Home My WebLink AboutRes 2013-43CERTIFICATE OF OFFICIAL ELECTION RETURNS OF THE NOVEMBER 5, 2013, GENERAL ELECTION HELD IN THE TOWN OF FOUNTAIN HILLS, ARIZONA, WHEREAS, for the General Election held in and for the Town of Fountain Hills, Arizona (the "Town "), on November 5, 2013 ( "Election "), the Town Clerk, as the officer in charge of elections, authorized execution of an agreement with Maricopa County, Arizona ( "the County ") whereby the County's electronic voting system was used to tabulate the votes cast by qualified electors at the Election; and WHEREAS, pursuant to this agreement and by authority of the Town Clerk, the electronic voting system, computer election tabulation programs, specifications, and voting equipment were tested prior to the Election and found to be in compliance with A.R.S. §§ 16 -441 through 16 -452; and WHEREAS, pursuant to the agreement and by authority of the Town Clerk, election and tabulation boards performed the duties required by Title 16 of the Arizona Revised Statutes, and prepared and delivered an abstract of the vote in accordance with A.R.S. §§ 16 -618 through 16 -621 to the undersigned officer in charge of the Election; and WHEREAS, the undersigned Town Clerk, the officer in charge of this Election, has caused the attached official returns to be prepared to reflect the mail ballot returns and the vote for the question appearing on the ballot. NOW, THEREFORE, pursuant to A.R.S. § 16 -622, the undersigned certifies that the official returns for this Election are attached hereto and made a part hereof, and that they contain a true and correct count of all of the valid ballots cast by mail ballot. WHEREAS, the Town of Fountain Hills (the "Town ") held a special election by mail ballot on November 5, 2013, for the purpose of submitting the question to the voters regarding authorizing the Mayor and Council to issue and sell bonds in the principal amount of $8,200,000 for Saguaro Boulevard road improvements (the "Special Election "); and WHEREAS, the Special Election returns have been presented to and have been canvassed by the Mayor and Council of the Town of Fountain Hills. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS as follows: 'SECTION 1. The recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The total number votes cast for and against the question, the total number of ballots cast, the total number of ballots rejected, the total number of registered voters, the percentage rate of return, the total number of over votes, and the total number of under votes, were as follows: SECTION 3. It is hereby found, determined and declared of record, that the question received sufficient affirmative votes to authorize its passage. SECTION 4. This Resolution shall be in full force and effect immediately upon its adoption. SECTION 5. The Mayor, the Town Manager, the Town Clerk and the Town Attorney are hereby authorized and directed to take all steps necessary to carry out the purpose and intent of this Resolution.
