Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory exceptions, parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the Commission are audio and/or video recorded and, as a result, proceedings in which children are present may be subject to such recording. Parents, in order to exercise their rights may either file written consent with the Town Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made, the Town will assume that the rights afforded parents pursuant to A.R.S. §1-602.A.9 have been waived.  REQUEST TO COMMENT The public is welcome to participate in Commission meetings. None 4.CONSIDERATION AND POSSIBLE ACTION: Trail Master Plan Commissioner Willard began the discussion with the finding of the Preserve Master Plan that was approved by the Town Council in 2004 and asked for all to review. Commissioner Craig pointed out items related to the Mission Statement from the 2004 Preserve Master Plan and noted the mission was to "preserve this setting" for future residents as open space. Pointing out it is the nighttime setting as well as the "construction of specific walking trails to provide the public with the opportunity to explore all directions within the preserve." Chairman Grzybowski asked if a procedural motion at some point would be needed to supersede the older document with the new document. Ms. Goodwin confirmed that it would be necessary. Chairman Grzybowski stressed that this outdated plan would need to be combined to be the new Master Trail Plan inclusive of the Guidelines and Principles from the Preserve Master Plan. Ms. Goodwin shared that the Master Trail Plan is the context to be discussed as noted on today's meeting agenda. Commissioner Willard stated Conservancy input had been not been received but was hoping by the next meeting to have that information available to share. Commissioner Holden had gone through with edits to clarify the immediacy of the potential of the preserve system to be built out. Commissioner Willard will be responsible for updating all changes submitted to him in this thorough document. Discussion ensued on the distance from property lines and obtaining that information to also include in the guidelines. Commissioner Holden wanted to break apart the North Leg as an in and out and then again to go through vetting as a loop. It was also noted by Commissioner Holden that funding requirements were important to consider for future trails and how they would be built. Commissioner Nurney asked how input from the public was received and Chairman Grzybowski shared that it was in the Community Services Master Plan. Surveys were conducted in April 2021 and town input was received that documented what residents were looking for. CONSIDERATION AND POSSIBLE ACTION: Appointment of a Vice ChairpersonChairman Grzybowski called for the nomination of a Vice-Chair due to the resignation of Tom Chairman Grzybowski called for the nomination of a Vice-Chair due to the resignation of Tom Barberic from MMPC. Commissioner Nurney asked what was required of the Vice-Chair and Chairman Grzybowski explained that if the Chair is not in attendance, the Vice-Chair oversees the meeting agenda. MOVED BY Chairman Scott Grzybowski, SECONDED BY Commissioner DJ Willard Vote: 6- 0 - Unanimously 7.REVIEW AND DISCUSSION: Commission Vacancy Chairman Grzybowski asked about the process to fill the vacancy left by the resignation of Commissioner Barberic. The commissioners were informed that the Town Clerk will be posting the open position and term for any interested residents to apply. Interviews will be conducted by a Sub Committee made of Town Council members. The Mayor will be announcing the new commissioner at a future Town Council meeting. Tom Barberic's term is to expire in October 2022. 8.CONSIDERATION OF AND POSSIBLE ACTION: Approval of Trail Master Plan A revised draft of the MMPC Trail Master Plan was sent to the commissioners for review. It was discussed if a special meeting was needed to finalize it and Commissioner Willard requested that it go before Town Council as soon as possible. Commissioner Craig informed the commissioners that the Lower Ridgeline Trail will be completed and after council approval will be ready to get started on the North Leg. It was noted that the end of April is the end of trail season. commissioner Craig requested to push for the March 15th Town Council meeting date. That would require items to be completed by February 28th to get into the packet. The Conservancy is a stakeholder and it was discussed whether to add their input as an appendix. It was agreed upon by Chairman Grzybowski to include their input. Commissioner Nurney agreed that the vetting criteria from the Conservancy should be taken into consideration. Commissioner Holden shared that the Conservancy was conservation-minded and would be happy with no other trails on the 824 acres