PO Bex 1 7958 Founfcin Hills,AZ 35269 RESOLUTION 1996-22 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA PURSUANT TO ARS §28-1901 EI.SEQ.ABANDONING ALL RIGHT,TITLE OR INTEREST IN PORTIONS OF CERTAIN PUBLIC RIGHTS-OF-WAY KNOWN AS (ORIGINAL)GOLDEN EAGLE BOULEVARD AND BAINBRIDGE AVENUE LOCATED WITHIN FOUNTAIN HILLS FINAL PLAT NUMBER 50SA AS RECORDED IN BOOK 153,PAGE 40 OF THE RECORDS OF THE MARICOPA COUNTY RECORDER WHICH HAVE BEEN FOUND TO BE NO LONGER NECESSARY. WHEREAS,A.R.S.§28-1901 et.sea,provides for the disposition of unnecessary public roads;and r KVJW"^ WHEREAS,The Town Council of the Town of Fountain Hills is the governing body of the Town;and NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,Arizona as follows: SECTION 1 SECTION 2. SECTION 3. That portions of the (original)Golden Eagle Boulevard,located within Plat 505A.Book 158,Page 40,Maricopa County Recorder Records as depicted in "Exhibit A"attached hereto and incorporated herein is hereby declared tobe no longer necessary for public use asa right-of-way. That the Council determines this property can best be used to protect the public health,safety and welfare oftheadjacent property owners and the citizens of the Town and therefore declares that the value of the property is de minimis andthat no compensation is required from the adjacent property owners pursuantto A.R.S.§28-1902.A.3 and§28-1902.A.5. That upon recordation of this resolution in the office of the Maricopa County Recorder,title to (original)Golden Eagle Boulevard depicted in "Exhibit A"shall vest in the owners of record of the adjacent property as determined by the records ofthe Maricopa County Recorder on the day of recordation,subject tothe easements retained.The property shown as LN 744 shall vest entirely in the owners of record ofthe adjacent unsubdivided property to the south. WHEREAS,the Council adopted Resolution 1996-22 on April 4,1996;and WHEREAS,said Resolution has never been recorded in the office of the Maricopa County Recorder;and WHEREAS,thestipulationshaveneverbeenfulfilled; NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of FountainHills,Arizonaasfollows:> SECTION 1.That Resolution 1996-22 is hereby rescinded.
