Commissioners of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum of the
Town’s Council, various Commission, Committee or Board members may be in attendance at the Commission meeting.
Notice is hereby given that pursuant to A.R.S. §1-602.A.9, subject to certain specified statutory exceptions, parents have a
right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings
of the Commission are audio and/or video recorded and, as a result, proceedings in which children are present may be subject
to such recording. Parents, in order to exercise their rights may either file written consent with the Town Clerk to such
recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a
child is present at the time a recording is made, the Town will assume that the rights afforded parents pursuant to A.R.S.
§1-602.A.9 have been waived.

contiguous minutes to address the Commission. Verbal comments should be directed through the
Presiding Officer and not to individual Commissioners.

1. CALL TO ORDER AND PLEDGE OF ALLEGIANCE
Chairman Myers called the meeting of Tuesday, November 26, 2019, to order at 6:05 p.m. in the Council
Chambers at Town Hall, located at 16705 East Avenue of the Fountains, Fountain Hills, Arizona.
2. ROLL CALL
COMMISSIONERS PRESENT: Chairman Bill Myers, Vice Chairman Tom Barberic, Commissioners Bill
Craig, Paul Garvey, Scott Grzybowski, and Darrienne Slater.
COMMISSIONER ABSENT: Thomas Aiello.
STAFF PRESENT: Community Services Director Rachael Goodwin and Executive Assistant Jamie
Salentine.
3. CALL TO THE PUBLIC
There was no comments from the citizens present.
4. CONSIDERATION OF APPROVING THE OCTOBER 22, 2019 MEETING MINUTES
Commissioner Garvey asked that a correction be made to item #8, paragraph 6 to read: Commissioner
Garvey expressed concern about the construction along the promenade trail where significant rocks have
been placed in numerous drainages.
Vice Chairman Barberic moved to approve the October 22, 2019, meeting minutes as amended, seconded
by Commissioner Grzybowski; passed unanimously by those present (6-0).
5. UPDATE ON 2020-2023 COMMUNITY SERVICES STRATEGIC PLAN
Community Services Director Rachael Goodwin stated that Town Council will have the 2020-2023
Community Services Strategic Plan on the January 7, 2020 agenda for consideration of adoption and
requested that the Commission attend the Council meeting if available.
6. UPDATE ON FOUR PEAKS PARK PLAYGROUND GRAND OPENING
Community Services Director Rachael Goodwin commented that the grand opening for the new playground
equipment at Four Peaks Park is on December 21, 2019 from 11:00 a.m. – 1:00 p.m. and invited the
Commission to attend. She pointed out that there will be crafts, prizes, and hot cocoa.
In response to a question posed by Chairman Myers, Ms. Goodwin replied that the playground equipment

was provided through grant funding saving the Town 30-40%. She stated that the smaller structure was
provided through GameTime and the larger structure was Kompan. She added that swings were added to
the structure.
Ms. Goodwin emphasized the playground equipment is safe and installed, looking into shade structure to
be installed over summer, and that there will be more updates coming to Four Peaks Park.
Community Services Director Rachael Goodwin reported that the Department is the recipient of the Arizona
Sports and Tourism Authority Grant for funding of one basketball court at Four Peaks Park.
7. UPDATE ON TRAIL COUNTER ACTIVITY
Commissioner Craig reported that he is waiting to hear from Scott Hamilton from the City of Scottsdale
regarding purchasing trail counters they are not using, due to the fact that the Town’s trail counters are not
working.
8. UPDATE ON ADERO CANYON TRAILHEAD (ACT) CONSTRUCTION
Community Services Director Rachael Goodwin stated that her understanding, utility work is still occurring
at ACT. She noted that sewer/water testing is to begin next week and then dry utilities start after that. She
added that the Trailhead hours are still the same at this time, which is no pedestrian access during business
hours (sunrise until 3:00pm) and then sunrise to sunset Saturday and Sunday.
Vice Chairman Barberic stated the opinion that he would like to see no hiking during the week.
Ms. Goodwin commented that the decision of the hiking hours is handled by the Town Manager’s office
and will pass the comment to the Town Manager. She added that the Developer’s Agreement does ask for
access and that the office receives calls that request access to the trailhead as well as complaints. She pointed
out that they are having issues with vehicles driving up to the trailhead versus parking at the end of the
paved area. She noted that they are addressing as to how to secure the entrance better, however, it is Toll
Brothers issue.
Ms. Goodwin reported that staff spoke with Epcor last week regarding water access and water pressure
getting to the restrooms in order to run them as well as the irrigation.
In response to a question from Vice Chairman Barberic, Ms. Goodwin replied that prior to the road being
paved utilities much go in first and is guessing the road would be paved after the first of the year.
Discussion ensued relative to accessing the trailhead via driving, improving the barrier to stop drivers, and
reporting the violators via the non-emergency Sheriff’s line.
In response to a question posed by Chairman Myers, Ms. Goodwin stated that staff will not know of a grand
opening for ACT until the project is complete.

