OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ADOPT-
ING A FORM OF BALLOT TO BE SUBMITTED TO THE
QUALIFIED ELECTORS OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, AT THE SPECIAL STREET AND
HIGHWAY USER REVENUE BOND ELECTION TO BE HELD
IN AND FOR THE TOWN OF FOUNTAIN HILLS, ARIZONA,
ON MARCH 12, 1991, AND ORDERING THAT NOTICE OF
THE ELECTION BE GIVEN TO THE QUALIFIED ELECTORS
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA

adopted as introduced and Councilmember Claris
motion.

RESOLUTION NO. 1991 -04
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ADOPT-
ING A FORM OF BALLOT TO BE SUBMITTED TO THE
QUALIFIED ELECTORS OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, AT THE SPECIAL STREET AND
HIGHWAY USER REVENUE BOND ELECTION TO BE HELD
IN AND FOR THE TOWN OF FOUNTAIN HILLS, ARIZONA,
ON MARCH 12, 1991, AND ORDERING THAT NOTICE OF
THE ELECTION BE GIVEN TO THE QUALIFIED ELECTORS
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA
WHEREAS, the Mayor and Common Council of the Town of
Fountain Hills, Arizona (hereinafter referred to as the "Town "),
have adopted Resolution No. 1991 -03 ordering and calling a special
street and highway user revenue bond election to be held in and for
the Town on March 12, 1991; and
WHEREAS, it is necessary to adopt a form of ballot to be
submitted to the qualified electors of the Town at such election
and to direct that notice be given of the election,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, THAT:
Section 1. The ballot to be used in the special street
and highway user revenue bond election to be held on March 12,
1991, shall be in substantially the following form:
OFFICIAL BALLOT
PURPOSE: STREET AND HIGHWAY IMPROVEMENTS
AMOUNT: $1,200,000
Shall the Mayor and Common Council of the Town of Fountain Hills,
Arizona, be authorized to incur indebtedness by the issuance and
sale of street and highway user revenue bonds in the maximum
aggregate principal amount of $1,200,000 to provide funds for the
purpose of improvement, construction, reconstruction and mainten-
ance of, and acquisition of rights -of -way for, Town streets and
highways and to pay all legal, financial, engineering and other
necessary costs and expenses in connection therewith and with the
issuance and sale of such bonds, such bonds to bear interest at a
rate or rates of not to exceed twelve percent (12 %) per annum,
provided that each bond may be evidenced by one instrument or a
succession.-of instruments and the interest may be payable or com-
pounded semiannually or more or less frequently than semiannually
and at a variable rate or rates, none of which shall exceed twelve
percent (12 %) per annum; to mature over a period of not to exceed
twenty (20) years from the date of their issuance; to be in the
denomination of $1,000 each or multiples thereof at maturity and
to be payable solely from revenues to be derived from taxes, fees,
charges and other moneys collected by the State of Arizona and
returned to the Town of Fountain Hills, Arizona, for street and
highway purposes pursuant to law?

NOTICE TO VOTERS:
The voter shall indicate his vote by inserting the mark "X" in the
square opposite the phrase which expresses his choice. Only quali-
fied electors of the Town of Fountain Hills, Arizona, are eligible
to vote at this election.
Section 2. The notice of special street and highway user
revenue bond election shall be given by the Clerk of the Town by
causing a copy of Resolution No. 1991 -03 to be published in full
for one insertion in The Times of Fountain Hills, a newspaper
published in Maricopa County, Arizona, and of general circulation
in the Town, such publication to be made within a period of not
less than fifteen (15) , nor more than thirty (30), days prior to
the date of the election.
Section 3. The Clerk of the Town shall cause to be
printed and delivered to the election boards, to be by them fur-
nished to the qualified electors offering to vote at the special
street and highway user revenue bond election, ballots as set forth
above.

Section 4. The special street and highway user revenue
bond election shall be conducted and the poll lists kept, and the
votes cast thereat shall be counted and tabulated and the returns
thereof shall be made, in the manner provided by law and only
persons shall vote at the special street and highway user revenue
bond election who are qualified electors of the Town.
Section 5. In order to comply with the Voting Rights Act
of 1965, as amended, the following proceedings pertaining to this
election shall be translated into Spanish and posted, published and
recorded in each instance where posting, publication and recording
of such proceedings are required, to -wit: Resolution No. 1991 -03
ordering and calling special street and highway user revenue bond
election, official ballot, all absentee voting materials and all
instructions at the polls.
Section 6. The Mayor and Common Council of the Town
shall meet within seven ( 7 ) days from the twelfth (12 ) day after
the date of the street and highway user revenue bond election to
canvass the returns of such election. The Mayor and Common Council
shall be governed by the vote of the majority of the qualified
electors of the Town voting at the special street and highway user
revenue bond election on the question submitted.
