After much research and discussion over the last year staff and the Commission decided leaving liquor service up to the client would be the best case scenario to help the residents of Fountain Hills. The presentation will give a timeline of events leading up to this decision, explanation of the current policy and a report on events that have taken place since this change. Risk Analysis (options or alternatives with implications): During this trial period the liquor license is in "inactive" status with the AZ Department of Liquor. At the end of January we will re-evaluate the new policies. Fiscal Impact (initial and ongoing costs; budget status): Saved approximatley $20,000 by removing from the budget (product cost, insurance, staff time, license renewals) Budget Reference (page number): Recommendation(s) by Board(s) or Commission(s): Community Center Advisory Commission unanimously approved the release of the liquor license at the April 2009 meeting. Staff Recommendation(s): Continue with the trial period and if no issues over the next five months release the liquor license. Attachment(s): Presentation and liquor policy SUGGESTED MOTION: N/A Page 1 of 2 Town of Fountain Hills Community Center Liquor Policy & Procedures 1. An alcohol permit must be completed and approved by the Director in order to serve any type of alcoholic beverage inside of the Community Center building; there is no fee for the application. Application is required to be submitted to Center staff no later than two weeks prior to event date. 2. Alcoholic beverage service may be provided by the vendor of your choice, subject to Center staff approval. The liquor vendor is required to be licensed through the Arizona Department of Liquor Licenses and Control and shall have a current Town of Fountain Hills business license. Proof of both licenses will be required no later than two weeks prior to event date. If the appropriate paperwork is not provided, alcohol service will not take place. NO EXCEPTIONS! 3. Only the vendor or authorized designee holding the permit is allowed to bring alcohol into the facility. There must be a designated licensed bartender responsible for serving the alcohol at all times. At no time can guests help themselves to liquor. Open bottles are not allowed on tables. At no time are guests allowed to bring in their own alcohol. Control of the liquor is crucial and any infraction will result in the closing of your event immediately upon warning and non-compliance. 4. Per state regulation liquor is permitted only within the hours of noon to 10 p.m. Liquor cannot be served past 10:00 pm 5. Licensee, except non- profit entities with a Special Event Liquor License, will not be able to sell liquor at events. (No cash bars) 6. Non-profit entities will be able to hold a liquor event through a Special Event Liquor License issued by the Arizona Department of Liquor Licenses and Control, with approval by the Town Council. This process typically takes two months, so applications will need to be filled out in a timely manner. Each special event liquor license application is subject to fees charged by the Arizona Department of Liquor Licenses and Control and by the Town. Page 2 of 2 7. Non-Profit entities that apply for Special Event Liquor Licenses must adhere to all applicable State laws and regulations, including, but not limited to ARIZON REVISED STATUTE 4-203,02, which allows non-profit groups to sell alcohol; subject to certain restrictions. It is the non-profit entity’s sole responsibility to ensure compliance with the applicable State laws and regulations. Additional information on Special Event Liquor Licenses may be obtained from the AZ Department of Liquor Licenses and Controls website. www.azliquor.gov/licensing/series/15.asp 8. Consumption of beer, wine or spirits shall only occur within the Center premises and outdoor patio area. No person or entity may bring opened containers of beer, wine, or spirits outside of these designated areas. 9. The Center management reserves the right to restrict service of beer, wine, or spirits to any person or event if determined it is in the best interest of the public and the Center. 10. Licensee shall conform to all the state and local laws, Policies and Procedures governing the serving and consumption of beer, wine and spirits. Violation of any of the provisions related to the sale, use or consumption of liquor affords the Center the right to impose restrictions and penalties, including, but not limited to, the cancellation or termination of the event without notice at the discretion of the Center Director or designee. 11. The Center will require, at Licensee’s expense, security personnel as may be determined to be appropriate for the event. Center staff will contract with Maricopa County Sheriff’s Office for all security needs. Security is required from the time liquor service begins until one hour after liquor service has ended. 12. The Licensee signing the permit is responsible for upholding all policies regarding liquor service. Failure to adhere to these policies will result in a revocation of the alcohol permit and no liquor will be allowed into the Center. LIQUOR/SECURITY POLICY DISCUSSION Town of Fountain Hills Community Center Timeline of Events April 2008 Presentation was done for the CCAC and public who attended the meeting;we highlighted State Liquor Laws and Town Policies regarding liquor service and security required at events. (Item #7 on agenda) November 2008 At the joint meeting with Council, Commission Chairman Jerry Gorrell spoke about the liquor and security policies. He explained why security is needed at all events serving liquor;covered using MCSO off-duty officers vs. security companies. January 2009 Discussed Liquor and Security at the CCAC meeting. Timeline of Events February 2009 “Stake holder” meeting took place at the Community Center; discussed a variety of topics. We presented the idea of releasing the liquor license and having clients arrange for their own alcohol service. At this time we explained how this would allow the non-profits to apply for a special event liquor license and raise money for their organization. We heard only positive responses during and after the meeting. At this meeting a challenge was posed to Community Center Advisory Commission and staff to “find an answer to help non-profit organizations” Timeline of Events April 2009 Discussion item at the CCAC meeting (items #12-13-14) Discussion regarding a sole source vendor for all services; after researching,decided this would not be a feasible option. Item #14 “Consideration of approving the release of the liquor license as of July 1, 2009” CCAC unanimously approved the motion. During the budget hearings the decision was made to move forward with the Commission recommendation and not to budget for bar supplies or bartenders. This saved approximately $20,000. Timeline of Events July-August 2009 Communication with the public notifying of policy changes:•Letter was sent to all regular users•Posted information on the Town’s website•Article in the FH Times•AveNews Article September 2009 Held first events with new policy in place; one wedding reception and the Historical Society dinner which applied for a special event liquor license. Both events went very well and we have heard only positive comments about the new policy. Updated Liquor Policy –Special Events Alcoholic beverages may be served by the bartending or catering service of the licensee’s choice. By State law, anyone serving liquor is required to be certified through the State of Arizona Liquor Board. Proof of certification must be presented to Center staff prior to event date. At no time are guests allowed to bring in their own alcohol. Per State Regulation (R19-316) liquor can not be served past 10:00 pm. Licensee, except non-profit entities with a Special Event Liquor License, will not be able to sell liquor at event. No cash bar. Update Liquor Policy –Non-profits Certified 501 Non-profit entities will be able to sell liquor and keep a percentage of the proceeds from the event. Entity would be required to apply for a Special Event Liquor License through the State of AZ Department of Liquor Division and obtain approval by Town Council. Security Policy This policy has not changed. MCSO off-duty officers are required to be at all events that are serving liquor. Officers must be on site at the time liquor service begins until one hour after service has ended. QUESTIONS
