RESOLUTION 1993 -34
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA EXPRESSING
INTENTION TO ACCEPT FROM MCO PROPERTIES INC. ALL RIGHT,
TITLE, AND INTEREST THEY POSSESS TO CERTAIN REAL AND
PERSONAL PROPERTY LOCATED IN FOUNTAIN HILLS, ARIZONA.
WHEREAS, The Town Council of the Town of Fountain Hills as the governing body of
real property located in the Town of Fountain Hills may require the
dedication of public streets, sewer, water, drainage, and other utility
easements or rights -of -way within any proposed subdivision; and
WHEREAS, The Town Council of the Town of Fountain Hills has the authority to accept
or reject offers of dedication of private property by easement, deed,
subdivision, plat or other lawful means; and
WHEREAS, It is the express intention of MCO Properties Inc. to convey said interest to
the Town of Fountain Hills;
NOW THEREFORE, be it resolved by the Mayor and Common Council of the Town of
Fountain Hills, Arizona as follows:
SECTION 1. That It is the intention of the Mayor and the Common Council of the Town
of Fountain Hills, Arizona to accept by deed any and all Interest possessed
by MCO Properties Inc. in the real property as depicted in "Exhibit A° and
more fully described as follows:
All that certain parcel of land in the County of Maricopa, State of Arizona, being a
portion of Section 9, Township 3 North, Range 6 East of the Gila and Salt River Base and
Meridian, more particularly described as follows:

Commencing at the centerline intersection of Golden Eagle Boulevard and
Boulder Avenue as shown on Fountain Hills Arizona Final Plat No. 505 -A as
recorded in Book 158, Page 40, official records of said County, said point
of intersection being on a tangent curve concave northeasterly and having
a radius of 800.00 feet, a radial line passing through said point bears South
480 35' 00" West;
Thence northwesterly along the arc of said curve and along the monument
line of Golden Eagle Boulevard through a central angle of 100 45' 00" an
arc length of 150.10 feet;
Thence North 590 20' 00" East a distance of 42.00 feet to the POINT OF
BEGINNING;
Thence North 300 40' 00" West a distance of 249.90 feet;
Thence North 590 20' 00" East a distance of 9.00 feet;
Thence South 300 40' 00" East a distance of 249.90 feet to the beginning of
a tangent curve concave northeasterly and having a radius of 749.00 feet;
Thence along the arc of said curve through a central angle of 070 45' 48"
an arc length of 101.49 feet to a point of cusp, said point being the
beginning of a non - tangent curve concave northerly and having a radius
of 20.00 feet, a radial line passing through said point bears South 040 25' 20"
East;
Thence northwesterly along the arc of said curve through a central angle
of 570 16' 46" an arc length of 19.99 feet to a point of compound curve,
said curve being concave northeasterly and having a radius of 758.00 feet,
a radial line passing through said point bears South 520 51' 26" West;
Thence along the arc of said curve through a central angle of 060 28' 34"
an arc length of 85.68 feet to the POINT OF BEGINNING.
SECTION 2. That upon presentation of proper documentation reviewed by the Town
Attorney and certified by the Town Engineer, the Mayor and Town Clerk are
hereby authorized and directed to accept the deed for the real property
and personal property and are instructed to record same in the Office of
the Maricopa County Recorder for notice to the world as the intent of the
Town of Fountain Hills to accept this property as public right -of -way.
