RESOLUTION 1996-65
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWNOFFOUNTAIN HILLS,ARIZONA PURSUANT TO A.R.S.§28-1901
H.SEQ.ABANDONING TO THE ADJACENT PROPERTY OWNERS ALL
RIGHT,TITLE OR INTERESTIN CERTAIN PUBLIC RIGHTS-OF-WAY
LOCATEDWITHINFOUNTAIN HILLS SECTIONS 28 AND 29,AS
RECORDED IN BOOK 401,PAGE 18OFTHE RECORDS OF THE
MARICOPA COUNTY RECORDER WHICH HAVE BEEN FOUND TO BE NO
LONGER NECESSARY FOR PUBLIC USE.
WHEREAS,A.R.S.§28-1901 et.seq.provides for the disposition of unnecessary public roads;
and
WHEREAS,TheTown Council of the Town of Fountain Hills is the governing body of the Town;
and
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,
Arizona,as follows:
SECTION1.That the 1982'portion of the Eagle Mountain Parkway right-of-way and the 881'
Westwind Drive right-of-way,Fountain Hills,Arizona;as recorded in book 401,Page
18,Maricopa County Recorder Records as depicted in"ExhibitA"attached hereto
and incorporated herein is hereby declared to be no longer necessary for public
use as right-of-way.
SECTION 2.That the Council determines this property can best be used to protect the public
health,safety and welfare of the adjacent property owners and the citizens of the
Town and therefore declares that the value of the property is de minimis and that
no compensation is required from the adjacent property owners pursuant to A.R.S.
§28-1902.A.3 and §28-1902.A.5.
SECTION3.That upon recordation of this resolution in the office of the Maricopa County
Recorder,title to the rood-wqy described in"ExhibitA"and depicted in"Exhibit B"
shall vest in the owners of record of the adjacent property as determined by the
records of the Maricopa County Recorder on the day of recordation.
SECTION 4.That a certain existing temporary turn-around,PUE,existing slope easement and
drainage easement as recorded in Book 401,Page 18 of the records of the
Maricopa County Recorder and shown on the Map of Abandonment shall be
retained as shown in "Exhibit A".

A parcel of land lying within Sections 28 and 29,Township 3 North,Range 6 East,
of the Gila and Salt River Meridian,Maricopa County,Arizona,more particularly
described as follows:
Commencing at the east quarter corner of said Section 29;
THENCE southerly along the east line of said Section 29,South 00°07'36"East,a
distance of 457.77 feet,to a point on the northerly right-of-way lineofEagle
Mountain Parkway as shown on the Final Plat of Eagle Mountain,recorded in Book
401 of Maps,at Page 18,M.C.R.,and the POINT OF BEGINNING;
THENCE easterly along said northerly right-of-way line the following courses;
THENCE South 00°07'36"East,a distance of 34.56 feet,to the beginning ofa
non-tangent curve;
THENCE easterly along said curve,having a radius of 758.00 feet,concave southerly,
whose radius bears South 12°15/58"West,through a central angle of 14°21'00",
a distance of 189.84 feet,to the curve's end;
THENCE South 63°23'02"East,a distance of 141.60 feet,to a point on the easterly
right-of-way lineof Westwind Drive as shown on said Plat,and the beginning ofa
non-tangent curve;
THENCE southerly along said easterly right-of-way line the following courses;
THENCE southerly along said curve,having a radius of 442.00 feet,concave easterly,
whose radius bears South 68°50'11"East,through a central angle of 43°31 '21",a
distance of 335.75 feet,to the curve's end;
