Commissioners of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum of the
Town’s Council, various Commission, Committee or Board members may be in attendance at the Commission meeting.
Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory exceptions, parents have a
right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child.
Meetings of the Commission are audio and/or video recorded and, as a result, proceedings in which children are present
may be subject to such recording. Parents, in order to exercise their rights may either file written consent with the Town
Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may
be made. If a child is present at the time a recording is made, the Town will assume that the rights afforded parents
pursuant to A.R.S. §1-602.A.9 have been waived.
REQUEST TO COMMENT
The public is welcome to participate in Commission meetings.
TO SPEAK TO AN AGENDA ITEM, please complete a Request to Comment card, located in the back
of the Council Chambers, and hand it to the Executive Assistant prior to discussion of that item, if
possible. Include the agenda item on which you wish to comment. Speakers will be allowed three
contiguous minutes to address the Commission. Verbal comments should be directed through the
Presiding Officer and not to individual Commissioners.

card, indicating it is a written comment, and check the box on whether you are FOR or AGAINST and

beautiful, natural desert landscape undisturbed.1

If you have to describe what 'Biophilic is' - you should not be doing it. Not everyone is as 'woke' as you. Additional community gardens
and plant classes, empasis on zero scaping that is attractive 1
Fountain Hills is in the Sonoran Desert. Saguaro and prickly pear cactus are native and popular in plantings. Bursage is mor common
naturally and holds the soil but it is unattractive. Brittlebush is also common, more attractive, grows in disturbed soil, and has gorgeous
spring owers. But what we need ar more creosotes. They are native, need almost no water, but will grow beautifully with a little more
than natural water. The plant is open feathery and nice, plant more. And desert marigolds are native and gorgeous and will bloom all year
if they get a little more than natural water. Plant more. Also need more globe mallows and lupines, which grow wild along roadways and
other disturbed areas. And I should mention ocotillos. Plant more. They will root from cuttings. They look dead most of the year, then
suddenly put out little green leaves, or in spting, spikes of red owrs. Great!

I would like to be assured that our recycled paper & items are being recycled & proof of this furnished rather than me being tempted to
follow the recycle truck to where he dumps his load!2
Must I be a resident of Fountain Hills to participate? I live close by and frequent Ft Hills.2
It was di cult choosing just one option on some of these questions, particularly the last with town trails vs biking. The other was tree
canopy and vegetation vs town greening. All excellent ideas and should be pursued. Thanks r doing this.2
I love the area by the sidewalk around the fountain, along La Montana, where desert plants are identi ed. I would like to see more like
that, only maybe add more info about planting/maintaining? And more classes on growing things here. Speci cally for here. What I read
on a plant label at Home Depot does NOT mean it grows well here.

Again, keep the natural desert beauty. Keep the open spaces. No more apartments or condos built. Concentrate on permanent, year-
round residents who will live in standalone homes. In order for the town to be sustainable, it must seek year-round residents who are
willing to invest whole-heartedly in the town. Make sure the quality of life in the town continues. It would be advantageous to have our
own police department with o cers who live and work in our community. For instance, having o cers on bicycles in the downtown area
as well as foot patrol in the park areas and the downtown. Maintain the small town open space community.

Memorandum of Understanding
This Memorandum of Understanding (MOU), hereafter referred to as the “Memorandum,” entered into
on ____________, 2021 is between Sami’s Fine Jewelry, of 16704 Avenue of the Fountains, Suite 100
(hereafter referred to as “Sami’s”), the Town of Fountain Hills, of 16705 Avenue of the Fountains,
(hereafter referred to as “the Town”), and Rosie the Riveter Memorial Rose Garden Co-Chairs, of 15545
E Scorpion Drive (hereafter referred to as “Garden Co-Chairs”), for the purpose of establishing and
maintaining a Rosie the Riveter Memorial Rose Garden (hereafter referred to as “the Garden”) to be
located within the Gardens outside the Fountain Hills Library located at 12901 North La Montana Drive.
WHEREAS the aforementioned Parties, Sami’s, the Town, and Garden Co-Chairs desire to enter into the
herein described agreement in which they shall work together to accomplish the goals and objectives
set forth for a trial period of one year.
AND WHEREAS Sami’s, the Town, and Garden Co-Chairs desire to enter into this Memorandum thus
setting out all necessary working arrangements that all Parties agree shall be necessary to ensure this
Garden shall always be a viable attribute for the Town and the Community.
MISSION
Our Mission is to create a thriving Garden that memorializes the contributions of 6M American women
who left their homes and went to work during WWII. In addition to being a beautification project for the
Town, this Garden will also serve as an educational opportunity for residents and visitors.
PURPOSE
The Purpose of the Memorandum is to provide the framework, if needed, for any future binding
contract which may be related to the Project.
OBLIGATIONS of the PARTNERS
The Partners acknowledge that no contractual relationship is created between them by this
Memorandum, but agree to work together in the true spirit of partnership to ensure there is visible and
responsive leadership of the Garden project by means of the following services.
COOPERATION
The activities and services for the Garden shall include, but not limited to:

