NOTICE OF THE
REGULAR SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
TIME: 6:30 P.M.
WHEN: THURSDAY, OCTOBER 16, 2014
WHERE: FOUNTAIN HILLS COUNCIL CHAMBERS
16705 E. AVENUE OF THE FOUNTAINS, FOUNTAIN HILLS, AZ
Councilmembers of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum of the Town’s
various Commission, Committee or Board members may be in attendance at the Council meeting.
Notice is hereby given that pursuant to A.R.S. § 1-602.A.9, subject to certain specified statutory exceptions, parents have a right to
consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the Town
Council are audio and/or video recorded and, as a result, proceedings in which children are present may be subject to such recording.
Parents, in order to exercise their rights may either file written consent with the Town Clerk to such recording, or take personal
action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a
recording is made, the Town will assume that the rights afforded parents pursuant to A.R.S. § 1-602.A.9 have been waived.
PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the Town Clerk
prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber
Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk or the
Mayor. At that time, speakers should stand and approach the podium. Speakers are asked to state their
name and whether or not they reside in Fountain Hills (do not provide a home address) prior to
commenting and to direct their comments to the Presiding Officer and not to individual Councilmembers.
Speakers’ statements should not be repetitive. If a speaker chooses not to speak when called, the speaker
will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not (i)
reserve a portion of their time for a later time or (ii) transfer any portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during the Public
Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time limits may be
waived by (i) discretion of the Town Manager upon request by the speaker not less than 24 hours prior to
a Meeting, (ii) consensus of the Council at Meeting or (iii) the Mayor either prior to or during a Meeting.
Please be respectful when making your comments. If you do not comply with these rules, you will be
asked to leave.

SCHEDULED PUBLIC APPEARANCES/PRESENTATIONS
i) The Mayor may review recent events attended relating to economic development.
CALL TO THE PUBLIC
Pursuant to A.R.S. §38-431-01(H), public comment is permitted (not required) on matters not listed on the
agenda. Any such comment (i) must be within the jurisdiction of the Council and (ii) is subject to
reasonable time, place, and manner restrictions. The Council will not discuss or take legal action on
matters raised during “Call to the Public” unless the matters are properly noticed for discussion and legal
action. At the conclusion of the call to the public, individual Councilmembers may (i) respond to criticism,
(ii) ask staff to review a matter or (iii) ask that the matter be placed on a future Council agenda.
CONSENT AGENDA ITEMS
All items listed on the Consent Agenda are considered to be routine, non-controversial matters and will be
enacted by one motion and one roll call vote of the Council. All motions and subsequent approvals of
consent items will include all recommended staff stipulations unless otherwise stated. There will be no
separate discussion of these items unless a Councilmember or member of the public so requests. If a
Councilmember or member of the public wishes to discuss an item on the c onsent agenda, he/she may
request so prior to the motion to accept the Consent Agenda or with notification to the Town Manager or
Mayor prior to the date of the meeting for which the item was scheduled. The items will be removed from
the Consent Agenda and considered in its normal sequence on the Agenda.

SPONSORSHIP, FEES, AND PLACEMENT of the wall. This item was added at the
request of Councilmembers Brown, Elkie, and Leger.

WHEREAS,serious social problems concern our nation,state and town,and threaten our
future;and,
WHEREAS,connecting with others and working together through volunteer service can
bridgethe differences that separate people and help solve serious social problems; and,
WHEREAS,we,the American people and the residents of Fountain Hilis,have a tradition of
philanthropy and volunteerism;and,
WHEREAS,in 2013,three and one-half million people cared enough about their communities to
volunteer on MAKE A DIFFERENCE DAY,accomplishing thousands of projects in hundreds of
cities and towns;and,
WHEREAS,in our community,nonprofit organizations,schools,businesses,houses of worship,
families,neighborhoods and friends serve together to make a difference;and
WHEREAS,2014 makes the 6th year for Fountain Hills to demonstrate that it is the small town
with a big heart;and
WHEREAS,the Town of Fountain Hills supports a vibrant community to enrich the lives of our

Dear Town of Fountain Hills Officials:
We are asking the Town of Fountain Hills to approval the replat for Lots 12 and 13 in plat 423 Block 149
in order to move approximately 92 sq ft of land that is currently showing in Lot 13 over to Lot 12.The
approximately 92 sq ft of land is outlined in the plat map completed by a licensed surveyor and also
described in verbiage below. The request for a replat is being requested in order to account of the land
encompasedby a retainingwall that was built on Lot 12.A portion of the retainingwall was errouneously
built over the property line with Lot 13.The retaining wall was built sometime prior to possession of Lot
12 by the existing owners. The section of land impacted represents the wall, irrigation lines, and electrical
lines that were erroneously constructed on Lot 13 for the benefit of Lot 12.
The owners of Lot 13 (16127 E Ocotillo Dr), Dominick and Mary Bueti, have agreed to the replat. Their
signatures havebeen notarized onthe plat map(s).The application isbeing submitted bytheownersof

Dear Ladies &Gentlemen,
The Public Art Committee of the Fountain Hills Cultural &Civic Association would like to
propose the acquisition of a sculpture entitled "Spirit of the Saguaro"by artist Don Kenworthy.It is
made of satin buffed stainless steel with copper,brass and stained glass decorative elements (flowers,
birds,and butterflies).The height is approximately 7'4.5"+ the base.The sculpture will be slightly
elevated with landscaping around the base.
The piece is being donated by the Brown Trust Family and is being prepared especially for
them.It has an insured value of $15,000.
We are recommending the piece be placed in the "The Joe &Marge Brown Legacy Plaza. This
acquisition will be presented to the Board of Directors of the Fountain Hills Cultural & Civic
Association on 9/23/14 for approval.
The sculpture is in the process of being made so no photo is available at this time. Instead I've
attached a mock-up photo,location map of the plaza and a drawing of the saguaro.

sculpture will be located just east of the sidewalk
in the Joe and Marge Brown Legacy Plaza .
The sculpture will be slightly elevated and
surrounded by landscaping to add height and
prominence to the piece while protecting it from
potential damage.