9. UPDATE AND DISSCUSSION OF 2019 MMPC WORKGROUPS

a. Preserve Marketing and Fairs
Commissioner Grzybowski reported on the Fountain Hills Arts and Craft Fair, which the Conservancy
booth had 1,164 people stopped by and all brochures handed out.
b. Safety
Chairman Myers stated that updates will be given at the January meeting.
c. Trailheads
In response to a question from Chairman Myers, Community Services Director Rachael Goodwin
replied that she is unware of a gate being put in and where the additional signs would be placed, however,
will look into.
Chairman Myers clarified that the four (4) benches located on the ACT will remain on the trail.
Vice Chairman Barberic stated that comments made at the last meeting mentioned that the donor would
request where the bench would be placed and suggested that the MMPC decide where the bench would
be placed.
d. Value of Preserve
Commissioner Craig stated that the QR codes will be removed as they hike.
Vice Chairman Barbaric thanked Chairman Myers for his 11 years of service to the MMPC and input at
ACT.
Ms. Goodwin stated that Chairman Myers will be recognized at the December 17, 2019 Town Council
meeting that starts at 5:30 p.m.
10. ADJOURNMENT
Commissioner Craig moved to adjourn, seconded by Commissioner Grzybowski; passed unanimously by
those present (6-0).

Section 9-5-1 Purpose and Intent
The Fountain Hills McDowell Mountain Preserve (“the Preserve”) encompasses a scenic area of mountainous,
pristine land within Fountain Hills that will be preserved in its natural state for the benefit of this and future
generations. In order for the Town to achieve tandem goals of providing trails and trailhead locations to facilitate
public access into the Preserve and to safeguard the Preserve for this and future generations, a thorough set of
Preserve, trailhead and trails regulations are needed. These regulations are specifically intended to accomplish the
following:
A. Maintain the existing undisturbed, desert environment of the Preserve.
B. Provide for Preserve use regulations that will maintain wildlife habitat and limit human encroachment to
specific areas within the Preserve.
C. Provide use regulations for the Central Trailhead that will provide public access into the Preserve.
D. Provide use regulations for the Golden Eagle Trailhead, including access control into the Preserve through
McDowell Mountain Park.
E. Provide for the development of a trail system within the Preserve and connectivity to abutting trail systems in
the City of Scottsdale and within McDowell Mountain Park. (02-01, Added, 01/17/2002)
Section 9-5-2 Definitions
“Camping” means any effort to erect a tent or shelter, sleeping, use of a sleeping bag, or the parking of a trailer or
camper for the purpose of sleeping or remaining overnight.

The Fountain Hills Town Code is current through Ordinance 19-15, and legislation passed through October 1, 2019.
“Central Trailhead” means the developed portions of that trailhead located at the terminus of Eagle Ridge Drive.
“Emergency Access Route” means that roadway between the Central Trailhead and the southwestern corner of the
Eagles Nest subdivision that can be used to evacuate people out of the Eagle Ridge North subdivision.
“Golden Eagle Trailhead” means the developed portions of that trailhead located at the public terminus of Golden
Eagle Drive.
The “Preserve” shall mean those lands identified by Resolutions 2002-01 and 2018-56 as the Fountain Hills
McDowell Mountain Preserve.
“Special preserve permit” means a noncommercial permit issued by the Parks and Recreation Department
required for group functions in and around the Central Trailhead.
“Spider trail” means an unauthorized trail or pathway within the Preserve.
“Trail” means an authorized pathway within the Preserve.
“Violation” means any act that violates any of the rules or regulations contained within this article, punishable as
specified in Section 9-5-7. (19-05, Amended, 03/19/2019; 02-01, Added, 01/17/2002)
Section 9-5-3 General Preserve Regulations
The following are prohibited within the Preserve:
A. Accessing the Preserve by leaving a trail or trailhead. All Preserve visitors shall stay on authorized trails and
within trailheads, unless approved by the Director of Community Development.
B. Accessing the Preserve outside of the posted hours of operation, unless approved by the Director of
Community Development.
C. Alcoholic beverages.
D. Camping.
E. Carrying or using any type of glass or ceramic container.
F. Creating, developing or using any type of spider trail.
G. Destroying any barriers, signs, or other Town property.
H. Destroying, damaging or removing any vegetative or mineral resource, including but not limited to any tree,
shrub, wildflower, cactus or rock outcropping, unless specifically authorized by the Town with an encroachment
permit granted by the Town Council.
I. Dogs are prohibited unless on a 6-foot maximum leash at all times, and must remain on trails.
J. Horses.

