The purpose of this survey was to gather information on residents' level of satisfaction with town services with the aim of using the feedback to help the town make improvements to service levels. The purpose of this survey was to gather information on residents' level of satisfaction with Town services and to gather opinions in regards to other topics. Information received will be used to help Town leaders know where they are doing well and where they can improve. Data from the survey will aide these leaders to make certain they are making decisions that align to the needs of the Town residents and prioritizing services that will positively impact the community. The survey instrument, cover letter, and postage paid return envelope were mailed to a random sample of households in the Town. The cover letter explained the purpose of the survey and encouraged residents to either return their survey by mail or complete the survey online. Approximately, ten days after the surveys were mailed, ETC Institute sent emails/text messages to the households that received the survey to encourage participation. The emails/texts contained a link to the online version of the survey to make it easy for residents to complete. To prevent people who were not residents of the City from participating, everyone who completed the survey online was required to enter their home address prior to submitting the survey. ETC Institute then matched the addresses that were entered online with the addresses that were originally selected for the random sample. If the address from a survey completed online did not match one of the addresses selected for the sample, the online survey was not counted. The goal was to obtain 400 surveys and this goal was achieved by a total of 465 completed surveys. The overall response for the sample of 465 households have a precision of at least +/- 4.5% at the 95% level of confidence. Residents are satisfied with the quality of garbage, refuse collection services, fire protection services, and parks & recreation programs/facilities. Residents think the maintenance of streets and infrastructure is the most important service and should have the most emphasis from Town leaders. Fire protection services, maintenance of streets and infrastructure, Maricopa County Sheriff's Office services, and garbage and refuse collection services are services residents would be the least willing for leaders to reduce or eliminate. Residents have a low positive perception of the Town's quality of retail, restaurant, and entertainment businesses, the ability to participate in decision-making processes, the leadership of the Town's elected officials, and the accessibility and transparency of information provided by the Town Council. About half of residents currently use the Town's website to get information about the Town and about half find the usefulness of the Town's website to be excellent/good. Which could attribute to the Town's ratings of the ease of accessing various communication services, the level of satisfaction resident's have with the Town's accessibility and transparency of information provided by the Town Council, availability of information about programs/services, and the Town's efforts to keep residents informed about local issues. Which correlates with residents' opinion that they think, overall, the quality of life in Fountain Hills is excellent/good. The graph below shows how residents responded when they were asked to rate, based on their observations and experiences during the past year, Fountain Hills for various perception items. The perception items that had the highest ratings, based on the sum percentage of excellent and good responses, were: Fountain Hills as a place to live (98.7%) Fountain Hills as a place to retire (95.2%) Fountain Hills as a place to visit (86.6%) Fountain Hills as a place to raise children (73.4%) As shown below, Fountain Hills as a place to work (57.9%) and Fountain Hills as a place to do business (42.8%) were the bottom two items with the lowest ratings of excellent/good. Residents were asked to rate their level of satisfaction with major categories of Town services and the top three services with the highest sum percentage of very satisfied and satisfied responses were: the quality of garbage and refuse collection services provided by Republic Services (92.1%), fire protection services (92.0%), and parks and recreation programs/facilities (87.3%). As the graph shows below, the bottom three major categories of services were: effectiveness of the Town's communication with the public, maintenance of Town streets and infrastructure, and enforcement of Town codes and ordinances by the Town. 61.5% of residents were either very satisfied or satisfied with the effectiveness of the Town's communication with the public; 29.0% were neither satisfied or dissatisfied and 9.5% were either dissatisfied or very dissatisfied. 49.1% of residents were either very satisfied or satisfied with the maintenance of Town streets and infrastructure; 24.9% were neither satisfied or dissatisfied and 26.0% were either dissatisfied or very dissatisfied. 