The Fire Marshal (ordesignee)will do an inspection of all booths (including grease
containment), site preparation, site reviewand firelane inspection. This inspection will be
done on Friday,with follow-up inspections on Saturday and Sunday as required.
2 ALS Stations:Each Station is staffed by a State Certified Emergency Paramedic (CEP)
and a State Certified Emergency Medical Technician (EMT).One Station will be located on
the North side of the intersection of Verde River Dr.and Avenue of the Fountains.A second
Station will be located near Saguaro Blvd.and Avenue of the Fountains.
Fire Department Explorers may be available as volunteers to staff the ALS stations to
provide blood pressure checks and provide additional public assistance when the Paramedic/
EMT team is providing assistance away from the station.
A Fountain Hills Fire Captain/Supervisor will be on duty for coordination and supervision.

There is a request from Council Members Lege,Elkie and Brown to place the subject of
bringing the "Wall That Heals" Viet Nam Memorial to Fountain Hills the week of February
18n to the 22n 2015 the same weekend as the Chamber of Commerce's Arts &Crafts Fair.
The initial request from the Town of Fountain Hills was a co-sponsorship of $5,000 for the
four day event.Staff mentioned in the initial discussions there are no funds available for
this event but that a site could be considered suitable in Fountain Park,if possible.
Additional requirements for the event are as follows:

EXHIBIT COMPONENTS
The Wall That Heals exhibition has three main components. All of the components are lit at
night for 24-hour visitation.
The Wall Replica
The Wall That Heals exhibition features a half-scale replica of the Vietnam Veterans Memorial
in Washington, D.C. It is approximately 250 feet in length, and like the original Memorial is
erected in a chevron-shape. The replica is complete with the 58,249 names of those killed or
missing in action from the conflict. When new names are added to the Memorial in Washington,
D.C., The Wall That Heals is updated as soon as possible.
The replica is constructed of powder-coated aluminum, supported by an aluminum frame, and is
made up of 24 individual panels, each containing six columns of names. The panels join
together to form a nearly 250 feet wide structure.
The names on The Wall That Heals replicate the names on The Wall in Washington, D.C. As on
The Wall, the names are listed alphabetically by day of casualty. Beginning at the center/apex,
the names start on the East Wall (right-hand side) working their way out to the end of that wing,
picking up again at the far end of the West Wall (left-hand side) and working their way back in
to the center/apex. Thus, the beginning and ending of the conflict are joined at the center.
The Information Center
A 20’ x 20’ white canvas tent is attached to the trailer and serves as an Information Center where
visitors have access to the many resources of www.vvmf.org as well as a variety of other useful
materials, maps, and resources. Volunteers are needed, but VVMF site managers will be on site
during daylight hours. The information tent is WiFi enabled and can support additional tents and
resources provided by the site hosts. Visitors are encouraged to bring photos of friends and
loved ones on The Wall to be scanned for inclusion in The Education Center at The Wall.
The Traveling Museum
When emptied, the 53-foot trailer that carries The Wall That Heals becomes a mobile
representation of The Education Center at The Wall that will soon be built in Washington, DC.
The exterior of the trailer opens to reveal exhibits designed to preview the key elements of The
Education Center. There is a Wall of Faces, featuring some of the thousands of photos collected
so far. Next, we have samplings of the 120,000 artifacts and remembrances that have been left at
The Wall. Finally, there is a map and timeline of the Vietnam conflict and history of The
Vietnam Veterans Memorial. The Museum, as will the Education Center in DC, helps visitors,
especially students, put American experiences in Vietnam in a historical and cultural context and
allows Veterans a further opportunity to heal and take part in the education of future generations.
SITE PARAMETERS
Site
The Vietnam Veterans Memorial Fund seeks public space, with public access 24 hours a day, as
sites for exhibition of The Wall That Heals. The Memorial Fund’s goal is to install the
exhibition in sites that provide an atmosphere as similar as possible to The Wall in Washington,
D.C. The Memorial Fund reserves the right of site approval, which may be accomplished
through the use of photographs, a sketch, descriptive material or a personal visit.
Size
The proposed site must be able to accommodate the three main components of the exhibition:
The Wall replica, the Information Center and the Traveling Museum. A minimum of 250’ x 60’
of level ground is required for the replica. The site size specified does not have to be a clear
rectangle; it may contain landscaping or other objects, but must be flat and accommodate the two
wings of the Memorial. The wings are each approximately 124 feet long and are joined at a 121
degree angle forming a slightly “flattened” triangle.
Additional space is required to accommodate the Information Center and Traveling Museum.
The Information Center is a 20’ x 20’ tent that attaches directly to the passenger rear side of the
53’ trailer. The Information Center and Museum, which is housed in the trailer, need a level area
70’ x 40’ located within 120 feet of the 220v electrical connection.
Setting
The Memorial Fund seeks sites that provide an appropriate setting for visitors to The Wall That
Heals. This includes minimal noise levels, minimal visual distractions and a reasonably
controlled area in which visitors are present for the prime purpose of visiting The Wall. In short,
the Memorial Fund looks for a relatively quiet, calm atmosphere in which people are free to
contemplate.
The simplicity and elegance of The Wall itself is critical to its integrity; in the case of The Wall
That Heals, “less is more” is a good rule of thumb. The Memorial Fund requests that flags,
signs, tents, vehicles or other elements not impinge on The Wall That Heals area and that
activities other than ceremonies directly related to The Wall occur at an appropriate distance.
Ideally, The Wall replica should be displayed on grass, which accommodates the anchoring
stakes for the replica, with the trailer parked on a solid surface adjoining the grassy area. If The
Wall replica will be displayed on a hard surface, you must notify the Memorial Fund as
soon as possible since special arrangements need to be made. If the trailer must be located on
grass, the ground must be hard and solid to support the weight of the trailer. If the trailer gets
stuck, it is the host site’s responsibility to provide towing to get the unit out.
Schedule
The duration of The Wall That Heals exhibition, open to the public, is usually Thursday through
Sunday, allowing for visits by families, school groups and the general public, but visitors begin
to arrive on Wednesday during set up. Although the schedule may change depending upon travel
needs, the exhibition typically arrives on Tuesday afternoon, parking the trailer/museum at the
site so that electrical hook-ups can be made. Set-up occurs on Wednesday morning, volunteer
orientation Wednesday afternoon/evening and the exhibition is taken down on Monday morning.
Volunteers
Volunteers are needed to help with set-up and breakdown of the exhibition and for visitor
assistance and security. Approximately 15-20 able-bodied volunteers, each capable of lifting 40
pounds, climbing ladders and doing overhead lifting, are needed for set-up and breakdown.
The number of volunteers needed depends upon the number of visitors expected. A general rule
is: an average of five volunteers is needed to assist for every shift. In practical terms, two
volunteers may be sufficient for off-peak hours (late evening and early mornings), and eight may
be needed for after-work and weekend hours as well as during school visitations. A minimum of
four people should be scheduled for a given shift. A shift may run from two to four hours,
except the computer volunteers who work a four hour shift.
Security
Security is required 24 hours a day for The Wall That Heals exhibition from Tuesday afternoon
until Monday morning. Security personnel must have a means for direct communication with
law enforcement officials. Normal police patrols are generally sufficient for daytime security,
but additional police patrol/security patrols may be increased at night. Overnight security may
be handled by a minimum of two volunteers. Overnight security will also need to be available to
help visitors at The Wall throughout the night.
Mechanical Requirements
Access to electrical power is required for the following areas:
The Wall That Heals needs two 110v/15 amp circuits to power the footlights for
nighttime illumination of The Wall.
The Traveling Museum and Information Center need 220v/50 amps to power lights,
computers, a printer, a copier and fans within the display cases, plus air conditioning or
heaters used to maintain even temperatures inside the trailer.
The Memorial Fund provides the footlights for The Wall replica, as well as all needed electrical
wiring. The Memorial Fund provides 120 feet of 220v cable for electric hook-up. The cable has
bare wires for attaching the cable to the electric panel. The 220v power must be connected
before set-up on Wednesday morning therefore an electrician will be needed on Tuesday
afternoon or early Wednesday morning (before 8 am) to hook the power up to the trailer and
disconnect the power after The Wall has been loaded, on Monday morning. The electrician
should check out the power source before the event to see if any special equipment will be
needed.
If generators must be used, they must be able to generate at least 10 kilowatts of power in order
to operate the needs in the trailer, as well as light The Wall. The electrician should check out the
generator ahead of time to see if there will be any special equipment needed to hook up the
generator.
Landscaping
The Memorial Fund recommends sites provide a visual walkway following the angle of the
Memorial replica, though it is not required. This helps direct visitors along the length of The
Wall so that the visitors can experience the progression of the nation’s involvement and loss in
the war as illustrated by The Wall, and so that they are close enough to read individual names.
Without a designated walkway, people tend to cluster in groups in which they might only see
The Wall from a distance and miss the opportunity to explore and contemplate all the exhibition
offers. Also, a pathway helps to establish crowd control and flow, protecting the free standing
half-scale replica. The pathway should be 15-20 feet out from The Wall.
The pathway can be created by:
· Flags
· Rope and posts
· Potted plants
· Benches
· Wood Chips
· Rugs/mats
· Wooden structure
· Fencing
Some sites provide benches or chairs for visitors at an appropriate distance from The Wall.
Other landscaping is at the discretion of the host site. But, the “less is more” rule usually
applies.
Other Facility Needs
Each site is asked to provide six 30” x 60” tables or five 30” x 72” tables or four 30” x 96” tables
for the Information Center to be used to display maps, handouts, the Names Directories, etc.
Heat for the tent may be required in colder seasons.
Some sites also choose to provide coffee, refreshments, chairs/tables and heat for the volunteers
in a separate location. Food and beverages are not permitted around the computers.
Having golf carts available to transport elderly and disabled visitors from the parking lots to The
Wall site is highly recommended. Other devices, such as the Gator, are helpful when setting up
and breaking down The Wall.
Decorum
Sites agree to ensure reasonable decorum at the exhibition site. No food or beverages may be
consumed at The Wall replica. Smoking is prohibited. No alcoholic beverages of any kind are
permitted at the site. Pets are not permitted at the site, except for working animals assisting the
disabled.
In keeping with the atmosphere at The Wall in Washington, D.C., sites are asked not to provide
taped or live music or other sound effects during the exhibition, except as related to official
ceremonies.
Solicitation
Visitors access to the site must be provided free of charge. Sites agree to prohibit solicitations or
sales by any parties other than the Memorial Fund in connection with the exhibition or in
proximity to the display site. The Memorial Fund provides four donation boxes for contributions
to support its activities as well as educational materials available for donations. On site donations
are what keeps TWTH on the road. VVMF has not increased our site fee since its inception.
Memorabilia
Visitors are likely to leave mementos at The Wall That Heals, just as they do at The Wall. The
Memorial Fund recommends that such memorabilia be collected throughout the exhibition,
tagged with location, date and time, and carefully stored. Flowers and perishables are not kept,
but do keep any cards and ribbons attached to them. Site hosts are encouraged to arrange a
permanent home for the memorabilia in the local community, perhaps at a historical museum,
veterans service post, veterans hospital or local school, so that the legacy of the tour finds a
permanent home in each community. Sites also are encouraged to plan exhibitions of the
material at local schools and libraries after the visit.
Educational Activities
A vital component of The Wall That Heals tour is the opportunity for young people to learn more
about the war, The Wall and the Vietnam era. School visits are strongly encouraged. If you
expect groups of 50 or more students at one time, please contact our site managers for ideas
to make the visits run efficiently for all involved.
In addition, the Memorial Fund has produced a curriculum called Echoes From The Wall that has
been sent free of charge to over 40,000 public and private middle and high schools in the
country. A visit to The Wall That Heals is a perfect compliment to Echoes or any study of the