of the preserve. Commissioner Willard expressed that the Upper Sonoran Trail would be good and that the Sonoran Quartz Connector Trail was supported by the Conservancy. He questioned if it should remain in the plan and Chairman Grzybowski stated it should be left in. There was discussion about Promenade Maintenance and looking at an alternate route for safer conditions. Mr. Snipes, Parks Superintendent addresses mitigating backout drains that are undersized. It will be necessary to do something different with equipment up there as the rock will continue to break down. Commissioner Craig added to also look at what is below the surface and if solid rock. Additional items discussed were trail maintenance, guiding principles, and consideration of Town input. 9.DISCUSSION WITH POSSIBLE DIRECTION: Golden Eagle and Adero Canyon Trailhead Info Signs Ms. Goodwin requested that edits be sent that will reflect a better consistency in signage. It was agreed to add no hunting. Chairman Grzybowski asked about the bike lane in Adero Canyon and Mr. Snipes shared that Director Weldy was looking at the downhill side to see a viable option. 10.REVIEW AND DISCUSSION: Action Items McDowell Mountain Preservation Commission Meeting of January 25, 2022 2 of 3 Commissioner Grzybowski shared with the commission that there were no new items on the Action Items list. He informed the commissioners that the drainage water tank issue has been addressed by Kevin Snipes, Parks Superintendent. Mr. Snipes also informed the commissioners that the Development Director, Justin Weldy, was is looking at the downhill side to see viable options and the addition of "weekend only" signage. 11.REVIEW AND DISCUSSION: Trail Counter Activity and Trail Counter Recorder The Trail Counter Activity was reviewed and further discussion on the need for new trail counters. 12.UPDATE: Sonoran Conservancy Fountain Hills Commissioner Holden informed the commissioners that there is a need for volunteers to meet and greet at Adero Canyon Trailhead. Thre was discussion on the kiosk at Adero and the inclusion of a map of the Preserve. NONE 4.CONSIDERATION OF AND POSSIBLE ACTION: Trail Master Plan The MMPC Special Meeting was held to discuss edits made to the Trail Master Plan that had been sent to Commissioner Willard to provide an updated draft for review. The MMPC Commissioners intend to have a final copy ready for approval at their February 22, 2022 meeting. Commissioner Willard went through the changes that were sent to him one by one for additional feedback and clarification. Ms. Goodwin informed the commissioners pending no objections to any of the other add-ons if they have one final marked-up version that they want to adopt that says "pending all the changes that were discussed" they can do that and not have to come back with a clean copy at a future meeting. Provided changes are not significant and commissioners agree to move forward with a vote. Commissioner Willard followed up stating they could conceptually agree and since they are meeting in another two weeks can have changes made. Commissioner Willard commented that two items should go before Town Council for their approval, one being the Trail Master Plan and the other part the approval of the North Leg Trail. Ms. Goodwin agreed putting two separate items on the agenda for Town Council approval would be best if they take exception to the Trail Master Plan. It does not preclude moving forward with the North Leg Trail project. Commissioner Nurney started the discussion on changes he noted on the Trail Options page which talked about repairs and improvements. Chairman Grzybowski confirmed that MMPC had fully vetted and approved of the North Leg. Commissioner Craig added that this should be called the "North Leg Loop." The Conservancy is looked upon for their input. Commissioner Holden shared that the North Leg Loop was not recommended by the Conservancy. Ms. Goodwin added that conceptually the Conservancy is asked of their concerns but ultimately this is a plan that is guided by the Commission. While feedback from the stakeholders is important they do not make the final decision. It is the Town Council’s decision on what is in the best interest of the preserve over the next ten years. Commissioner Willard noted further that the commission has not made a judgment “these are the trails that may be built” if the discussion were in favor of building the trails noted in the plan. The Conservancy also had noted for consideration spider trails and visibility from the promenade. Due to the nature of the terrain Commissioner, Willard shared that there was no visibility from the promenade. It was reiterated by Commissioner Willard that these trails may be built but the Commission has not weighed in on all of them yet. The Conservancy input is more appropriate when the committee begins vetting the