46.3% of residents were either very satisfied or satisfied with the enforcement of Town codes and ordinances by the Town; 36.3% were neither satisfied or dissatisfied and 17.4% were either dissatisfied or very dissatisfied. Findings Report: Town of Fountain Hills Community Survey (2021) ©2021 ETC Institute Page v Town of Fountain Hills Community Survey Executive Summary Major Findings Maintenance of Fountain Hills' streets and infrastructure are not only one of the most important services residents feel should receive the most emphasis from leaders over the next two years, it is also a service that residents would not be willing to see services be reduced/eliminated. Residents were asked to rate their top three major categories of Town services they think should receive the most emphasis from Town leaders over the next two years. Based on the sum of resident's top three choices, the top four services with the highest percentage of responses were: Maintenance of streets and infrastructure (74.4%) Quality of Maricopa County Sheriff's Office services (35.7%) Quality of parks and recreation programs/facilities (30.3%) Flow of traffic and ease of getting around Town (29.7%) Residents were asked to rate, if the Town needed to reduce or eliminate major services, which three services they would be most willing for the Town to reduce/eliminate. The top three services residents would be willing for the Town to reduce or eliminate are; library program/services (35.9%), enforcement of Town codes and ordinances (33.0%), and effectiveness of the Town's communication with the public (29.3%). The four services that residents would be the least willing for the Town to reduce or eliminate are listed below. Findings Report: Town of Fountain Hills Community Survey (2021) ©2021 ETC Institute Page vi Town of Fountain Hills Community Survey Executive Summary Major Findings Over three-quarters of residents are satisfied with the cleanliness and maintenance of landscaping of streets, other public areas, and the condition of street signs and traffic signals. The condition of major streets and neighborhood streets in Fountain Hills had the highest dissatisfied ratings for the Town maintenance category of services. The Town maintenance services that had the highest ratings of satisfaction were; the cleanliness of streets and other public areas (82.5%), condition of street signs and traffic signals (78.5%), and the maintenance of landscaping along major streets (77.2%). Residents were the least satisfied with the condition of major streets (61.7%) and neighborhood streets (56.6%). The graph below shows the maintenance services with the highest dissatisfaction ratings were the condition of major streets (23.2%) and neighborhood streets (26.1%). The top two Town maintenance services that resident's think should receive the most emphasis from Town leaders over the next two years, based on the sum of their top two choices, are listed below. Condition of major streets (62.8%) Condition of neighborhood streets (40.9%) Findings Report: Town of Fountain Hills Community Survey (2021) ©2021 ETC Institute Page vii Town of Fountain Hills Community Survey Executive Summary Major Findings Items that influence perception of the Town that had the highest ratings of below average and poor were the quality of retail/restaurant/entertainment businesses, the ability to participate in decision-making processes, the leadership of the Town's elected officials, and the accessibility and transparency of information provided by the Town Council. 51.3% of residents rated the quality of retail, restaurant, and entertainment businesses in the Town as excellent or good; 21.3% gave a rating of neutral and 27.3% of residents rated the quality as below average or poor. 47.6% of residents rated the leadership of the Town's elected officials as excellent or good; 32.6% gave a neutral rating and 19.8% gave a rating of below average or poor. 47.3% of residents rated the accessibility and transparency of information provided by the Town Council as excellent or good; 33.4% gave a neutral rating and 19.3% gave a rating of below average or poor. 33.1% of residents rated the ability to participate in the Town's decision-making process as excellent or good; 44.2% gave a neutral rating and 22.7% gave a rating of either below average or poor. The chart below shows that 49.3% of residents indicated they were either very satisfied or satisfied with the job the Mayor and Town Council are doing; 35.2% were neither satisfied or dissatisfied and 15.4% were either dissatisfied or very dissatisfied. Which could attribute to the Town's ratings of the ease of accessing various communication services, the level of satisfaction resident's have with the Town's accessibility and transparency of information provided by the Town Council, availability of information about programs/services, and the Town's efforts to keep residents informed about local issues. 52.3% of residents rated the usefulness of the Town's website as excellent/good; 36.3% rated the usefulness of the website as neither good or poor (neutral) and 10.9% rated the usefulness of the website as below average/poor. Residents were asked which communication sources they currently use to get information about the Town and 49.2% indicated they currently use the Town's website (in the top three sources used by residents for information). When asked what the three sources of information are resident's most preferred, 45.2% indicated the Town website is their most preferred way to learn about activities and Town services (in the top three most preferred sources). 68.5% of residents are either very satisfied or satisfied with the availability of information about programs/services provided by the Town; 25.8% are neither satisfied or dissatisfied and 5.7% are dissatisfied/very dissatisfied. 