1. Services to be rendered by the Town include:
a. Provide a location for planting and irrigation as marked in Appendix I
b. Agree to review the progress of the Garden at time periods of six months, and one year
after planting
c. Notify Garden Co-Chairs of any vandalism or other unsightliness for remediation
2. Services to be rendered by Garden C0Chairs include:
a. Act as Stewards for the Garden
b. Ensure the proper experts care for the Garden, thereby presenting a healthy appearance of
the Garden
c. Ensure these experts utilize the proper materials, soil amendments and preventative care
for the Garden
RESOURCES
The partners will endeavor to have final approval and secure any financing necessary to fulfill their
individual contributions at the start of the planning for the development of the Garden.
1. The Town hereby agrees to provide the following:
a. Parcel of land for planting of three rose bushes, and an adjacent parcel for three
additional roses after a successful one-year trial period
b. Sufficient irrigation scheduled to ensure the Garden receives adequate moisture
c. Supplemental water source available for planting and feeding the roses
2. Garden Co-Chairs agree to seek funding for:
a. The required materials, labor and financial resources for the care of the Garden
COMMUNICATIONS
Communications to the public shall always be consistent with the Mission:
1. Education efforts for the National Spirit of ’45, National Rosie the Riveter Memorial Rose
Garden, National Rosie the Riveter Day, etc.
2. Recognition of local “Rosies”
LIABILITY
No liability will arise or be assumed between the Partners of this Memorandum.
DISPUTE RESOLUTION
In the event of a dispute between the Partners, the Partners agree to work together amicably to make a
compromise to achieve the goals and objectives of this Memorandum.
TERM
This Memorandum shall be effective as of the date set forth above for the period of one year. The term
can be extended only by the agreement of the Partners.

NOTICE
Any notice or communication required or permitted under the Memorandum shall be sufficiently given
if delivered in person or by certified mail, return receipt requested, to the address set forth in the
opening paragraph or to such other address as one party may have furnished to the other in writing.
GOVERNING LAW
This Memorandum shall be construed in accordance with the laws of the state of Arizona.
ASSIGNMENT
Neither party may assign or transfer the responsibilities or agreement made herein without the prior
written consent of the non-assigning parties, which approval shall not be withheld.
AMENDMENT
This Memorandum may be amended or supplemented in writing, if the writing is signed by the party
obligated under this Memorandum.
SEVERABILITY
If any provision of this Memorandum is found to be invalid or unenforceable for any reason, the
remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this
Memorandum is invalid or unenforceable, but that by limiting such provision it would become valid and
enforceable, then such provision will be deemed to be written, construed and enforced as so limited.
PRIOR MEMORANDUM SUPERSEDED
This Memorandum constitutes the entire Memorandum between the parties relating to this subject
matter and supersedes all prior or simultaneous representations, discussions, negotiations and
Memorandums, whether written or oral.
UNDERSTANDING
It is mutually agreed upon and understood by and among the Partners of this Memorandum that:
1. Each Partner will work together in a coordinated fashion for the fulfillment of the Garden.
2. In no way does this agreement restrict involved Partners from participating in similar agreement
with other public or private agencies, organizations, and individuals.
3. To the extent possible, each Partner will participate in the development of the Garden.
4. Nothing in this Memorandum shall obligate any Partner to the transfer of funds. Any endeavor
involving the reimbursement or contribution of funds between the Partners of this
Memorandum will be handled in accordance with applicable laws, regulations and procedures.
Such endeavors will be outlined in separate agreements that shall be made in writing by

