RESOLUTION NO. 2008-25
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, APPROVING AN AMENDMENT TO THE
TOWN OF FOUNTAIN HILLS GENERAL PLAN 2002 RELATING TO
APPROXIMATELY 1,276 ACRES OF LAND LOCATED IN THE
NORTHEAST CORNER OF THE TOWN, FORMERLY KNOWN AS THE
STATE TRUST LAND.
WHEREAS, on June 20, 2002, the Mayor and Council of the Town of Fountain Hills
(the “Town Council”) approved the Town of Fountain Hills General Plan 2002 (the “General
Plan”) which General Plan was subsequently ratified by the qualified electors of Fountain Hills
on September 11, 2002; and
WHEREAS, Chapter 7 of the General Plan, Plan Implementation, establishes the
authority and procedures for amending the General Plan; and
WHEREAS, on January 2, 2008, an application (GPA2008-01) was received on behalf
of the property owner, Fountain Hills Investment Company, LLC, to amend General Plan (the
“General Plan Amendment”) to facilitate the future orderly, planned development of the 1,276
acre parcel of land located in the northeast corner of the Town and formerly known as the State
Trust Land, as more particularly described and depicted on Exhibit A, attached hereto and
incorporated herein by reference; and
WHEREAS, the proposed General Plan Amendment provides for an appropriate mix of
residential, open space, commercial, resort and recreational land uses as depicted on Exhibit B
attached hereto and incorporated herein by reference (the “Amended Land Use Map”); and
WHEREAS, the proposed General Plan Amendment satisfactorily addresses the issues
of traffic circulation, development on slopes, major drainage corridors, expansive soils, adequacy
of public utilities, housing density, transition to existing development and the preservation of
open space; and
WHEREAS, two Open House meetings were held in the community to inform the public
of the General Plan Amendment on February 26 and February 27, 2008; and
WHEREAS, notice of the public hearings on the proposed General Plan Amendment
before the Planning and Zoning Commission was provided in the Fountain Hills Times on
April 16, 2008; and
WHEREAS, public hearings regarding General Plan Amendment were held by the
Commission on May 5 and May 6, 2008 and by the Town Council on May 15, 2008.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. That the General Plan Amendment contained in file GPA 2008-01,
including narrative text that clarifies and supports modifications in land use and changes to the
Land Use Map included as Exhibit 4 to the Fountain Hills General Plan 2002, altering
approximately 1,276 acres of the area shown on the Amended Land Use Map is hereby
approved, subject to the following conditions:
1. Compliance with the provisions and commitments expressed in the staff report/council
agenda action form and the text and exhibits of the major general plan amendment report
entitled “Fountain Hills ASLD” prepared by CMX Engineering and dated April 9, 2008.
2. Prior to approval of the master plat for the property, Developer shall:
a. Provide a daily Total Traffic analysis/map of the site showing additional
roadways and intersection volumes suitable for design; the analysis shall include
offsite traffic from offsite roads travelling into the site in the daily trip
assignments to obtain the Total Traffic. Develop the above traffic projections for
an interim project phasing and for the design year.
b. Provide a Peak Hour turning movements analysis/map (including traffic counts
and safety analysis at affected offsite collector/arterial intersections) indicating
turn pockets/lengths, design speeds, horizontal and vertical curvature
requirements and level of service calculations.
c. Evaluate all-way stop and traffic signal warrants at affected intersections. Provide
traffic control devices as warranted and directed by the Town.
3. In conjunction with the infrastructure improvements on the property, Developer shall:
a. Widen the pavement and right-of-way width for Richwood Avenue, with a
median (similar to that of a Major Collector), from a point adjacent to the eastern
entrance to Parcel 17 to Fountain Hills Boulevard. This requirement for widening
does not apply to Richwood Avenue at the west end of the site. Provide median
turn pockets at the proposed park, middle school ball fields, the east entrance to
Parcel 17 and other parcel entrances, and a widened round-a-bout approach at
Fountain Hills Boulevard.
b. Widen Ivory Drive to a Minor Collector, if needed, based on the traffic design for
the adjacent commercial parcel.
c. Provide Limited Collector or Local Road widths at Parcel 13, Parcel 8 and other
entrance roadways east/west from their intersection with FHB if justified based on
the subdivision lot layout and/or more detailed traffic analysis provided at the
time of preliminary plat review.