Other educational activities are also welcome.
Emergency Medical/Counseling Services
Sites may wish to provide visitors with the assistance of medical personnel (in case of accidents
or emergencies) and crisis counselors. Although the exhibition has not experienced negative
consequences to date, a visit to The Wall That Heals is sometimes an emotional experience that
may be aided by the presence of caring and knowledgeable mental health counselors. Sites
providing such services have found them useful and appreciated.
Promotion
It is essential to work with the local media to promote and publicize The Wall That Heals
exhibition prior to and during the exhibition period. Included in this kit is the artwork for a
brochure and an advertisement or poster and a public information plan.
Other Activities
Sites are strongly encouraged to work with local veterans groups, schools and other
organizations to organize activities such as local name readings, memorial services to honor
those from the region (or alumni or relatives) who are recognized on The Wall or other events.
In addition, school education programs, history and cultural programs and other activities are
encouraged.
Ceremonies might include:
· opening/closing ceremony (welcome, invocation, color guard, fly-over or other activities)
· memorial service (multi-denominational religious service to honor those who served)
· candlelight ceremony (might be combined with memorial service, or feature readings of
material appropriate to the Memorial)
· reading of names (of local or state names on The Wall)
· wreath laying ceremony (by local organizations of all types or by family members)

A PROCLAMATION
As we observe the 50th anniversary of the Vietnam War, we reflect with solemn reverence upon the
valor of a generation that served with honor. We pay tribute to the more than 3 million servicemen and
women who left their families to serve bravely,a world away from everything they knew and everyone
they loved. From la Drang to Khe Sanh,from Hue to Saigon and countless villages in between,they
pushed through jungles and rice paddies,heat and monsoon, fighting heroically to protect the ideals
we hold dear as Americans.Through more than a decade of combat, over air, land, and sea, these proud
Americans upheld the highest traditions of our Armed Forces.
As a grateful Nation,we honor more than 58,000 patriots—their names etched in black granite—who
sacrificed all they had and all they would ever know. We draw inspiration from the heroes who suffered
unspeakably as prisoners of war, yet who returned home with their heads held high. We pledge to keep
faith with those who were wounded and still carry the scars of war, seen and unseen. With more than
1,600 of our service members still among the missing,we pledge as a Nation to do everything in our
power to bring these patriots home. In the reflection of The Wall, we see the military family members
and veterans who carry a pain that may never fade. May they find peace in knowing their loved ones
endure,not only in medals and memories,but in the hearts of all Americans,who are forever grateful
for their service,valor,and sacrifice.
In recognition of a chapter in our Nation's history that must never be forgotten, let us renew our sacred
commitment to those who answered our country's call in Vietnam and those who awaited their safe
return. Beginning on Memorial Day 2012,the Federal Government will partner with local governments,
private organizations, and communities across America to participate in the Commemoration of the
50th Anniversary of the Vietnam War—a 13-year program to honor and give thanks to a generation of
proud Americans who saw our country through one of the most challenging missions we have ever
faced.While no words will ever be fully worthy of their service, nor any honor truly befitting their
sacrifice, let us remember that it is never too late to pay tribute to the men and women who answered the
call of duty with courage and valor. Let us renew our commitment to the fullest possible accounting
for those who have not returned.
Throughout this Commemoration,let us strive to live up to their example by showing our Vietnam veterans,
their families,and all who have served the fullest respect and support of a grateful Nation.

the authority vested in me by the Constitution and the laws of the United States, do hereby proclaim

commemorative partners.
Commemorative events should meet one of the five congressionally
mandated objectives each year,from

SAMPLE EVENTS PROGRAM
The Wall That Heals, a half-scale replica of the Vietnam Memorial in Washington D.C.,will be visiting Williamsburg Oct. 9-13. The 250-foot long memorial and
accompanying exhibit will occupy the lawn in front of the DeWitt Wallace Decorative Arts Museum on Francis Street,
Veterans organizations and the Patriot Guard Riders will escort the wall into Williamsburg on the afternoon of October 7.Once local veterans groups finish
assembling the 24 panels that make up the memorial on Wednesday,October 8, it willbe open to visitors 24 hours a day.There is no admission charge.
In addition to providing opportunities for the public to contemplate the sacrifices made by the men and women memorialized on the wall,there willbe a series
of public events to honor the fallen.
• The opening ceremony on Oct. 9 at 10 a.m.includes a Marine Honor Guard and the Colonial Williamsburg Fifes& Drums, as well as a wreath laying by the
Combined Veterans Organizations.Retired four-star General Anthony Zinni,Congressman Rob Wittman,and incoming Colonial Williamsburg President Mitchell
Reiss will offer remarks.