representatives of the Partners involved and shall be independently authorized by appropriate
statutory authority. This Memorandum does not provide such authority.
5. This Memorandum is not intended to and does not create any right, benefit or trust
responsibility.
6. Any Partner may terminate its participation in this Memorandum by providing written notice to
the other Partners.
SIGNATORIES
This agreement shall be signed on behalf of Sami’s Fine Jewelry by Stephanie Lochner, Manager, on
behalf of the Town of Fountain Hills by ____________________________,________________, and on
behalf of the Rosie the Riveter Memorial Rose Garden by Judy and Jim Winzell, Co-Chairs, Rosie the
Riveter Memorial Rose Garden. This agreement shall be effective as of the date first written above.

FOUNTAIN COLOR AND OPERATIONAL GUIDELINES
Policy: Establish an internal operating procedure for the colors of the light displays at the Fountain
at Fountain Park.
Procedure: The light displays shall be programmed as follows:
1. The Fountain controller has the capability of playing in basic mode:
2. Static Display Mode - The Town may program the fountain to display a solid or static mix of
colors to highlight additional selected holidays, city events and national days/months of
recognition or as a result of an approved Special Static Color Display.
3. Special Static Color Display Application Process. Programming of the fountain is normally
controlled by the Parks and Recreation Department. Requests for Special Static Color Displays
shall be reviewed and approved in accordance with the following process and guidelines:
b) Other requests:
i) Requests for Special Static Color Displays must be submitted in writing to the
Fountain Hills Parks Superintendent no less than four weeks and no more than
one year in advance. All applicants will acknowledge the Special Static Color
Display Operational Information listed in #4 below. Any requests that are
inconsistent with the Special Static Color Display Operational Information will
not be considered or approved. The Fountain Hills Parks Superintendent will
inform such requestors that they have made requests that are inconsistent with
the Special Static Color Display Operational Information.
ii) The Fountain Hills Parks Superintendent will promptly forward any written
requests which are consistent with the Special Static Color Display Operational
Information to the Families, Parks & Recreation Department Director, Director
of the Office of Communications and the Mayor and Town Council) who will
determine eligibility of the Special Static Color Display request. A request will
only be approved if it:
a) is intended to educate or enlighten the public about a significant health
or safety issue;
b) is intended to draw public attention to an activity or event sponsored
by the Town of Fountain Hills;
c) promotes an event scheduled at a Fountain Hills Venues Department
facility;
d) promotes a state or national holiday or day of remembrance.
e) NO PERSONAL USE i.e. BIRTHDAYS, GENDER REVEAL
Organizations or promoters that have rented the entire park or the amphitheater
for an event during the requested Special Static Color Display time will be
given priority. (I think this is ok if they meet the above requirements)
ii) The Committee will notify the Fountain Hills Parks Superintendent of its
decision and the Fountain Hills Parks Superintendent will notify the requestor
whether its application has been approved.
4. Special Static Color Display Operational Information.
a) No more than four (4), Special Static Color Displays will be allowed within any
calendar month. Each of these special color events will be permitted to last a single
night, with the exception of national holidays and national health observations, which
may be extended for several nights at the discretion of the Community Services
Director.
b) Approvals will not be granted for multiple years at a time nor will they be
automatically approved for successive years.
c) Under no circumstances should an event promoter advertise the color of the fountain
unless written approval has been received for the Special Static Color Display. This
approval may be in the form of a written notification from the Fountain Hills Parks
Superintendent.
d) The color selections may be combinations of colors for Special Static Color Display,
but must remain static for the duration of that request. Colors cannot be altered or
changed after approval and the fountain has been programmed.
e) The Fountain Hills Parks Superintendent or his designee is the only person(s) that
may log on to the computer that controls the fountain shows.
f) The fountain will operate daily from 7:00 am to 9:00 pm
g) All display approvals are contingent on equipment operation and maintenance and
no approval guarantees any rights with respect to the fountain’s operations nor to any
damages should the fountain fail, for any reason whatsoever, to operate as planned.
h) The nine colors available are:
i. Red
ii. Blue
iii. Teal
iv. Yellow
v. White
vi. Green
vii. Orange
viii. Pink
ix. Purple
