WHEREAS,TheTownCounciloftheTownofFountainHills,asthegoverningbodyofreal property located inthe Town of Fountain Hills,may require the dedication of publicstreets,sewer,water,drainage,andotherutility easements orrights-of-way withinany proposed subdivision;and WHEREAS,TheTownCounciloftheTownofFountainHillshastheauthoritytoacceptor rejectoffersof dedication ofprivate property by easement,deed,subdivision,plat or other lawful means;and WHEREAS,Allpresentutilitycompanieshavereceivednotificationoftheproposed abandonment; NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of Fountain Hills,Arizona as follows: SECTION 1.Thatthecertainten(10)footpublicutilityand drainage easements,locatedalong the westerly property line of Lot 22,Plat 213,Block 1,Fountain Hills,Arizona; as recorded inbook 155 of maps,page 24 records of Maricopa County,Arizona; are hereby declared tobe abandoned bythe Town of Fountain Hills. SECTION 2.Thatthis Resolution isoneof abandonment and disclaimer bytheTownsolelyfor the purpose of removing any potential cloud onthe title to said property andthat theTowninnoway attempts toaffecttherightsofanyprivatepartytooppose the abandonment or assert anyright resulting therefrom or existing previous toany action bythe Town.