Volunteers will provide assistance with locating names.You can also locate names online. On the wall,they are listed in order of casualty date.
Visitors are asked to park at Colonial Williamsburg's Visitor Center,where they can board buses that stop at the site, Buses operate from 9 a.m. until 10 p,m.

The Planning &Zoning Commission formed a subcommittee on February 27, 2014 with the purpose
of reviewing the ordinances related to the hillside disturbance envelopes and the way they are
calculated.The subcommittee was charged to look into making recommendations for revising the
standards in orderto allow a greater degree of flexibility during hillside lot designand development.

The Review Subcommittee recommended the following changes in the Subdivision Regulations to the
Hillside Protection Ordinance Sections:
1.Allowa 20'wide driveway path exemption between the front property line and the
garage door,or front of house if there is no garage.
2.Allow a 10' wide utility trench exemption subject to written confirmation of the
requirement from the utility that the trench be outside of the driveway exemption
area AND that the trench area be re-vegetated.
3.Slopes shall be considered "Hillside"slopes if they are 20% or greater.
4. Up to 40%of the "Hillside"slope areas on a residential lot may be disturbed.
5.Commercially and Industrially zoned properties shall be exempt from the hillside
disturbance limitations.
6.Residential lots that are zoned R1-6,R1-6A,R1-8,R1-8A,R1-10 and R1-10A
(Small Lot Zoning) shall be exempt from the hillside disturbance limitations and
be 100%disturbable.
The subcommittee reported its findings and recommendations to the full Planning & Zoning
Commission on July 24, 2014. At that meeting, the Commission accepted the subcommittee report
and directed staff to initiate the ordinance amendment process.
The Planning & Zoning Commission held a Public Hearing of the proposed text amendments on
September 25, 2014. The Commission unanimously voted to recommend approval of the proposed
amendments subject to two modifications.
1.Include "house"in Section 1 -5.02.C.2 so as to cover instances where there is no garage or carport.
2.Remove the sentence in Section 2 -5.04.A regarding transferring between slope categories as it no
longer appears to be applicable now that there are onlytwo slope categories.

AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AMENDING THE TOWN OF FOUNTAIN
HILLS SUBDIVISION ORDINANCE,ARTICLE 5 (GRADING
STANDARDS),SECTION 5.02 (SUBDIVISION GRADING STANDARDS)
AND SECTION 5.04 (HILLSIDE DISTURBANCE)BY MODIFYING THE
GRADING AND HILLSIDE DISTURBANCE REQUIREMENTS.
WHEREAS,the Mayor and the Council of the Town of Fountain Hills (the "Town
Council") adopted OrdinanceNo. 96-29, which established the Subdivision Ordinance for the
Town of Fountain Hills (the "Subdivision Ordinance");and
WHEREAS,Sections 5.02 and 5.04 of the Subdivision Ordinance contain provisions
relatingto gradingand hillside disturbancethat limit the amount of disturbanceallowed on lots
with slopesin excess of 10% (the "Hillside Requirements"); and
WHEREAS,the Town Council desires to amend the Subdivision Ordinance to modify
theHillside Requirements to allowfor greaterareas of disturbance on certainlots; and
WHEREAS,public hearings regarding this Ordinance were advertised in the
September 10,2014,and September 17,2014,editionsofthe Fountain Hills Times',and
WHEREAS,public hearings were held by the Fountain Hills Planning &Zoning
Commissionon September25,2014,and by the Town Council on October 16,2014.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. The foregoing recitalsare incorporated as if folly setforthherein.
SECTION 2. The Subdivision Ordinance, Article 5 (Grading Standards), Subsection
5.02.B (Grading Standards),is hereby deleted inits entirety and replaced withthe following:
B.Grading Standards.Unless exempt pursuant to Subsection 5.02.C of this
Article, the following grading standards shall apply to all property within the
corporate limits of the Town.
1.Residential Property:The area permittedto be disturbed on any platted
residential land is unlimited on terrain sloping less than 20%. Terrain
containing slopes equal to or exceeding 20% is limited to 40%
disturbance,as set forth in Subsection 5.04.A of this Article.
a. When the subdivider has granted a Hillside Protection Easement(s)
and/or has donated undisturbed hillside land to the Town or to a
Town-approved land preservation organization in an amount
necessary to satisfy the hillside protection requirements of this

