A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,ABANDONING WHATEVER RIGHT,TITLE,OR
INTEREST IT HAS IN THE HILLSIDE PROTECTION EASEMENT AT EAGLES NEST
PARCEL 11,LOT 235,AS RECORDED IN DOCUMENT 83117,RECORDS OF
MARICOPA COUNTY,(16007 N.RINGTAILTRAIL).
WHEREAS,theMayor and CounciloftheTownof Fountain Hills(the"TownCouncil"),as the
governing bodyofreal property located in the Townof Fountain Hills(the"Town"),may require the
dedication ofpublic streets,sewer,water,drainage,and other utility easements orrights-of-waywithinany
proposed subdivision;and
WHEREAS,the TownCouncil has the authority to accept or reject offers of dedication ofprivate
property by easement,deed,subdivision,plator other lawful means;and
NOW THEREFORE,BEIT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,as follows:
SECTION 1.The property owner is granting a replacement Hillside Protection Easement of
virtually equivalent area onthelot,the replacement easement will be recorded immediately followingthe
recordation of the abandonment document.
SECTION 2.That this Resolution is one of abandonment and disclaimer by the Town solely for
the purpose of removing any potential cloudonthetitleto said property and that theTowninnoway
attempts to affect therightsof any private partyto oppose the abandonment or assert anyrightresulting
there fromor existing previous to any action by the Town.
PASSED AND ADOPTED BY the Mayor and Council of the Town of Fountain Hills,
December 4,2014.