58.6% of residents are either very satisfied or satisfied with the Town's efforts to keep residents informed about local issues; 29.7% are neither satisfied or dissatisfied, and 11.7% are dissatisfied/very dissatisfied. The three communication items that had the lowest ratings of satisfaction were; how easy it is to access information about Town Board and Commision meetings (44.3%), how easy it is to access the Town's financial information (33.6%), and how easy it is to access campaing finance and lobbyist disclosures (26.5%). Findings Report: Town of Fountain Hills Community Survey (2021) ©2021 ETC Institute Page ix Town of Fountain Hills Community Survey Executive Summary Additional Findings Overall, resident's perception of safety in Fountain Hills is positive. 97.6% of residents indicated they feel very safe or safe in their neighborhood during the day and 91.3% feel very safe or safe in their neighborhood at night. 79.2% of residents indicated they feel very safe or safe in Town parks; 16.7% feel neither safe or unsafe and 4.1% feel unsafe or very unsafe. Public safety services that had the highest ratings of satisfaction were the overall quality of the local fire protection by Rural Metro (91.7%), overall quality of EMS services (87.9%), and the overall quality of police protection provided by the Sheriff's Office (78.8%). 66.9% of residents indicated they were either very satisfied or satisfied with the Town's efforts to prevent crime; 25.9% were neither satisfied or dissatisfied and 7.2% were either dissatisfied or very dissatisfied. When residents were asked to rate the public safety services that they think should receive the most emphasis from Town leaders, the top response, based on the sum of resident's top two choices, was the Town's efforts to prevent crime (50.5%). Followed by the overall quality of police protection (39.8%). Overall residents seem to be satisfied with parks and recreation services provided by the Town. At least 80.0% of residents are either very satisfied or satisfied with: The location of the parks (93.5%) Maintenance of the parks (89.0%) Hiking/walking/biking trails (89.0%) Number of parks (84.4%) Variety of parks (84.1%) The top three parks and recreation services that residents indicated they think should receive the most emphasis, based on the sum of their top three choices, from Town leaders over the next two years are listed below. Maintenance of the parks (62.0%) Hiking/walking/biking trails (44.9%) Quality of recreation programs offered (40.8%) 77.5% of residents were either very satisfied or satisfied with the quality of recreation programs offered; 20.3% were neither satisfied or dissatisfied and 2.2% were either dissatisfied or very dissatisfied. The top (6) responses were: Fountain Hills Times (75.9%) Word of mouth (61.7%) Town website (49.2%) Fountain Hills Insider (37.6%) Local television news (29.5%) Fountain Hills Facebook (29.0%) Shown in the chart below are the sum percentage of resident's top three choices for their most preferred way to learn about Town activities and services. The top four sources that resident's most prefer to use to learn about activities and services in the Town are listed below. Fountain Hills Times (68.2%) Town website (45.2%) Fountain Hills Insider (31.8%) Fountain Hills Facebook (25.6%) Findings Report: Town of Fountain Hills Community Survey (2021) ©2021 ETC Institute Page xi Town of Fountain Hills Community Survey Executive Summary Benchmark Analysis ETC Institute compared the 2021 results of Fountain Hills Community Survey with the average of communities with a population of 30,000 or less, in the mountain region, and nationally. More information can be found in Section 3 of the report. Overall, when compared to the other communities, Fountain Hills' results exceeded theirs in a multitude of services. Differences of +/-4.5% are considered significant. Compared to the national average, there were 23 positive differences and four (4) significant negative differences of the 41 services analyzed. The top four significant positive differences were; As a place to retire (+32.5%) Flow of traffic and ease of getting around the Town/City (+29.7%) Overall appearance of the Town/City (+24.6%) Hiking/walking/biking trails (+23.1%) The four significant negative differences were; Enforcement of Town/City codes and ordinances (-5.4%) As a place to work (-6.2%) Ability to participate in the Town/City's decision-making process (-7.5%) Leadership of the Town/City's elected officials (-8.9%) Differences between Fountain Hills' results and regional averages, there were significant positive differences in 22 services and significant negative differences in four (4) of the 41 services analyzed. Differences between Fountain Hills' results and average for communities with a population of 30,000 or less, there were significant positive differences in 19 services and significant negative differences in five (5) of the 41 services analyzed. Overall Priorities for the Town by Major Categories of Services: The first level of analysis reviewed the importance of and satisfaction with major Town services. This analysis was conducted to help set the overall priorities for the Town. The table below shows the Importance- Satisfaction Analysis for three (3) of the ten (10) major services analyzed. Based on the results of this analysis, the major service that is recommended as the top opportunity for improvement over the next two years, in order to raise the Town's overall satisfaction rating, is the maintenance of Fountain Hills' streets and infrastructure (IS Rating=0.3787) Public Safety: the Town's efforts to prevent crime (IS Rating=0.1672) Parks & Recreation: quality of recreation programs offered (IS Rating=0.0918) Maintenance: condition of major streets (IS Rating=0.2405) and condition of neighborhood streets (IS Rating=0.1775) Priorities for Specific Areas: The second level of analysis reviewed the importance of and satisfaction with specific areas of services. This analysis was conducted to help departmental managers set priorities for their department. limited resources which need to be targeted to services that are of the most benefit to their residents. Two of the most important criteria for decision making are; (1) to target resources toward services of the highest importance to residents and (2) to target resources toward those services where residents are the least satisfied. The Importance‐Satisfaction (I-S) rating is a unique tool that allows public officials to better understand both highly important decision- making criteria for each of the services they are providing. The Importance‐Satisfaction (I-S) rating is based on the concept that public agencies will maximize overall resident satisfaction by emphasizing improvements in those areas where the level of satisfaction is relatively low, and the perceived importance of the service is relatively high. The rating is calculated by summing the percentage of responses for items selected as the first, second, and third most important services for the Town to provide. The sum is then multiplied by 1 minus the percentage of respondents who indicated they were positively satisfied with the Town’s performance in the related area (the sum of the ratings of 4 and 5 on a 5‐point scale excluding “don’t know” responses). “don’t know” responses are excluded from the calculation to ensure the satisfaction ratings among service categories are comparable. I-S Rating = Importance x (1‐Satisfaction) Example of the Calculation Respondents were asked to identify Town services and initiatives provided by the Town that they thought should receive the most emphasis, from Town leaders, over the next two years. Seventy-four percent (74.4%) of respondents selected the maintenance of Town streets and infrastructure, as one of the most important services for the Town to provide. Regarding satisfaction, 49.1% of respondents rated the Town’s overall performance regarding the maintenance of Town streets and infrastructure, as a “4” or “5” on a 5‐point scale (where “5” means “very satisfied”) excluding “don’t know” responses. The I‐S rating for the maintenance of Town streets and infrastructure, is calculated by multiplying the sum of the most important percentages by one minus the sum of the satisfaction percentages. This calculation yielded an I‐S rating of 0.3787 which ranked first out of the ten services and initiatives, provided by the Town, that were analyzed. The maximum rating is 1.00 and would be achieved when 100% of the respondents select an item as one of their top three choices to emphasize over the next two years and 0% indicate they are positively satisfied with the delivery of the service. The lowest rating is 0.00 and could be achieved under either of the following two situations: Interpreting the Ratings Ratings that are greater than or equal to 0.20 identify areas that should receive significantly more emphasis over the next two years. Ratings from 0.10 to 0.20 identify service areas that should receive increased emphasis. Ratings less than 0.10 should continue to receive the current level of emphasis. Miller, Town Manager Request to Town Council Retreat (Agenda Language): Update on the Citizen Committee on Long-Term Streets Needs Staff Summary (Background) Last year at the Town Council retreat staff recommended that the Town Council consider a citizen committee to review and develop recommendations relating to the town's long-term street needs. During the summer of 2021 staff advertised and promoted the streets committee and thirteen residents submitted letters of interest to serve on the committee. All of the residents who applied were invited to serve on the committee. It is anticipated that the committee will be completing its review in April or the early part of May, which will culminate with a presentation to the Town Council with its findings and recommendations. This will include a strategy to address arterials, collector streets, and local streets, as well as proposed financing of the streets. The town is very fortunate to have such a high caliber of residents serving on the citizen committee on streets. The committee is comprised of residents who have backgrounds in streets, public works, engineering, business, human resources, marketing, local government, and other areas that have positively contributed to the process. The committee members are as follows: Buck Haworth, Kim Colenso, Karl Manthe, Gregg Dudash, Christopher Plumb, Jerry Butler, Dean Hughson, George Mitchell, Bernie Hoenle, Gary Salavitch, Jeffrey Kerr, Joe Mueller, and Mark Graham. Another name being used for this type of home is “Community Residence.” The information below provides specific information as to how this land use is currently regulated and the legal requirements and boundaries for local regulation of this type of residence. 1. Group homes for the handicapped are defined in the Town’s Zoning Ordinance as: Group Home for the Handicapped and Adult Care: A dwelling shared by handicapped and/or elderly people as their primary residence and their resident staff, who live together as a single housekeeping unit, sharing responsibilities, meals, and recreation. The staff provides care for the residents. A Group Home for the Handicapped and Adult Care does not include nursing homes, alcohol or other drug treatment centers, community correction facilities, shelter care facilities, or homes for the developmentally disabled as regulated by the Arizona Revised Statutes Section 36- 582. 