Ordinance,all areas outside of the Hillside Protection Easement(s)
and/or preservation lands may be disturbed.
b.When no preservation measures have taken place in the platting
process,the disturbance allowance shall be in accordance with the
grading limitations of Subsection 5.04.A of this Article.
c.If a residual area remains after computing the allowed area of
disturbance of a lot or parcel, and any of the following conditions
apply, the Town Manger or authorized designee may allow the
property owner to disturb all or a portion of residual area under any
of the following circumstances:
1. The residual area of the lot or parcel was previously
disturbed during subdivision construction.
2. There are no rock outcrops,significant topographic features
or significant native vegetation to be preserved.
3. All adjacent property owners were permitted to disturb
property adjacent to the residual area.
d. There shall be no waiver by the Town Manager or authorized
designee, for disturbance of residual area that:
1.Contains rock outcrops,significant topographical features,
significant native vegetation;or
2.Abuts land dedicated in any form as non-disturbance or
open space, such as wash parcels, native open space tracts,
Hillside Protection Easement(s),or other non-disturbance
areas on privately owned land.
Grading of All Un-platted Land,Regardless of the Base Zoning
District:The area permitted to be disturbed for all un-platted land is
unlimited on terrain sloping less than 20%).The area permitted to be
disturbed on slopes equal to or exceeding 20%)is set forth in Subsection
5.04.A of this Article.
Grading for Non-Residential Structures in Residential Zoning
Districts:The limitations on grading area for non-residential structures in
residential zoning districts as specified in Subsections 5.02.B.1 through
5.02.B.2 of this Article, may be waived by the Town Council.
Grading for Parks and Golf Courses:The limitations on disturbance as
specified in this Article (including area of disturbance as well as height
and retention of cut and fill)may be waived by the Town Council for the

development of a park, a golf course,trails or other recreational
development that does not entail a building or buildings as the primary
purpose of the development.
5.Grading for Utility Lines:With the exception of power lines capable of
carrying 69kv or more of voltage,utility lines shall be located
underground.Utilities must be located within allowed disturbance areas as
outlined in Subsection 5.04.B.l.b of this Article.
6.Road Grading:Grading for roads is subject to the cut and fill limitations
of this Article.These limitations may be waived by the Town Council.
7.Total Disturbance:All grading,including subdivision improvement
grading,and/or disturbance performed subsequent to September 20,1991
is considered to be cumulative under this Article.
8.Disturbance Limit Fencing:Prior to the issuance of a building or
grading permit, and prior to any disturbance activities, a six foot high
imbedded chain-link fence shall be installed on the disturbance limit line
as identified on the approved site plan for the site. The disturbance limit
boundary shall be established and staked by an Arizona-registered land
surveyor. No disturbance limit fencing shall be located outside of the
surveyor's staked area. Appropriate warning signs in English and Spanish
shall also be posted at least every 100 linear feet on the required fencing.
The Town Manager or authorized designee shall inspect the fence,
signage, and surveyor's staking to insure its proper location and
construction prior to the issuance of the building/grading permit for the
site. Such fencing and signage shall be maintained in place throughout the
grading/construction process and shall only be removed after a final
inspection or Certificate of Occupancy has been issued by the Town.
These regulations may be waived by the Town Manager or authorized
designee if 100%)of the lot on which the constructionactivity is permitted
has been graded or disturbed as part of an approved subdivision grading
permit.
9.Disturbance Buffers:
a. It is recommended that all proposed non-disturbance areas or
Hillside Protection Easements be located not closer than:
1.Eight feet from any building.
2. Five feet from the outside face of any retaining wall where
the retaining wall is supporting a fill slope.
3. One foot from the "day lighted"top of a maximum one to
one cut slope, the toe of such slope beginning at the bottom

of the outside edge of the footing for any retaining wall
where the retaining wall is supporting a cut slope.
4.Three feet from the outside face of any other wall or fence
or the edge of any fill grading.
5. One foot from the edge of any cut grading.
6.Ten feet from any sewer lateral,or five feet from the edge
of any utility line trench,whichever is greater.
b.If disturbance does take place within a non-disturbance area or
within a Hillside Protection Easement,all construction and grading
activity on the site shall stop,pursuant to a Town-issued stop work
order. The stop work order shall remain effective until the
property owner and the property owner's authorized
representatives,either jointly or severally, do all of the following:
1.Provides the Town with a revised site plan prepared by an
Arizona-registered land surveyor that accurately depicts the
area and size, in square feet,of the disturbance into the
non-disturbance area(s)or Hillside Protection Easement
area(s).
2.Provides the Town with re-vegetation and irrigation plans
prepared by an Arizona-registered landscape architect for
the non-disturbance or Hillside Protection Easement area(s)
disturbed.
3.Causes the non-disturbance area(s)or Hillside Protection
Easement Area(s) to be re-vegetated and irrigated
according to the submitted and approved re-vegetation and
irrigation plans.
4. Pays to the Town a fee, in an amount determined by the
Town Manager or designee, per square foot of disturbance
that occurred within the non-disturbance areas or Hillside
Protection Easements on the property.
10.Columbaria Disturbance Exemptions by Special Use Permit:The
development of columbaria,includingany accompanying features such as
walkways,may be exempted from the regulations of this Subsection
5.02.B by Special Use Permit pursuant to Section 2.02 of the Town
ZoningOrdinance,if all ofthe followingconditionsexist:
a. The columbaria is an accessory use to a church.

