HomeMy WebLinkAboutRes 1994-07RESOLUTION 1994-07 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA ACCEPTING FROM ARIZONA DISTRICT COUNCIL OFASSEMBLYOF GOD ALL RIGHT, TITLE,AND INTERESTTHEY POSSESS TO CERTAIN REAL PROPERTY LOCATED IN FOUNTAIN HILLS,ARIZONA. WHEREAS,The Town Council of the Town of Fountain Hills as the governing body of real property located in the Town of Fountain Hills may require the dedication of public streets,sewer,water,drainage,and other utility easements or rights-of-way within the corporate limits of the Town of Fountain Hills;and WHEREAS,The Town Council of the Town of Fountain Hills has the authority to accept or reject offers of dedication of private property by easement,deed, subdivision,plat or other lawful means;and WHEREAS,It is the express intention of the Arizona District Council of Assembly of God to convey said interest to the Town of Fountain Hills; NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,Arizona as follows: SECTION 1.That the Mayor and the Common Council of the Town of Fountain Hills, Arizona accepts by deed any and all interest possessed by the Arizona District Council of Assembly of God in the real property as depicted in "Exhibit A"and more fully described as follows: The northerly ten feet of Lot 8 of Block 2 of Fountain Hills Plat No.423,MCR;located in Section 15,T3N,R6E,G&SRB&M;and more particularly described as follows: Commencing at the northwest corner of said Lot 8,which point lies on the southerly right-of-way line of Ironwood Drive,is a corner of a 10'wide portion of Parcel A of said Plat No.423,and is the point of curvature for a curve concave northerly whose tangent bears South 77°30'00"East; Resolution 1994-07 page 1 of 2 thence along said curve having a radius of 275.00'along the southerly right-of- way of Ironwood Drive through a central angle of 36°23'00"a distance of 174.63',to a point of reverse curvature concave southwesterly and having a radius of 20.00'; thence along said curve through a central angle of 90°00'00"a distance of 31.42', to a point lying on the westerly right-of-way of Fountain Hills Boulevard; thence along the westerly right-of-way of Fountain Hills Boulevard South 23°53'00" East a distance of 10.00'; thence along a curve concave to the southwest whose radius is 20.00'and whose tangent bears North 23°53'00"West,through a central angle of 90°00'00"a distance of 31.42',to a point of reverse curvature concave northerly whose radius is 285.00'; thence along said curve through a central angle of 36°23'00"a distance of 180.98'to a point on the west boundary of said Lot 8;thence North 12°30'00"East 10.00'to the point of beginning. SECTION 2.That upon presentation of proper documentation reviewed by the Town Attorney and certified by the Town Engineer,the Mayor and Town Clerk are hereby authorized and directed to accept the deed for the real property and are instructed to record same in the Office of the Maricopa County Recorder for notice to the world as acceptance by the Town of Fountain Hills of this property as public right-of-way.