2. Per Section 10.02A, group homes are permitted as a use by right in single-family zoning districts subject to the following: 12. Group Homes for the Handicapped and Elderly Care; provided, that: a. No such home is located on a lot that is within one thousand – two hundred (1,200) feet, measured by a straight line in any direction of the exterior lot lines of another group home for the handicapped and elderly care. b. No such home contains more than ten (10) residents. c. Such home is licensed by the State of Arizona Department of Health. d. Such home is registered with, and administratively approved by the Community Development Director or designee, as to compliance with the standards of this Ordinance. 3. The registration process includes the following: a. Application to include: i. Property owner information and consent if not the applicant ii. Applicant name and contact information iii. Type of facility iv. Number of beds/residents v. Whether or not residents will be capable of self-preservation vi. Service type (Directed Care, Supervisory Care, Personal Care) vii. Review of the location to ensure separation requirements are met c. Inspection by the Building Official and Fire Marshal for compliance with life-safety code; follow up if corrections/modifications were required 2 d. Obtain a Town business license 4. Currently there are 13 registered group homes in Fountain Hills. Nine are assisted living facilities and four are sober living homes. There is one unlicensed facility which came to staff’s attention a few weeks ago and we have begun code enforcement action regarding this home. 5. In 2019, largely in response to the situation in Prescott, the state passed legislation to regulate and control sober living homes at the state level, thus pre-empting cities and towns from regulations beyond zoning requirements. The State licenses sober living homes through the Department of Health. The state has extensive requirements for the managers and operations of such homes. Details are available through the AZDHS website. Anyone with complaints regarding an established home can file a complaint through the State’s website. 6. Sober living homes, by definition, are for people who have withdrawn from drugs or alcohol and are not currently using drugs or alcohol. They are considered to meet the definition of handicapped under the Federal rules. People who are still using are not considered handicapped and are not protected. 7. Detoxification, the process of having or allowing drugs or alcohol to be removed from the body, is a medical procedure. It is separate from and not part of a sober living home. A detoxification facility is a commercial use that would take place in a commercial zoning district, not in a residential district. 8. There are no current requests or applications for additional sober living homes or for a detox facility in Fountain Hills. 9. The timeline and process for the consideration of possible ordinance amendments addressing detox facilities and sober living homes was presented to the Planning and Zoning Commission in November, 2021. At that time, staff and the Commission recognized that this is an important public issue and they needed time to learn about this issues and present any concerns or suggestions they may have. The schedule clearly stated staff would not start working on any ordinance revisions until after the January meeting where the public would be given the opportunity to provide input. Staff did not want to pre-suppose what all the issues, concerns, suggestions, and options maybe until after listening to the public. The options and ideas provided by the Commission up to that point, along with what was received by the public would then be taken into account as ordinance revisions are considered and proposed. 10. Legal background and requirements associated with local regulation of these uses. WHAT IS A COMMUNITY RESIDENCE? One of the core elements of community residences is that they seek to emulate a family in how they function. The residents with disabilities learn or re–learn the same life skills and social behaviors taught in every family. Community residences seek to achieve “normal ization” of their residents and incorporate them into the social fabric of the surrounding community (known as “community integration). WHAT DO COMMUNITY RESIDENCES DO? Community residences seek to achieve “normalization” of their residents and incorporate them into the social fabric of the surrounding community (known as “community integration”). 3 WHAT DOES THE FAIR HOUSING ACT SAY ABOUT COMMUNITY RESIDENCES? The Fair Housing Act makes it unlawful “[t]o discriminate in the sale or rental, or to otherwise make unavailable or deny, a dwelling to any buyer or renter because of a handicap. 