b. The columbaria and any accompanying features shall be designed
to minimally alter the existing topography and vegetation.
c. The columbaria and any accompanying features shall be designed
so that any Natural Features are not disturbed.
d. The building area of the columbaria shall not exceed 10%of the
total building area of the church buildings.
e. A landscape plan prepared and stamped by an Arizona-registered
landscaping architect,which plan meets the applicable landscaping
regulations of Article VI, Section 6.05 of this Ordinance, is
submitted and approved by the Town Manager or authorized
designee.
11.Pad Elevation and Building Location Certifications:Prior to the
approval of any building stem wall inspection or a pre-slab inspection,
whichever occurs first, the property owner or his/her designee shall
provide the Town with a certification statement that is prepared, stamped
and signed by an Arizona-registered land surveyor, that certifies the
finished floor elevation(s) and the horizontal location of the building. Pad
elevations and building locations must be accurate to 1/10th of a foot as
compared to the approved site plan or an amended site plan. The
requirements in this subsection may be waived at the discretion of the
Town Engineer.
12.Stabilization of Slopes:Slope stabilization is required as set forth in the
Town's most recently adopted version of the International Building Code,
as amended.
13.Pre-Grading:A grading or building permit shall not be conditioned on
altering,modifyingor notutilizingexisting grading,if the existinggrading
work was completed in conformance with valid permits, and does not
present a threat or danger to the proposed development or neighboring
properties.This provision does not prevent the Town Engineer from
requiring necessary documentation of site suitability to assure soil
stability, compaction, and other geotechnical purposes.
14.Restoration of Graded Surfaces:
a. Vegetation shall be reestablished on all exposed fill slopes, cut
slopes,utility lines,driveway(s),and graded surfaces,except for
cosmetic landscaping abutting buildings in accordance with the
standards established in Article VI of this Ordinance.Newly
exposed rock faces shallbe stainedto match adjacent areas of the
lot.
b.This re-vegetation process shall be completed prior to the final
approval by the Town Manager or authorized designee,unless a
specific exemption is granted by the Town Manager or authorized
designee.Grading and other improvements for drainage and
erosion control purposes shall also be completed and re-
vegetated/landscaped prior to final inspection.
15.Dust Control:During all grading,and until re-vegetation or site
restoration is completed,dust should be minimized by application of
approved dust control methods.
C.Exemptions:
1.Lots used for governmental purposes and owned by utility companies that
are regulated by the Arizona Corporation Commission,and lots owned by
other political subdivisions of the State or Federal government, are exempt
from the hillside disturbance limitations of Sections 5.02 and 5.04.
2. A 20'wide band of primary driveway access (measured from the back of
curb to the nearest point of intersection with any portion of the house,the
garage door or a carport or covered driveway, if any) is excludedfrom the
hillside disturbance limitations.
3. A 10' wide utility trench exemption may be allowed, subject to written
confirmation of the requirement from the utility company stating that the
trench must be outside the driveway access exemption. Such exempted
area must be re-vegetated upon completion.
4. Single-Family Residential lots zoned Rl-6,R1-6A,Rl-8,R1-8A,Rl-10
and R1-10A shall be 100%)disturbable and exempt from the hillside
disturbance limitations.
5. Non-residential property in Commercial or Industrial zoning districts shall
be 100%o disturbable and exempt from the hillside disturbance limitations.
SECTION 3. The Subdivision Ordinance, Article 5 (Grading Standards),Subsection
5.04.A (Purpose; Methodology), is hereby amended as follows:
A.Purpose; Methodology.The purposeof these hillside regulations is to limit the
amount of hillside disturbance within each subdivision.The amount of hillside
area that may be disturbed shall be based on the severity of the slope.Hillside
areas shall mean any area having slopes equal to or greater than -tQ 20%o,as
measured from a topographical contour map prepared and stamped by an
Arizona-registered land surveyor.The Town requires the submission of
topographic contour maps having contour intervals not greater than two feet and
at a scale not smaller than 1"=20'for sites less than 10 acres.Sites 10 to 100
acresmayutilizecontour intervals not greaterthan fivefeet at a scale not smaller

than 1" =50'.Sites over 100 acres may utilize contour intervals not greater than
five feet at a scale not smaller than 1" =100'.Individual non-contiguous areas of
hillside or non-hillside that are less than 500 square feet that are located within
larger areas non-hillside or hillside,respectively,may be included with the larger
area of non-hillside or hillside that surrounds it.Whether a subdivider chooses
the Lot by Lot Hillside Protection Option or the Hillside Transfer and Protection
Option as set forth in SubSections 5.01 .G.l and 5.01.G.2,respectively,the actual
square footage of disturbance permitted within one slope interval may be
transferred into areas having lesser degree of slope. The percent of slope shall be
determined by the spacing between the contours lines as shown on the preliminary
plat.Following are the land disturbance allowance of slope interval areas of 500
square feet or more:

SECTION 4. The Subdivision Ordinance,Article 5 (Grading Standards),Subsection
5.04.B (Exemption; Calculations), is hereby amended by adding a new Subsection,504.B.1.C,to
read as follows:
c. All lots and uses deemed exempt under Subsection 5.02.C of this Article.
SECTION 5. The Subdivision Ordinance,Article 5 (Grading Standards),Section 5.04
(Hillside Disturbance), is hereby amended by deleting the Illustration of Preservation
Requirement,in its entirety.
SECTION 6. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for anyreasonto be held invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the remaining portions of
this Ordinance.
SECTION 7. The Mayor, the Town Manager, the Town Clerk and the Town Attorney are
hereby authorized and directed to execute all documents andtakeall steps necessary to carry outthe
purpose and intent of this Ordinance.

