AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AMENDING THE TOWN OF FOUNTAIN
HILLS TOWN CODE,CHAPTER 1,RELATING TO CIVIL CITATIONS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1.TheFountainHillsTownCode,Chapter1(General),Article1-8
(Penalty),Section1-8-3(CivilPenaltyProvisions),Subsection l-8-3(D)(CivilCitations),is
hereby amended as follows:
D.Civil Citations.
1.Unless otherwisedesignated asa criminal offense,ifa violation continues pastthe
compliance timesetforthinthenoticeof violation,acivil citation maybeissued
tothe person orentity responsible forthe violation.
2.Acivil citation maybeissuedbythe Town Manager or authorized designee.
3.The civil citation shall include the date of the violation,a reference tothe
sections(s)violatedand,if applicable,thelocationofthepropertyorsiteatissue.
4.Thecivil citation shall direct the defendant topaythefine imposed pursuant to
subsection l-8-3(E)below or appear inthe Fountain Hills Municipal Court within
ten days of issuance of ON THE DATE NOTED ONthe citation,WHICH DATE
SHALL NOT BE LESS THAN TEN DAYS AFTER CITATION ISSUANCE.
5.Thecivil citation shall provide noticethatifthe defendant failstopaythefineor
appear in the.Fountain Hills Municipal Court as cHrected,«a default judgmentwill
be entered inthe amount of thefine designated onthe citation forthe violation.
In addition,a default feemaybe imposed forfailureto appear.
6.Service ofthe citation maybe accomplished andwillbe deemed proper and
complete byanyofthe following methods:
a.Hand delivering the citation tothedefendant.IF THE DEFENDANT IS
A BUSINESS,SERVICE MAY BE BY HAND DELIVERY TO THE
BUSINESS OWNER,ANY ADULT MANAGER OF THE BUSINESS,
OR ANY ADULT EMPLOYEE OF THE BUSINESS.
b.Mailingacopyofthecitationbycertifiedorregisteredmail,returnreceipt
requested,tothe defendant's lastknownaddress.IFTHE DEFENDANT
ISA BUSINESS,SERVICE MAY BEBY CERTIFIED OR

REGISTERED MAIL,RETURN RECEIPT REQUESTED,TO THE
CURRENT BUSINESS ADDRESS.
c.Any means allowed bythe Arizona Rules of Civil Procedure forthe
Superior Courts of Arizona.
SECTION 2.Ifanysection,subsection,sentence,clause,phraseorportionofthis
Ordinanceisforanyreasonheldtobeinvalidor unconstitutional bythedecisionofanycourtof
competent jurisdiction,such decision shallnotaffectthevalidityoftheremainingportionsof
this Ordinance.
SECTION 3.The Mayor,theTown Manager,the Town Clerk andtheTown Attorney
are hereby authorized and directed to execute all documents and take allsteps necessary to carry
outthe purpose and intent of this Ordinance.
