RESOLUTION NO.2001-27
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,AUTHORIZING
THE TOWN,PURSUANT TO A.R.S.28-2603,TO USE UP TO
TEN PERCENT OF LOCAL TRANSPORTATION
ASSISTANCE FUND MONIES FOR ALL USES AS
ALLOWED BY LAW.
WHEREAS,the Thirty-Fifth Legislature,second special session of 1981,established aLocal
Transportation Assistance Fundfromtheproceeds of theArizonaStateLottery;and
WHEREAS,the Forty-Second Legislature,second regular session of 1996,amended Title 28,
Transportation,removing the requirement that cities and towns applytothe department of transportation for
local transportation assistance fund (LTAF)monies eachyear;and
WHEREAS,A.R.S.28-2603,stillinfull force and effect,states that acityor town may authorize
byresolution theuseofuptotenpercentoflocaltransportationassistancefundmoniesreceivedinanyone
fiscalyearfor cultural,educational,historical,recreational or scientific facilities or programs orfor
nonresidential outpatient programs or services for developmentally disabled persons as defined byA.R.S.
36-551 whohave never resided within a facility identified inor established pursuant toA.R.S.36-558 ifthe
monies are matched equally by nonpublic monies received bythecityortownand expended forthesame
purposes,except inafiscal year when thetotal distributed from thelocal transportation assistance fundis
lessthan twenty-three million dollars;and
WHEREAS,funds received bythe Town of Fountain Hillsaretobeusedforthe following
purposes:
ALL USES AS ALLOWED BY LAW.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,THAT the Town of Fountain Hills has declared intent,as
authorized byA.R.S.28-2603,touseten percent of local transportation assistance fundmoniesinanyone
yearfor purposes other than transportation.
PASSED this7thday of June 2001bythe Mayor and Council of the Town of Fountain Hills,
Arizona.
