A RESOLUTION OFTHE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA PURSUANT TO A.R.S.
§28-7201 ET.SEQ.ABANDONING TO THE ADJACENT PROPERTY
OWNERS ALLRIGHT,TITLE OR INTERESTIN CERTAIN PUBLIC
RIGHTS-OF-WAY LOCATED WITHIN THE AREA COMMONLY
KNOWN AS SAGUARO WOODS (FONTANA II,BLOCK 1FINAL
PLATNUMBER 110)AS RECORDED IN BOOK 159 OF MAPS,PAGE
42 AND CORRECTEDIN BOOK 168OF MAPS,PAGE 28 AND
HORIZONTAL PROPERTY REGIME AS RECORDED IN BOOK 160 OF
MAPS,PAGE 4OFTHE RECORDS OFTHE MARICOPA COUNTY
RECORDER WHICH HAVE FOUND TOBE NO LONGER NECESSARY
FOR PUBLIC USE.
WHEREAS,A.R.S.§28-7201 et.seq.provides for the disposition of unnecessary public
roads;and
WHEREAS,TheTown Council of the Townof Fountain Hills is the governing body of the
Town;and
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona,as follows:
SECTION 1.That the right-of-way for Boxwood,Oakwood and Teakwood,originally
private roads whose centerline is as shown inBook160of maps,Page 4;
together with Parcels Al,A2,A3,Bl,and B2 dedicated inDkt 13442,Page
1524,Maricopa County Records as depicted in"ExhibitA"attached hereto
and incorporated herein is hereby declared to be no longer necessary for
public use as right-of-way.
SECTION 2.That the Council determines this property can best be used to protect the
public health,safety and welfare of the adjacent property owners and the
citizens of the Town and therefore declares that the value of the property
is de minimis and that no compensation is required from the adjacent
property owners pursuant to A.R.S.§28-7208.

SECTION3.That upon recordation of this resolution in the office of the Maricopa
County Recorder,title to Boxwood,Oakwood,Teakwood and to Parcels
Al,A2,A3,Bl and B2 as depicted in Exhibit A shall vest in the owners of
record of the adjacent property as determined by the records of the
Maricopa County Recorder.
SECTION4.That a public utility easement and emergency access easement shall be
retained,as depicted in Exhibit A,attached hereto.

SPECIAL WARRANTY DEED

Forthe consideration ofTenDollars ($10.00)andother valuable considerations,Saguaro
WoodHomeowners'Association("Grantor"),herebyconveystotheTownofFountainHills,
("Grantee"),the following realpropertysituatedinMaricopaCounty,Arizona(the "Property"):
SeeExhibit"A"and"B"attachedheretoandincorporatedhereinbythisreference.
EXCEPT alloil,gases and other hydrocarbon substances,coal,stone,metals,
minerals,fossils,andfertilizersofeverynameanddescription,together withall
uranium,thorium,oranyothermaterialwhichisormaybe determined tobe
peculiarlyessential tothe production of fissionable materials,whether ornot of
commercial value;and
EXCEPTallundergroundwaterin,underorflowingthroughthePropertyand
water rights appurtenant thereto;and
SUBJECT toalltaxesand other assessments,reservations inpatentsoralleasement,
covenants,conditions,restrictions,reservations,rightsandrightsofway,obligationsand
liabilities asmay appear of record,andtoall Federal,State,County,District andlocallaws,
ordinances,regulations,zoning codes andthelikeasthesamenowexistandasmaybe hereafter
established or amended.
Grantor herebywaives,releases and relinquishes allsurfacerightstotheProperty,
including without limitation therights of ingress and egress on,to,over andacrosstheProperty
forthe purpose of testing,drilling,mining,removing,producing,storing,treating or transporting
anyoftheabove excepted substances,by pipeline or otherwise,orthe performance of anymining
operations,removal of earth,orforany other purposes.Provided,however,nothing herein
contained shallbe construed as waiving,releasing or relinquishing any right,titleor interest of
Grantor inandtothe above excepted substances inand under and that maybe produced from
the property.
Grantor hereby binds itself andits successors to warrant and defend thetitleas against
allacts of Grantor herein and none other,subject tothe matters above setforth.
