for each parcel as required by ordinance; 2. Identify where appropriate trails should be located per the direction provided in the Parks, Recreation, Trails, and Open Space Map and the Social Environment goals and policies and develop public educational materials to discourage off-trail use and protect wildlife habitat and vegetation; 3. Discourage un-permitted grading or dumping and require re-vegetation for violators; 4. Encourage redevelopment, revitalization, and rehabilitation to reduce land consumption; 5. Continually update the approved low-water use plant list to ensure that all plants on the list are suitable for the community; 6. Continually protect dark skies; and 7. Update the Land Disturbance Regulations when appropriate. Continue to preserve and conserve the natural desert, support open space, identify and protect historical and archaeological resources, and develop and implement programs and policies that encourage water and energy conservation and reduce water and air pollution. Continue to enforce and update all applicable ordinances, including Land Disturbance Regulations, to conserve the natural desert, protect open space, hillsides, unpaved trails, wild habitats, and dark skies, and encourage low-water-use, drought-tolerant landscapes 2. Require observance of all applicable requirements through the Development Review Process. GOAL 2: Provide and maintain an open space network throughout the community. POLICIES 1. Continue to protect the existing natural washes within the platted portions of the community as permanent natural desert open spaces. 2. Continue to identify and evaluate all wash/wildlife corridors in unsubdivided areas and encourage landowners to ensure those corridors are rezoned to one of the Open Space (OS) Zoning Districts. 3. Continue the development of land trusts and taxing mechanisms that have community support to accomplish open space acquisition and management programs. 4. Continue to require new development to meet recreational/open space needs as part of site design through the development plan review process. 5. Encourage the private development of a neighborhood park as a part of subdivision design, which may or may not be conveyed to the Town or other public entities even though its status as a permanent open space is secured. 6. Continually support unpaved trails within the Town limits that provide connectivity and opportunities for recreation, enjoyment, and use of the Sonoran Desert subject to the appropriate findings and studies in places where they have little impact on residential developments and natural wildlife. ACTION ITEMS 1. Continue to protect natural washes, wildlife corridors, open space, and the unpaved trail network through established mechanisms, including subdivision regulations, Open Space (OS) Zoning Districts, available space acquisition, and DRP. 2. Support the creation of neighborhood parks and continued development of unpaved trails through the DRP and subdivision regulations approval processes GOAL 3: Provide open space linkages within the Town and to the regional systems beyond its boundaries where feasible and appropriate. POLICIES 1. Continue to encourage the development of trail systems that link Fountain Hills with McDowell Mountain Regional Park, the City of Scottsdale’s trail system, and Maricopa County’s trail system and potential systems on both the Salt River Pima-Maricopa Indian Community and the Ft. McDowell Yavapai Nation to support eco-tourism efforts, provided that such trails do not infringe on the privacy of residential areas. 2. Continue to update and produce mapping and facility information for the public on the Town’s website and through printed media regarding recreation, trail, and open space facilities. ACTION ITEMS 1. Continue to encourage the development of local trails that connect to the regional trail system to increase opportunities for eco-tourism 2. Update the trail system map and facility information on the Town’s website and social and print media to inform the public of the availability of these assets, as needed. GOAL 4: Identify and preserve historical and archaeological resources. POLICIES 1. Collaborate with studies that aim to uncover and preserve the historical and archaeological resources within the incorporated area. 2. Promote the preservation of archaeological artifacts by applying the latest applicable cultural resource conservation reporting methods working collaboratively with the State Historic Preservation Office and the Arizona State Museum. 3. Continue to support public education programs emphasizing local and regional historical and cultural resources like those provided at the River of Time Museum. ACTION ITEM Work collaboratively with the State Historic Preservation Office and the Arizona State Museum to protect historical and archaeological resources and support educational programs on historic and cultural resources. 1. Continue to support the expansion and development of regional and local transit service. 2. Continue to require the utilization of native, drought-tolerant landscapes. 3. Promote environmentally friendly initiatives supported by the 2022 Fountain Hills Strategic Plan. 4. Support a walkable Town Center. 5. Encourage bicycle and pedestrian connectivity throughout the Town to promote active and healthy lifestyles. GOAL 5: Continue to promote programs that encourage environmentally- friendly alternatives and improve air quality. POLICIES ACTION ITEMS 1. Prepare and adopt a Comprehensive Environment Plan (CEP) that implements the 2022 Strategic Plan and the policy direction included in Goals 5 and 6 of this Element 2. Update all applicable regulations and ordinances to meet the directives of the CEP once adopted GOAL 6: Continue to promote environmental stewardship. POLICIES 1. Continue to pursue improved communication and collaboration with Federal, State, and local partners on environmental concerns and legislation. 2. Advance understanding of the environment through the Town’s Communications Office, education programs, and media and environmental agencies partnerships. 5. Consider environmental costs, risks, and impacts as integral components of the planning and decision-making processes when feasible and appropriate. 6. Implement and maintain a process/system to evaluate environmental initiatives that seek input from Town Staff, the business community, citizens, and community services providers. 7. Encourage, when economically comparable, the use of architectural design using active and passive solar heating, shade elements, and energy-efficient insulating materials to reduce energy consumption. 8. Encourage water conservation through: a. Supporting water use reduction education programs; b. Continuing use of recycled water for turf irrigation Town parks and golf courses; c. Encouraging drought-tolerant landscapes that incorporate water harvesting, drip or low-flow irrigation as water use reduction measures; and d. Encouraging the utilization of low water use features in new development and redevelopment. 9. Encourage salt-free water treatment systems to improve irrigation water used at Town Parks. 10. Where feasible and appropriate, encourage Low Impact Development (LID) designed to support sustainable stormwater management planning and design practices in their watersheds that either enhance or do not significantly diminish environmental quality by encouraging: a. Practices that preserve or restore predevelopment hydrological and ecological functions; b. Site design strategies that minimize runoff and protect natural drainage patterns; c.
