(Executive Session will be held in the Fountain Conference Room - 2nd floor)

PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the
Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in the
Council Chamber Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk or
the Mayor. At that time, speakers should stand and approach the podium. Speakers are asked
to state their name prior to commenting and to direct their comments to the Presiding Officer
and not to individual Councilmembers. Speakers’ statements should not be repetitive. If a
speaker chooses not to speak when called, the speaker will be deemed to have waived his or her
opportunity to speak on the matter. Speakers may not (i) reserve a portion of their time for a
later time or (ii) transfer any portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during the
Public Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time limits
may be waived by (i) discretion of the Town Manager upon request by the speaker not less than
24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the Mayor either
prior to or during a Meeting. Please be respectful when making your comments. If you do not
comply with these rules, you will be asked to leave.

CALL TO THE PUBLIC
Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any
such comment (i) must be within the jurisdiction of the Council and (ii) is subject to reasonable time, place, and manner
restrictions. The Council will not discuss or take legal action on matters raised during “Call to the Public” unless the
matters are properly noticed for discussion and legal action. At the conclusion of the call to the public, individual

from 9:00 a.m. to 11:59 p.m.
6. CONSIDERATION of a SPECIAL EVENT APPLICATION submitted by Perimeter
Bicycling Association of America, Inc. for El Tour de Phoenix. The event is scheduled for
April 10, 2010, travelling through Fountain Hills along Shea Boulevard from approximately
8:15-9:15 a.m. and will require law enforcement and traffic control.
7. CONSIDERATION of a SPECIAL EVENT APPLICATION submitted by Special Olympics
Arizona for Chester’s Torch Ride. The event is scheduled for April 17, 2010, travelling
through Fountain Hills along Shea Boulevard from approximately 10:45 a.m.-12:30 p.m. and
will require law enforcement and traffic control.

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, DECLARING AND ADOPTING THE
RESULTS OF THE PRIMARY ELECTION HELD ON MARCH 9, 2010.
WHEREAS, the Town of Fountain Hills (the “Town”) did hold a primary election on
March 9, 2010 (the “Primary Election”) for the nomination/election of the Mayor and three
Councilmembers; and
WHEREAS, the Primary Election returns have been presented to and have been
canvassed by the Mayor and Council of the Town of Fountain Hills.

SECTION 1. The total number of ballots cast at the Primary Election, as shown by the
poll lists was 4,540.
SECTION 2. The number of provisional ballots was 35, the number of conditional
provisional ballots was 0, the number of challenged ballots was 0, the number of provisional
ballots not counted was 4; and the number of rejected early ballots was 29.
SECTION 3. The votes cast for the candidates for Mayor were as follows:

RESOLUTION NO. 2010-01
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, APPROVING THE TOWN OF FOUNTAIN
HILLS 2009 HAZARD MITIGATION PLAN.
WHEREAS, Maricopa County has historically experienced damage from natural hazards
such as flooding, wildfire, drought, severe winds and others on many occasions in the past
century, resulting in loss of property and/or life, economic hardship and threats to public health
and safety; and
WHEREAS, the November 2009 Maricopa County Multi-Jurisdictional Multi-Hazard
Mitigation Plan (the “2009 Plan”) has been developed after more than one year of review,
research and update work by the Town of Fountain Hills (the “Town”) in association and
cooperation with the Maricopa County Multi-Jurisdictional Planning Team for the reduction of
hazard risk to the community; and
WHEREAS, the 2009 Plan specifically addresses natural hazard vulnerabilities,
mitigation strategies and plan maintenance procedures for the Town; and
WHEREAS, the 2009 Plan is an update and replacement for the previous hazard
mitigation plan adopted by the Town on September 16, 2004, by Resolution No. 2004-49 (the
“2004 Plan”); and
WHEREAS, the 2009 Plan recommends several hazard mitigation actions/projects that
will provide mitigation for specific natural hazards that impact the Town, with the goal of
protecting people and property from loss associated with those hazards.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. The recitals set forth above are hereby incorporated as if fully set forth
herein.
SECTION 2. The 2009 Plan is hereby approved in the form attached hereto as Exhibit A
and incorporated herein by this reference.
SECTION 3. The 2004 Plan is hereby repealed.
SECTION 4. The 2009 Plan shall be implemented, monitored and maintained by the
officials/staff designated in the 2009 Plan for a period five years from the date of this Resolution.
SECTION 5. The Mayor, the Town Manager, the Town Clerk, the Town Attorney and
other Town officers and employees are hereby authorized and directed to take all steps necessary
to (i) carry out the purpose and intent of this Resolution and (ii) perform the duties ascribed to
them by the 2009 Plan.