42 U.S.C. § 3604(f)(1). It is well established that persons recovering from drug and/or alcohol addiction are disabled under the FHA and therefore protected from housing discrimination. City of Edmonds v. Washington State Bldg. Code Council, 18 F.3d 802, 803, 804 (9th Cir. 1994); see 42 U.S.C. § 3602(h). It is equally well established that zoning practices that discriminate against disabled individuals can be discriminatory, and therefore violate § 3604, if they contribute to “mak[ing] unavailable or deny[ing]” housing to those persons. Since 1989, the nation’s Fair Housing Act has required all cities, counties, and states to make a “reasonable accommodation” in their zoning when the number of residents exceeds the local cap on the number of unrelated people who can live together in a dwelling so that community residences for people with disabilities can locate in all residential zoning districts. Amendments to the FHA to include protections against disability discrimination “also apply to state or local land use or health and safety laws, regulations, practices, or decisions which discriminate against individuals with handicaps”). Finally, group homes such as the ones at issue here are “dwellings” under 42 U.S.C. § 3602(b), and therefore the FHA prohibits discriminatory actions that adversely affect the availability of such group homes. See, e.g., Schwarz v. City of Treasure Island, 544 F.3d 1202, 1213–16 (11th Cir. 2008); Lakeside Resort Enters., LP v. Bd. of Superiors of Palmyra Twp., 455 F.3d 154, 160 (3d Cir. 2006); Larkin, 89 F.3d at 289. The Americans with Disabilities Act provides that “no qualified individual with a disability shall, by reason of such disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to discrimination by any such entity.” 42 U.S.C. § 12132. Like the FHA, this provision prohibits governmental entities from discriminating against disabled persons through zoning. See Bay Area Addiction Research & Treatment, Inc. v. City of Antioch, 179 F.3d 725, 730–32 (9th Cir. 1999). Also like the FHA, the ADA’s protections extend to persons recovering from drug or alcohol addiction. Hernandez v. Hughes Missile Systems Co., 362 F.3d 564, 568 (9th Cir. 2004). WHAT IS A DISABILITY? “Disability” means a mental or physical impairment that substantially limits at least one major life activity, a record of such an impairment or being regarded as having such an impairment. Disability does not include current illegal use of or addiction to any drug or illegal or federally controlled substance. Under the Fair Housing Act (FHA), disability is defined and construed by the Americans with disabilities act of 1990 (P.L. 101-336) and the ADA amendments act of 2008 (P.L. 110-325; 122 Stat. 3553). Persons recovering from drug and/or alcohol addiction are considered disabled under the FHA and therefore protected from housing discrimination. WHAT IS NOT A DISABILITY UNDER THE FAIR HOUSING ACT? Current users of illegal controlled substances, persons convicted of illegal manufacture or distribution of controlled substances, sex offenders and juvenile offenders are not considered disabled under the Fair Housing Act. Therefore, cities and towns do not have to make the same reasonable accommodation for them as for people with disabilities who do not pose “a direct 4 threat to the health or safety of others.” Consequently, licensing rules that prohibit such individuals from living in community residences are legal. ARE COMMUNITY RESIDENCES A BUSINESS? It is well settled that for zoning purposes, a community residence is a residential use, not a business use. The Fair Housing Amendments Act of 1988 specifically invalidates restrictive covenants that would exclude community residences from a residential district. The Fair Housing Act renders these re-strictive covenants unenforceable against community residences for people with disabilities. Residence, not treatment, is the home’s primary function. The underlying rationale for a community residence is that by placing people with disabilities in as “normal” a living environment as possible, they will be able to develop to their full capacities as individuals and citizens. The atmosphere and aim of a community residence is very much the opposite of an institution. As the courts have consistently concluded, community residences foster the same family values that even the most restrictive residential zoning districts promote. WHAT CAN A CITY OR TOWN DO TO REGULATED COMMUNITY RESIDENCES? The majority view of the courts, both before and after enactment of the Fair Housing Amendments Act of 1988, is that community residences constitute a functional family and that zoning should treat the occupants of a community residence as a “family.” However, the U.S. Supreme Court has ruled that a jurisdiction can establish a cap on the number of unrelated persons who can occupy a dwelling unit. The Fair Housing Act requires jurisdictions to make a reasonable accommodation for community residences for people with disabilities by making narrow exceptions to these caps. Belle Terre v. Borass, 416 U.S. 1 (1974). In Belle Terre, the U.S. Supreme Court upheld the resort community’s zoning definition of “family” that permitted no more than two unrelated persons to live together. The Court opined that the specter of “boarding housing, fraternity houses, and the like” would pose a threat to establishing a “quiet place where yards are wide, people few, and motor vehicles restricted. These are legitimate guidelines in a land–use project addressed to family needs”. Therefore, a city or town can cap the number of unrelated persons living in a residence. As such, up to that number, unrelated persons, whether in a disability group home or not, are allowed to live in a residential zone as a matter of right. No additional zoning restrictions can be imposed on the community residence for people with disabilities. Licensing cannot be required; a spacing distance between community residences or any other use cannot be imposed. A zoning code however can set a rational limit on the total number of people who live in a community residence based on emulating a family. Experts generally believe that a community residence with up to 10-12 residents can emulate a family. It is very unlikely that the home with more than 12 residents can effectively emulate a family. It’s clear that a “home” for 16 or 20 people is a mini–institution and not a community residence. 