A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AMENDING THE TOWN OF FOUNTAIN
HILLS GENERAL PLAN 2010 REGARDING THE LAND-USE
DESIGNATION FOR APPROXIMATELY 80 ACRES GENERALLY
LOCATED ALONG EAGLE RIDGE DRIVE AS SHOWN IN CASE NO.
GPA2013-01.
WHEREAS,the Town of Fountain Hills General Plan 2010 (the "General Plan")was
adoptedbytheMayorandCouncil of theTown of FountainHills(the"TownCouncil")on
January7,2010,andratifiedbythe qualified electors of theTown of FountainHills(the
"Town")onMay 18,2010;and
WHEREAS,Figure 11 of theGeneralPlan(the "Land UsePlan")setsforththeland-use
designations forallreal property withinthe corporate limits of theTown;and
WHEREAS,theGeneralPlan establishes the authority and procedures for amendments
totheGeneralPlan land-use designations;and
WHEREAS,theTown Councildesires to amend the General Planto change theland-use
designationontheLandUsePlanforapproximately80acresgenerallylocatedalongEagle
RidgeDriveasshowninCaseNo.GPA2013 fromSingleFamily/VeryLowtoacombination of
SingleFamily/MediumDensityResidential,Multi-Family/Medium DensityResidentialand
Multi-Family/HighDensityResidential(the"GeneralPlanAmendment");and
WHEREAS,pursuantto Ariz.Rev.Stat.§9-461.06andtheGeneralPlan,theTown
hasconsultedwith,advisedandprovidedtheopportunityforpubliccommentontheGeneral
Plan Amendment;and
WHEREAS,pursuantto Ariz.Rev.Stat.§9-461.06andtheGeneralPlan,theTown
PlanningandZoningCommission(i)heldapublichearingontheproposedGeneralPlan
AmendmentonFebruary13,2014,and(ii)providednotice of suchhearingbypublicationinthe
Fountain Hills Times onJanuary22,2014,andJanuary29,2014;and
WHEREAS,pursuanttoAriz.Rev.Stat.§9-461.06 andthe General Plan,theTown
Council (i)heldapublichearingonthe proposed General Plan Amendment onMay1,2014 and
(ii)provided noticeofsuchhearingby publication inthe Fountain Hills Times onApril16,
2014;and
WHEREAS,theTown Council findsand determines that (i)proper notice of the
proposed General Plan Amendment hasbeengiveninamanner required by ARIZ.Rev.Stat.§
9-461.06 etseq.and(ii)each of therequiredpublicationshavebeenmade.

NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1.The recitals aboveare hereby incorporated as if fullysetforthherein.
SECTION 2.The General Planishereby amended to change the land-use designation on
theLandUsePlanfor approximately 80 acres generally located along EagleRidgeDriveas
showninCaseNo.GPA2013,asmore particularly described and depicted on Exhibit A,attached
heretoand incorporated hereinby reference,from Single Family/Very Lowtoa combination of
Single Family/Medium Density Residential,Multi-Family/Medium Density Residential and
Multi-Family/High DensityResidential.
SECTION 3.Ifanyprovision of thisResolutionisforanyreasonheldbyanycourt of
competent jurisdiction tobe unenforceable,suchprovisionorportion hereof shallbedeemed
separate,distinctand independent of all other provisionandsuchholdingshallnotaffectthe
validity of the remaining portions of this Resolution.
SECTION 4.The Mayor,the Town Manager,the Town Clerk andthe Town Attorney
arehereby authorized and directed totakeall steps necessary tocarry out the purpose andintent
of this Resolution.
