RESOLUTION NO.2002-23
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,AUTHORIZING
THE TOWN,PURSUANT TO A.R.S.28-8104,TO USE UP TO
TEN PERCENT OF LOCAL TRANSPORTATION
ASSISTANCE FUND MONIES FOR ALL USES AS
ALLOWED BY LAW.
WHEREAS,theThirty-FifthLegislature,secondspecialsessionof1981,establishedaLocal
TransportationAssistanceFundfromtheproceedsoftheArizonaStateLottery;and
WHEREAS,the Forty-Second Legislature,second regular session of 1996,amended Title 28,
Transportation,removingtherequirementthatcitiesandtownsapplytothedepartmentoftransportationfor
local transportation assistance fund(LTAF)monieseachyear;and
WHEREAS,A.R.S.28-8104,stillinfullforceandeffect,statesthatacityortownmayauthorize
by resolution theuseofuptotenpercentoflocaltransportationassistancefundmoniesreceivedinanyone
fiscalyearforcultural,educational,historical,recreationalorscientificfacilitiesorprogramsorfor
nonresidentialoutpatientprogramsorservicesfordevelopmentallydisabledpersonsasdefinedbyA.R.S.
36-551 whohaveneverresidedwithinafacilityidentifiedinorestablishedpursuanttoA.R.S.36-558ifthe
moniesarematched equally by nonpublic monies received bythecityortownand expended forthesame
purposes,except inafiscalyearwhenthetotal distributed from thelocal transportation assistance fundis
lessthan twenty-three million dollars;and
WHEREAS,fundsreceivedbytheTownofFountainHillsaretobeusedforthefollowing
purposes:
ALL USES AS ALLOWED BY LAW.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF FOUNTAIN HELLS,ARIZONA,THAT the Town of Fountain Hills has declared intent,as
authorizedbyA.R.S.28-8104,tousetenpercentoflocaltransportationassistancefundmoniesinanyone
yearforpurposes other than transportation.

Arizona.