5 However, when a proposed community residence would house more than the number unrelated individuals that zoning code allows to live together as a single housekeeping unit or family, the zoning must make a “reasonable accommodation” to enable these homes to locate in the residential districts in which they need to locate to attain their purpose. WHAT IS A REASONABLE ACCOMODATION? Case law suggests that any reasonable accommodation must meet these three tests: ✓ The proposed zoning restriction must be intended to achieve a legitimate government purpose. ✓ The proposed zoning restriction must actually achieve that legitimate government purpose. ✓ The proposed zoning restriction must be the least drastic means necessary to achieve that legitimate government purpose. In Bangerter v. Orem City Corporation, the federal Court of Appeals said the same thing a bit differently, “Restrictions that are narrowly tailored to the particular individuals affected could be acceptable under the FHA if the benefits to the handicapped in their housing opportunities clearly outweigh whatever burden may result to them.” 46 F.3d 1491 (10th Cir. 1995) at 1504. ARE THE OTHER METHODS TO REGULATE COMMUNITY RESIDENCES? It is important to remember what no matter what cap a city’s zoning code establishes, the number of residents in any type of residence is ultimately limited by the building code that applies to all residential uses as dis- cussed below. The U.S. Supreme Court brought this point home in its 1995 decision in Edmonds v. Oxford House. The Court ruled that housing codes that “ordinarily apply uniformly to all residents of all dwelling units … to protect health and safety by preventing dwelling overcrowding” are legal. Zoning ordinance restrictions that focus on the “composition of households rather than on the total number of occupants living quarters can contain” are subject to the Fair Housing Act. 514 U.S. 725, 115 S.Ct. 1776, 131 L.Ed.2d 801 (1995). This LTD savings would be = ($18,000) •ASRS rules require certain part-time employees that meet hourly work thresholds to be ASRS members. We have determined that there would be a maximum of 10 current part-time employees that may be added as ASRS members. The maximum additional cost to add part-time employees, for next fiscal year would be $34,500. For next year the estimated combined (contribution %, LTD savings, adding part-time employees) incremental cost is projected to be approximately $66,000 (approximately 1.1% of total employee expenses) However, there is a good case to be made that joining ASRS will result in savings for the Town in the coming years (next slide shows this) 8 WWW.FOUNTAINHILLSAZ.GOV ASRS Savings for the Town A good case can be made that joining ASRS will decrease costs for the Town in the coming years •Historically, the contribution rate (12.17% for July 2022) has averaged approximately 7.07% over the past 35 years •For 25 of the last 35 years the contribution rate has been lower than the town currently contributes for the 401A (11%) •Contribution rates tend to "trend" or move in the same direction for multiple years at a time •13 years, from 1991-2003 rate decreased every year except one •14 years, from 2009 to 2022 rate increased each year •As mentioned, the rate for fiscal year 2023 decreased. This reversed a 14 year trend which could represent the start of a downward trend and a possible regression toward the 35 year average (7.07%). •Therefore, based on historical contribution rates, it is not unreasonable to project a savings for the town in the coming years. •For example, if the contribution rate decreases to 10%, the Town would see a yearly savings of approximately $33,000 per year. Miller, Town Manager Request to Town Council Retreat (Agenda Language): Proposed Community Branding Project to Provide the Town of Fountain Hills with a Marketing Theme and Strategy to Promote the Community Staff Summary (Background) Vice Mayor Alan Magazine has proposed for a few years that the town consider further developing a unique health and wellness brand to actively market and promote Fountain Hills. Vice Mayor Magazine has prior background in marketing and is very familiar with branding processes. The proposed Strategic Plan has touched upon this and the previous Economic Development Director had agreed that health and wellness were unique attributes that could be targeted for economic development purposes. The Vice Mayor has pointed out that a number of cities around the country have undertaken similar initiatives to provide brand identity for cities. The brand identities have enabled the cities to be known as an extension of the brand. The proposed health and wellness theme is truly unique and ties very well with the natural outdoors such as the McDowell Mountain Preserve and trails, medical facilities in Fountain Hills and the Shea medical corridor, hotels and resorts, spas, medical tourism, and other attributes that can be tied to health and wellness. In order to further develop this as a brand, staff is proposing to initiate a community branding project. The outcome from a community