REGULAR SESSION WHEN: THURSDAY, MARCH 18, 2010 WHERE: FOUNTAIN HILLS COUNCIL CHAMBERS 16705 E. AVENUE OF THE FOUNTAINS, FOUNTAIN HILLS, AZ PROCEDURE FOR ADDRESSING THE COUNCIL Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the Clerk’s position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Clerk or the Mayor. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Councilmembers. Speakers’ statements should not be repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion of their time for a later time or (ii) transfer any portion of their time to another speaker. If there is a Public Hearing, please submit the speaker card to speak to that issue during the Public Hearing. Individual speakers will be allowed three contiguous minutes to address the Council. Time limits may be waived by (i) discretion of the Town Manager upon request by the speaker not less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the Mayor either prior to or during a Meeting. (ii) Presentation by Carole Groux, LPC, Director of Fountain Hills Youth Substance Abuse Prevention Coalition, and Sarah Brichler with Pima Prevention Partnership, relating to Fountain Hills youth substance abuse Assessment and Planning for reducing underage alcohol use in Fountain Hills. CALL TO THE PUBLIC Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any such comment (i) must be within the jurisdiction of the Council and (ii) is subject to reasonable time, place, and manner restrictions. The Council will not discuss or take legal action on matters raised during “Call to the Public” unless the matters are properly noticed for discussion and legal action. At the conclusion of the call to the public, individual Councilmembers may (i) respond to criticism, (ii) ask staff to review a matter or (iii) ask that the matter be placed on a future Council agenda. CONSIDERATION of a SPECIAL EVENT APPLICATION submitted by Perimeter Bicycling Association of America, Inc. for El Tour de Phoenix. The event is scheduled for April 10, 2010, travelling through Fountain Hills along Shea Boulevard from approximately 8:15-9:15 a.m. and will require law enforcement and traffic control. 7. CONSIDERATION of a SPECIAL EVENT APPLICATION submitted by Special Olympics Arizona for Chester’s Torch Ride. The event is scheduled for April 17, 2010, travelling through Fountain Hills along Shea Boulevard from approximately 10:45 a.m.-12:30 p.m. and will require law enforcement and traffic control. PRESENTATION WITH CONSIDERATION of approving the Swaback Partners Landscape Plan for the Greening of Downtown as it pertains to the creation of TWO (2) DEMONSTRATION PROJECTS near the amphitheater in Fountain Park. 9. What are the purposes of a Social Host/Unruly Gathering Ordinance? •Law Enforcement tool; Prevention Tool •Targets non-commercial individuals who own, lease, or control a house, property, rental, etc. •Criminal and/or Civil Liability •Educate the public; Possible misdemeanor, jail time, monetary fines •State or Local Level Law But We Already Have a State Law... 1.Such person knowingly allows a gathering on such unlicensed premises of two or more persons who are under the legal drinking age and who are neither: (a) Members of the immediate family of such person. (b) Permanently residing with such person. 2.Such person knows or should know that one or more of the persons under the legal drinking age is in possession of or consuming spirituous liquor on the unlicensed premises (ARS §4-241. Q.) What Tools Do Our Officers Have? “When you go to a party where there’s underage drinkers, there’s a pretty good chance that someone over 21 is helping them, but trying to establish it beyond reasonable doubt is difficult.” Brett Wallace, Casa Grande City Attorney Law enforcement officers report that the existing tools are inadequate. WHEREAS, the Town of Fountain Hills (the “Town”) did hold a primary election on March 9, 2010 (the “Primary Election”) for the nomination/election of the Mayor and three Councilmembers; and WHEREAS, the Primary Election returns have been presented to and have been canvassed by the Mayor and Council of the Town of Fountain Hills. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS as follows: SECTION 1. The total number of ballots cast at the Primary Election, as shown by the poll lists was 4,540. SECTION 2. The number of provisional ballots was 35, the number of conditional provisional ballots was 0, the number of challenged ballots was 0, the number of provisional ballots not counted was 4; and the number of rejected early ballots was 29. WHEREAS, Maricopa County has historically experienced damage from natural hazards such as flooding, wildfire, drought, severe winds and others on many occasions in the past century, resulting in loss of property and/or life, economic hardship and threats to public health and safety; and WHEREAS, the November 2009 Maricopa County Multi-Jurisdictional Multi-Hazard Mitigation Plan (the “2009 Plan”) has been developed after more than one year of review, research and update work by the Town of Fountain Hills (the “Town”) in association and cooperation with the Maricopa County Multi-Jurisdictional Planning Team for the reduction of hazard risk to the community; and WHEREAS, the 2009 Plan specifically addresses natural hazard vulnerabilities, mitigation strategies and plan maintenance procedures for the Town; and WHEREAS, the 2009 Plan is an update and replacement for the previous hazard mitigation plan adopted by the Town on September 16, 2004, by Resolution No. 2004-49 (the “2004 Plan”); and WHEREAS, the 2009 Plan recommends several hazard mitigation actions/projects that will provide mitigation for specific natural hazards that impact the Town, with the goal of protecting people and property from loss associated with those hazards. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS as follows: SECTION 1. The recitals set forth above are hereby incorporated as if fully set forth herein. SECTION 2. The 2009 Plan is hereby approved in the form attached hereto as Exhibit A and incorporated herein by this reference. SECTION 3. The 2004 Plan is hereby repealed. SECTION 4. The 2009 Plan shall be implemented, monitored and maintained by the officials/staff designated in the 2009 Plan for a period five years from the date of this Resolution. SECTION 5.
