Related Ordinance,Policy or Guiding Principle:N/A Staff Summary (background):The Final Plat for Diamante del Lago was approved by the Town Council on 6- 17-99,and was recorded on 11-5-99.The platted lots in this subdivision are separated by two "Exception" parcels (which were purchased by the Town for ridgeline open space, per a public vote,in 1999).Additionally, 7 Tracts, totalling 50 acres, were dedicated on the Diamante del Lago final plat to the Town as Hillside Protection Easement. A Town trail, now known as the "Lake Overlook Trail", with access connections to various public and private roadways, was modified and re-connected after the subdivision's construction. The private roadways within the Diamante del Lago plat (Tracts A1 and A2)were platted with the following blanket easements over them:General Public,Pedestrian Access,Emergency Access,Public Utility (PUE), and Drainage (DE)Easements. Construction completion of the Lake Overlook Trail has now taken away the former need for public pedestrian access to the private roadways within the Diamante del Lago plat. So,the platted General Public and Pedestrian Access Easements on the Diamante del Lago private street rights-of-way (Tracts A1 and A2)can now reasonably be abandoned,as requested. This abandonment does NOT affect the existing Emergency Access,Public Utility, and Drainage Easements platted on the private roadways in the Diamante del Lago plat.Because the existing Public Utility Easements will remain intact on the Diamante del Lago private streets, the utility companies do not need to review/approve of this abandonment action. Applicant:Sandi Thompson,Chair,Public Art Committee Applicant Contact Information:PO Box 18254,Fountain Hills, AZ Owner: Owner Contact Information: Property Location: Related Ordinance,Policy or Guiding Principle: Staff Summary (background):The Public Art Committee has proposed the acquisition of a new art installment entitled "Fountain of Light"by artist Brian Schader. The piece is expected to have a base of 14 to18 feet in diameter and an overall height of 48 to 50 feet. The sculpture is comprised of glass and galvanized steel and is designed to be lit internally. The committee has recommended installing this piece on the eastern end of the Avenue of the Fountains. Duringthe reconstruction and renovation of the Avenue of the Fountain plaza, a master plan was designed to accommodated multiple art nodes. These nodes were designed to fit the aesthetic of the plaza and have art thoughtfully placed throughout the winding pathway. The proposed location of the "Fountain of Light"sculpture was not anticipated within the master plan for art installations and no art node or accommodations have been made for the installation of the piece.Based on the size and suggested location of the piece, redesign of the eastern end of the median would be required to accommodate ADA accessibility requirements.Possible options include partial removal of the gabion baskets and seat walls, redesign and installation ofthe brick paver walking path,and/or removal of existing trees. Additional considerations for this piece include potential violation of the "Dark Skies"Ordinance,as the illumination scale is not currently known. The base for this piece will need to be commissioned and structurally designed, with review and approval by the Town Engineer. "Fountain of Light"is not currently funded. If this piece is approved by the Council, the Public ArtCommittee will work with the artist to develop fund raising efforts. The pieces has an acquisition price of $125,000 with an additional $25,000 needed for the base. Risk Analysis (options or alternatives with implications): Ongoing maintenance costs are yet to be determined, structural engineering review is required for the base,ADA accomodations required. Page 1 of 2 Scope and Scale Foundation Dimensions: 14’ to 18’ in diameter and 5’ to 7’ tall. Sculpture Dimensions: 4’ x 4’ tapering to 3’ x 3’, and 41’ to 43’ tall. Overall Height: 46’ to 50’ tall Site Footprint and Impact •The Avenue master plan did not accommodate for a sculpture of this size or scope. •Proposed 18 ft base, indicated by length of measuring tape along the pavers. • The site must be modified to accommodate the base • Installation as currently proposed does not meat ADA requirements. Visual Height Comparison • An estimate of height for the “Fountain of Light” sculpture is 46 ft to 50 ft. • The pine trees on the east end of the plaza, featured in the background, are roughly 55 ft. • The height of the gabion basket and light fixture, featured in the foreground, is 9 ft. • The height of the new Park Place construction along the Avenue of roughly 54 ft. Additional Height and Width Comparisons Christmas tree display: • 23 ft tree atop a 3 ft base. •Equivalent to roughly half of the height of the proposed “Fountain of Light” sculpture. •Christmas tree base is 12 ft in diameter. •Proposed base would be an additional 2 to 4 ft wider in diameter.