trail and comments are shared that have not been addressed yet. Commissioner Holden stated 5 years from now looking at the trails to be vetted may look different with a change with the commissioners. Ms. Goodwin stated this Master Plan is a forward-looking document and as each trail is considered it will be reviewed in its current capacities. This is a living document and things can change. Ms. Goodwin asked if there will be sufficient resources or will there be a need for outside help. Commissioner Holden noted trail maintenance plan would not have enough volunteers and asked if there are enough people to build a new trail. A plan for the construction of a trail should be included in the North Leg vetting was added by Commissioner Willard. Chairman Grzybowski shared that it is included in the MMPC vetting process and the funding requirements. Commissioner Willard added that they are saying Conservancy/Trailblazers are committing to do this and maybe with outside help great addition “trail-specific” Commissioner Holden suggested that a construction trail plan is needed and should include resources. Chairman Grzybowski asked that for the North Leg vetting add a bullet for “is there sufficient resources to build this trail?” The answer to that was “YES”. Chairman Grzybowski requested the Appendix be added and page numbers. Commissioner Willard asked for any new edits to be sent to him by February 14, 2022. Ms. Goodwin added the approval timeline would allow for a formal motion to adopt the Master Trail Plan by MMPC on February 22, 2022, with Town Council adoption on April 5, 2022, with Commissioner Craig as the presenter providing maps of what Council is voting on. 5.ADJOURNMENT MOVED BY Commissioner DJ Willard, SECONDED BY Commissioner Janice Holden Vote: 5 - 0 - Unanimously Meeting Adjourned at 5:17 pm. On page three it was discussed to add the word "Trail" next to North Leg to keep it consistent with the map. Further discussion followed related to allowing bikes on the new trail. Commissioner Craig expressed that no bikes should be on a short trail. Commissioner Holden noted that bikes are not allowed on the Overlook Trail. Commissioner Nurney shared that he is a mountain biker and asked if the commission was concerned about the safety of the hiker or biker. Chairman Grzybowski stated the safety of both is to be considered as it will be a narrow path. Commissioner Jennings added that the website includes a policy on bikes that addresses "no wheeled vehicles." This will be a future action item for the workgroup to address. Chairman Grzybowski added that the bicycle criterion to be added to the March agenda to amend 9.53 Item P. After further discussion, it was agreed to move forward to approve the Master Trail Plan as amended with all identified edits. MOVED BY Commissioner DJ Willard, SECONDED BY Chairman Scott Grzybowski Vote: 6 - 0 - Unanimously 9.REVIEW AND DISCUSSION: Action Items The review of Town Code 9-3-5 Item P was discussed and requested to continue that discussion at the March 22, 2022 meeting. The topic of closing railheads is also to be added to the March or April agenda for further discussion. Determining factors discussed was snow, fire, heavy rains with input from Mr. Snipes, Parks Superintendent. Parking on the street at Adero Canyon is a topic in progress with a final decision needed. Parks and Recreation promenade drainage rerouting. Scope is to change to align with MMPC and SCFH. 10.REVIEW AND DISCUSSION: Trail Counter Activity and Trail Counter Recorder The Trail Counter Activity chart was reviewed by commissioners. Ms. Goodwin recommended the purchase of two trail counters by the end of the fiscal year. 11.UPDATE: Sonoran Conservancy Fountain Hills Commissioner Holden reported on the conservancy recording 300 volunteer hours serving the trailheads. There have been 22 hikes/walk events and will be adding 3 more quarter moon hikes with the third one in May. This consisted of removing slough, removing loose rocks, removing overgrown foliage, removing berms, and smoothing out the trails. This took most of the season but a thorough job was done. Following our maintenance efforts, we completed the building of the Lower Ridgeline Trail and opened this new trail. Signage for this trail has been requested and will be installed when we receive these new signs. At the Town Council meeting on April 19th our request for approval to build a new trail, to be called North Leg Trail, was approved. As a result, we will be spending the final 2 Saturday mornings of this season starting to create this new trail. During the 2021-2022 season, 44 different people worked on our trails. As indicated we have two Saturdays to work as yet, but I estimate that so far the Trailblazers have given the Town of Fountain Hills 933 hours of volunteer service (not counting the extra hours that I put in).