AGENDA ITEM #2 -PUBLIC HEARING TO RECEIVE COMMENTS ON ORDINANCE #14-
08,RELATING TO THE SUBDIVISION ORDINANCE OF THE TOWN OF FOUNTAIN HILLS,
ADOPTING "THE 2014 HILLSIDE DISTURBANCE AMENDMENTS TO THE SUBDIVISION
ORDINANCE OF THE TOWN OF FOUNTAIN HILLS BY REFERENCE (CASE#Z2014-04).
Chairman Lloyd Pew opened the Public Hearing at 6:35 p.m.
Senior Planner Robert Rodgers addressed the Commission and reviewed the information contained inthe
staff report.
The Planning &Zoning Commission formed a subcommittee in February ofthisyearforthe purpose of
reviewing the hillside disturbance and the way the disturbance and disturbance envelopes are calculated.
The subcommittee reported its findings to the Commission on July 24th and made six recommendations
for revising the hillside protection ordinance section standards in order to simplify the calculation

process andto allowfor a greaterdegreeof flexibility duringhillsidelot design and development.The
Commissionaccepted the report and directed staff to initiate the amendment process. He indicatedthat
Ordinance #14-08 was before the Commission tonight, which was drafted to reflect those
recommendations and contains the following changes:
1. Allow a 20'wide driveway path exemption between the front property line and the
garage door, or front of house if there is no garage.
2.Allow a 10f wide utility trench exemption subject to written confirmation of the
requirement from the utility that the trench be outside of the driveway exemption area
and that the trench area be re-vegetated.
3. Slopes shall be considered "Hillside"slopes if they are 20% or greater (currently that is 10%).
4. Up to 40%of the "Hillside"slope areas on a residential lot may be disturbed.
5.Commercially and Industrially zoned properties shall be exempt from the hillside
disturbance limitations.
6.Residential lots that are zoned Rl-6,R1-6A,Rl-8,R1-8A,Rl-10 and R1-10A (Small
Lot Zoning)shall be exempt from the hillside disturbance limitations and be 100%
disturbable.
Mr.Rodgers stated that staff recommends that the Commission forward a recommendation to the Town
Council to approve this ordinance amendment as proposed and presented.

AGENDA ITEM #3 -CONSIDERATION OF ORDINANCE #14-08,RELATING TO THE
SUBDIVISION ORDINANCE OF THE TOWN OF FOUNTAIN HILLS,ADOPTING "THE 2014
HILLSIDE DISTURBANCE AMENDMENTS TO THE SUBDIVISION ORDINANCE OF THE
TOWN OF FOUNTAIN HILLS BY REFERENCE (CASE#Z2014-04)..
Chairman Pew advised that he had a couple of minor technical changes noting that in the exemptions,
Section C, #2, the 20'wide exempted band for the driveway doesn't mention measuring to the house if a
garage or a carport isn't there; it states to the nearest garage door or carport. The second change was in
Section 2, Paragraph A (regarding methodology).He read the last part of that section,"whether a
subdividerchooses a lot by lot hillside protection option or a hillside transferprotection optionset forth,
the actual square footage of disturbance in one slope intervals can be transferred into a lower slope
interval".He stated that did not seem applicable to the situation being proposed since we only have two
intervals (one at 40% and the other at 100%).Chairman Pew commented that prior to that,there had been
four intervals and you could take area in the steeper interval and add it to a lower interval. He asked staff
to look at that and determine if it was technically correct.
Development Services Director Paul Moon stated staff could look at that.
Chairman Pew acknowledged that the ordinance addressed everything that the Commission had set out to
accomplish as it addressed all of the issues, made a simpler calculation, and had cut down a lot of
verbiage.

Chairman Pew MOVED that the Planning & Zoning Commission forward a recommendation to the
Town Council to approve Ordinance #14-08, a proposed text amendment to the Fountain Hills
Subdivision Ordinance revising the hillside protection standards in order to allow a greater degree of
flexibility during hillside lot design and development.Commissioner Jones SECONDED and the
MOTION CARRIED UNANIMOUSLY by those members present (5 0).Vice-Chairman Archambault
and Commissioner Slechta were absent.
Mr.Rodgers asked if those technical questions were intended to be included in the motion;Chairman Pew
clarified that yes, they were technical wording issues and meant to be included.
AGENDA ITEM #4-COMMISSION DISCUSSION/REQUEST FOR RESEARCH TO STAFF.

Chairman Pew asked for an update on the department's Executive Assistant and the new positions being
filled.
Mr.Rodgers stated that there were three new commissioners of which two are returning commissioners
(Commissioner Jones and Connick).The new commissioner is Jeremy Strohan.He commented on the
fact that this was the last meeting for commissioners Slechta and Strohan.
Mr. Mood commented that they hoped Janice would be returning in the next two to three weeks.
Chairman Pew asked about the joint meeting with the Town Council and Mr. Rodgers confirmed that
would be held the third or fourth week of the month in October.
Mr. Mood indicated there weren't any agenda items scheduled yet; Mr.Rodgers suggested the
Commissioners provide items for the joint meeting agenda to him so that Chairman can work with staff to
prepare the agenda.
Mr. Mood gave a brief update on the median project at the request of Commissioner Jones noting that the
project was ongoing; once the pavers were completed on the east end of the plaza, the fountain
subcontractor would start working on the pebbletec and tiling and then the pathways. He noted that then
they will move into the underground irrigation and then do the landscaping and the trees/plants. He stated
that contractually the construction isto be done by October 20th.He indicated that he was unsure at this
time if they would meet that deadline as they have a lot of work that needs to be done. He explained the
current delay regarding the turf situation noting that he anticipated an update form the contractor next
week. He pointed out that the construction fence was to stay up for an additional month to allow for the
establishment of the grass and plants; therefore, even if the construction date were met, the earliest that
construction fence would go away would be the first week in December (in time for the Stroll in the Glow
event).
