WHERE: TOWN HALL COUNCIL CHAMBERS, BUILDING B 16836 E. PALISADES BOULEVARD Pursuant to A.R.S. 38-431.02, notice is hereby given to the Directors of the District Board of the Eagle Mountain Community Facilities District and to the general public that the District Board of the Eagle Mountain Community Facilities District will hold a special session open to the public beginning at 6:25 p.m. and immediately prior to the Council meeting that begins at 6:30 p.m. The agenda for the meeting is as follows: 1.) Meeting CALLED TO ORDER and ROLL CALL. 2.) CALL TO THE PUBLIC. Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any such comment (i) must be within the jurisdiction of the Directors is subject to reasonable time, place and manner restrictions. The Directors will not discuss or take legal action on matters raised during “Call to the Public” unless the matters are property noticed for discussion and legal action. At the conclusion of the call to the public, individual Directors may (i) respond to criticism, (ii) ask staff to review a matter or (iii) ask that the matter be placed on a future agenda. 3.) CONSIDERATION of approving the meeting MINUTES of June 2, 2005. 4.) CONSIDERATION of RESOLUTION EMCFD 2005-04, adopting the final budget for the fiscal year beginning July 1, 2005, and ending June 30, 2006; and levying upon the assessed valuation of the property within the district, subject to ad valorem taxation a certain sum upon each one hundred dollars ($100.00) of valuation sufficient to raise the amounts estimated to be required in the annual budget, specifically for the purpose of paying principal and interest upon bonded indebtedness; all for the fiscal year ending on June 30, 2006. 5.) PALISADES BLVD., FOUNTAIN HILLS, AZ (Executive Session will be held in the Building A Teleconference Room) PROCEDURE FOR ADDRESSING THE COUNCIL Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the Clerk’s position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Clerk or the Mayor. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Council Members. Speakers’ statements should not be repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion of their time for a later time or (ii) transfer any portion of their time to another speaker. If there is a Public Hearing, please submit the speaker card to speak to that issue during the Public Hearing. Individual speakers will be allowed three contiguous minutes to address the Council. Parks, recreation activities and leisure experiences provide opportunities for young people to live, grow and develop into contributing members of society; create lifelines and continuous life experiences for older members of the community; generate opportunities for people to come together and experience a sense of community; and, pay dividends to communities by attracting business and jobs and increasing housing values. As we observe Recreation and Parks Month, we recognize the vital contributions of employees and volunteers in parks and recreation facilities. These dedicated supporters keep public parks clean and safe for visitors, organize youth activities, provide educational programming on health, nutrition, first aid and gardening, advocate for more open space and better trails, and fundraise for local improvements. They ensure that parks and recreation facilities are safe and accessible places for all citizens to enjoy. Staff Recommendation: Approve Fiscal Impact: Yes $37,060 Purpose of Item and Background Information: Council approved the Feasibility Study for the skate park on October 21, 2004. SITE Design Group, Inc. completed that study. The Feasibility Study recommended a 15,000 sq. ft. concrete, combination, dual-use facility be built at Desert Vista Park. Dual use design would include both skateboard and biker users. The report also recommended constructing the park in two phases: a street style course utilizing existing Town funds, and a flow course utilizing donations from the public. Staff spent considerable time working initially on a design/build approach to complete the skate park design and construction. The design/build approach was used because staff wanted to select the highest qualified firm to design and build the skate park. While three firms attended a mandatory prebid meeting only, SITE Design Group, Inc., submitted a proposal. Unfortunately, state statutes require at least two firms submit proposals as part of the design/build process. Therefore, an alternative method needed to be chosen. It was determined the next best method of procuring a highly qualified firm was the two-step design/construction manager at risk approach. The initial step in this process is accepting a proposal from SITE Design Group, Inc. for the design of the skate park, and including it in a Professional Services Agreement. The Agreement stipulates $37,060 to complete the design work through construction documents for both phases of the project. The subsequent construction portion of the project would only include the first phase, or street style course, under a subsequent construction manager at risk arrangement. Designing both phases at this time has several potential benefits. Quantities for the second phase for steel and concrete, could be predetermined, which would greatly assist the local Skate Park Committee as it continues its efforts to secure donated funds, labor and/or materials. Designing both phases simultaniously helps ensure the two phases would work well together on the site, and be compatible with each concerning grading, site access and parking. The "In The Loop" Parks and Recreation Activity Guide will contain parks, recreation, senior services, and Community Center information and will be distributed three times per year. Buse Printing has been providing printing and mailing services for the Town for the past two years. The contract with Buse Printing was awarded following a successful bid in 2003. The contract was restructured in 2004 to allow for the two publications. Town staff is pleased with both the quality of printing and the timely mailing of the newsletter and desires to continue the contractual relationship for an additional year. Furthermore, Buse Printing agreed with the 2.7% Consumer Price Index increase, as stipulated in the contract.