branding process would be a brand for Fountain Hills, marketing strategies, logos, marketing taglines, advertising messaging, and other tools. If the Town Council is interested in pursuing this project further, staff proposes a Request for Proposal process to secure a firm with expertise in community branding. The award of a contract will come back to the Town Council for its consideration before going forward. Miller, Town Manager Request to Town Council Retreat (Agenda Language): Discussion Regarding a Possible Short-Term Lease of Four Peaks Elementary School for Continuation of the Biz Hub Business Accelerator and Other Town Uses Staff Summary (Background) Through a partnership with the East Valley Institute of Technology (EVIT), Fountain Hills Unified School District, Arizona Business Advisors, and the Town of Fountain Hills, an EVIT school campus and the Biz Hub were launched in 2018 at the former Four Peaks Elementary School. EVIT had planned on using Four Peaks Elementary School as an opportunity to expand into the greater Scottsdale-Fountain Hills area. Unfortunately, EVIT was never able to meet its attendance targets for students at this location. As a result, EVIT pulled out of the campus in January of 2021, which then caused the school district to take over the leases and to have a more active role in managing the day-to-day activities at Four Peaks Elementary School. The vision behind Biz Hub was to utilize the vacant Four Peaks Elementary School as a business accelerator for new businesses looking to grow and expand. The concept behind a business accelerator is that after a period of time, the businesses housed in Biz Hub would grow to the point that they would need to relocate to new space elsewhere in Fountain Hills and beyond. Due to EVIT not thriving at this site and being involved in the management of the overall building, the Biz Hub has not realized its full potential. While staff is in the process of identifying costs associated with operating the Four Peaks Elementary School as the Biz Hub and potentially for special interest classes and recreation space, all of the information has not been finalized for Council consideration at this time. The Fountain Hills Unified School District has indicated that the cost for the town to lease the space would be extremely low in exchange for the town paying for the utilities, maintenance of the building and grounds, and managing the leasing to the tenants in the facility. The Town of Fountain Hills would be interested in an initial lease period of three years in order to properly give the Biz Hub an opportunity to be utilized as originally envisioned. At the end of the end lease period, the town will evaluate the effectiveness of Biz Hub and the cost of operating and maintaining the facilities before coming back to the Town Council with a recommendation about continuing the program or terminating it. The point in bringing this up to the Town Council at this time is to determine if the Council has an interest in having Biz Hub continuing as proposed and for the town to have a larger role in operating and managing the building for this purpose and other potential town uses. Other town uses may consist of recreation and special interest classes offered by the Community Services Department. Biz Hub is identified as a strategic priority in the 2022 Strategic Plan. The Town researched regional and national standards and potential service level improvements in developing the plan and solicited community feedback through surveys, online forums, and community presentations. Ideally, communities strive to have a park within a 10-minute walk from every residential home. Consistently, nearly 80 percent of Fountain Hills’ residents indicated they desire to have parks within easy access. As a result, several future parks locations have been identified as part of the Community Service Master Plan. The first of these new parks is Sunridge Park, located on a 5-acre Town-owned parcel at the corner of Sunridge Dr and Desert Canyon Dr. The Town originally identified the site as a future fire station with a park as part of the 2010 General Plan. Though the future fire station at this location was later relocated to Fountain Hills Blvd., the park designation remains in the 2020 General Plan. The park is also featured in the Council-adopted Parks, Recreation, and Trails Master Plan and is an identified project in the Capital Improvement Program. Following Council direction in June, staff were invited to a Sunridge Homeowner's Association board meeting on July 29. Staff had anticipated a small group setting on Zoom and expected to address community questions and gather feedback regarding the park layout and amenities. At the meeting there were a number of residents present who expressed concerns about the park. Since the meeting had approximately 80 residents, staff thought it would be important to survey as many residents as possible to obtain additional feedback about the proposed neighborhood park. In January, the Community Services Department coordinated the emailing a survey to Sunridge residents through the community's HOA. A total of 208 responses were received with approximately 60 percent of the survey respondents against the park and 40 percent in favor. At the Council Retreat, staff will be presenting the survey results and seeking further Council direction on next steps. They encouraged residents to share the email and let neighbors know. •The survey resulted in 208 respondents, however many questions were skipped.
