RESOLUTION 1994-70
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA ACCEPTING FROM
MCO PROPERTIES LP.,A DELAWARE LIMITED PARTNERSHIP,
D/B/A/MCO PROPERTIES LIMITED PARTNERSHIP ALL RIGHT,TITLE,
AND INTEREST THEY POSSESS TO CERTAIN REAL PROPERTY
LOCATED IN FOUNTAIN HILLS,ARIZONA.
WHEREAS,The Town Council of the Town of Fountain Hills as the governing body of
real property located in the Town of Fountain Hills may require the
dedication of public streets,sewer,water,drainage,and other utility
easements or rights-of-way within the corporate limits of the Town of
Fountain Hills;and
WHEREAS,The Town Council of the Town of Fountain Hills has the authority to accept
or reject offers of dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,It is the express intention of MCO Properties L.P.,a Delaware limited
partnership,d/b/a MCO Properties Limited Partnership to convey said
interest to the Town of Fountain Hills;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
SECTION 1.That the Mayor and the Common Council of the Town of Fountain Hills,
Arizona accepts by deed any and all interest possessed by MCO Properties
L.P.,a Delaware limited partnership,d/b/a MCO Properties Limited
Partnership in the real property as depicted in "Exhibit A"and more fully
described as follows:

All that certain parcel of land in the County of Maricopa,State of Arizona,being a
portion of Section 9,Township 3 North,Range 6 East of the Gila and Salt River Base and
Meridian,more particularly described as follows:
Commencing at the centerline intersection of Palisades Boulevard and La
Montana Drive in the Town of Fountain Hills,as shown on "Fountain Hills
Arizona Final Plat No.102",Book 142 of Maps,Page 12,Records of
Maricopa County;
thence North 69°2V 52"West along the centerline of said Palisades Boulevard a
distance of 42.00 feet;
thence South 20°38'08"West a distance of 55.00 feet to northwesterly corner of
La Montana Boulevard Right-of-Way,as shown on "Fountain Hills Arizona
Final Plat No. 208",Book 144 of Maps,Page 4,Records of Maricopa County;
the next nine (9)courses follow along the westerly Right-of-Way line of La
Montana Boulevard as shown on said Plat No.208;
thence continuing South 20°38'08"West a distance of 1122.00 feet to a curve
whose radius bears North 69°21'52"West a distance of 30.00 feet;
thence westerly along said curve through a central angle of 90°00'00" a distance
of 47.12 feet to a point of non-tangency and the POINT OF BEGINNING;
thence South 20°38'08"West a distance of 50.00 feet;
thence South 69°2V 52"East a distance of 27.00 feet to a curve whose radius
bears South 20°38'08"West a distance of 20.00 feet;
thence southerly along said curve through a central angle of 90°00'00" a
distance of 31.42 feet to a point of tangency;
thence South 20°38'08"West a distance of 40.00 feet to a curve whose radius
bears North 69°21'52"West a distance of 20.00 feet;
thence westerly along said curve through a central angle of 90°00'00" a distance
of 31.42'to a point of tangency;
thence North 69°21'52"West a distance of 27.00 feet;
thence South 20°38'08"West a distance of 50.00 feet;
thence leaving said Right-of-Way line North 69°21'52"West a distance of 370.00
feet;
thence North 20°38'08"East a distance of 180.00 feet;
thence South 69°21'52"East a distance of 370.00 feet to the POINT OF
BEGINNING.
SECTION 2.That upon presentation of proper documentation reviewed by the Town
Attorney and certified by the Town Engineer,the Mayor and Town Clerk are
hereby authorized and directed to accept the deed for the real property
and are instructed to record same in the Office of the Maricopa County
Recorder for notice to the world as the acceptance by the Town of
Fountain Hills of this property as public right-of-way.