K. Hunting, trapping or otherwise harming or harassing any wildlife.
L. Littering or depositing garbage, trash, refuse or other obnoxious material anywhere other than in specific
Town-provided containers provided for that purpose.
M. Setting or igniting any type of fire.
N. Smoking.
O. Throwing rocks or other objects into washes, including but not limited to up or down hillsides and on or off
trails.
P. Using any vehicle, including motorized vehicles and bicycles, except authorized maintenance vehicles and
during emergency evacuations along the Emergency Access Route as directed by emergency personnel.
Q. Using or discharging any firearm, bow and arrow, slingshot or other weapon.
R. Geocaching, except within three feet of an established town trail. (19-13, Amended, 08/13/2019; 18-13,
Amended, 11/06/2018; 02-01, Added, 01/17/2002)
Section 9-5-4 Central Trailhead Regulations
In addition to the prohibitions in Section 9-5-3, the following are prohibited within the Central Trailhead:
A. Accessing or utilizing the Central Trailhead outside of the posted hours of operation.
B. Alcoholic beverages, unless as approved by Special Preserve Permit.
C. Groups of 20 or more people without a Special Preserve Permit, to ensure adequate available parking.
D. Horses or horse trailers.
E. Parking vehicles outside of designated parking spaces.
F. Parking vehicles in the school bus parking spaces, except on weekends. School buses may utilize these parking
spaces with prior Town approval.
G. Use of a covered ramada that has been reserved by others, through a Special Preserve Permit.
H. Vehicles longer than 19 feet. (02-01, Added, 01/17/2002)
Section 9-5-5 Golden Eagle Trailhead Regulations
The Golden Eagle Trailhead is a public parking area to provide a primary point for access into the southwestern
portion of McDowell Mountain Park from the Town of Fountain Hills. It may also be possible to access the
Preserve, through McDowell Mountain Park, from the Golden Eagle Trailhead. All users of the Golden Eagle

The Fountain Hills Town Code is current through Ordinance 19-15, and legislation passed through October 1, 2019.
Trailhead will be directed along public access easements through a private subdivision to gain access to McDowell
Mountain Park. All users of McDowell Mountain Park shall abide by those rules and regulations established by
Maricopa County for McDowell Mountain Park. In addition to the prohibitions in Section 9-5-3, the following are
prohibited within the Golden Eagle Trailhead:
A. Accessing or utilizing the Golden Eagle Trailhead outside of the posted hours of operation.
B. Horses or horse trailers.
C. Vehicles longer than nineteen (19) feet. (19-13, Amended, 08/13/2019; 01-23, Added, 01/17/2002)
Section 9-5-6 Trailhead and Trail Development
The McDowell Mountain Preserve Commission will be responsible for the design of any trailhead and the
development of any trails within the Preserve. (02-01, Added, 01/17/2002)
Section 9-5-7 Penalties
The Rules and Regulations contained in Article 9-5 will be considered petty offenses and/or Class 1 Misdemeanors
as specified under subsections A through C below:
A. Violations of the rules and regulations contained in subsections 9-5-3 (A, B, C, E, F, I, J, L, N and O) and Sections
9-5-4 and 9-5-5 shall be considered a petty offense if the offender has not been convicted of the same infraction
within the last twenty-four (24) months. Petty offenses shall be punishable by a fine of up to one hundred dollars
($100.00).
B. Subsequent conviction(s) of the same subsections 9-5-3 (A, B, C, E, F, I, J, L, N and O) and Sections 9-5-4 and
9-5-5 within a twenty-four (24) month period shall be considered a Class 3 Misdemeanor, and will be punishable as
such under State Law.
C. Violations of the rules and regulations contained in subsections 9-5-3 (D, G, H, K, M, P and Q) of this section
shall be considered a Class 1 Misdemeanor and will be punishable as such under State Law. (02-01, Added, 01/17/

Section 9-5-8 Severability
Should any section of this Article be determined to be void, unlawful or of no effect, the remaining sections shall
continue to be fully applicable and shall be deemed to be in full force and effect. (02-01, Added, 01/17/2002)
