AVENUE OF THE FOUNTAINS, FOUNTAIN HILLS, AZ (Executive Session will be held in 2nd floor Conference Room) PROCEDURE FOR ADDRESSING THE COUNCIL Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the Clerk’s position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Clerk or the Mayor. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Council Members. Speakers’ statements should not be repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion of their time for a later time or (ii) transfer any portion of their time to another speaker. If there is a Public Hearing, please submit the speaker card to speak to that issue during the Public Hearing. Individual speakers will be allowed three contiguous minutes to address the Council. Time limits may be waived by (i) discretion of the Town Manager upon request by the speaker not less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the Mayor either prior to or during a Meeting. CALL TO THE PUBLIC Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any such comment (i) must be within the jurisdiction of the Council and (ii) is subject to reasonable time, place, and manner restrictions. WHEREAS, the Mayor and Council of the Town of Fountain Hills (the “Town Council”) adopted written financial policies for the Town of Fountain Hills (the “Town”) on May 1, 2003 (the “Financial Policies”); and WHEREAS, the Town Council has identified the need for long-term accumulation of Town revenues to meet the significant future capital improvement needs of the Town; and WHEREAS, the Town Council wishes to (i) establish Capital Improvement Special Revenue Fund, (ii) adopt a policy regarding the use of the Capital Improvement Special Revenue fund and (iii) incorporate the policy into the Town’s Financial Policies. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS: SECTION 1. That the Capital Improvement Special Revenue Fund is established to allow the Town to accumulate monies for: 1. Purchase of land or buildings. 2. Improvements to Town-owned properties. 3. Grant matches associated with capital improvements. 4. Public safety projects and equipment purchases. 5. Economic development projects. 6. Such other capital projects as determined by the Town Council. SECTION 2. That the Capital Improvement Special Revenue Fund will be funded by: 1. Sales of real and personal property belonging to the Town. 2. General fund transfer of any excess revenues collected over budgeted and unexpended appropriations not needed to meet fund balance requirements or re- appropriation. 3. Interest earnings on the balance of the fund invested per the Town’s investment policy. 601117.1 2 SECTION 3. That the Town Council may approve the uses of the Capital Improvement Special Revenue Fund as a part of its annual budget or by motion and affirmative vote at a time the expenditures are awarded. SECTION 4. That the Town shall first be entitled to recoup the cost of any capital improvements, infrastructure, marketing or sales related cost associated with the disposition of property before crediting the Capital Improvement Special Revenue Fund. SECTION 5. That the Town Manager, the Town Clerk and the Town Attorney are hereby authorized and directed to take any and all steps necessary to implement the purpose and intent of this Resolution. SECTION 6. That the Town’s Financial Policies are hereby amended as follows: . . . Capital Project Funds The Capital Project Funds includes accumulated Development Fees that are assessed on new construction for the purpose of funding growth. These funds are restricted to growth-related capital expenditures. The Undesignated Unreserved, Designated Unreserved and Reserved Fund Balance will be established each fiscal year during the budget process depending on planned expenditures but cannot exceed accumulated revenues. The Development Fees must be expended within six years of collection or refunded to the taxpayer. A CAPITAL IMPROVEMENT SPECIAL REVENUE FUND HAS BEEN ESTABLISHED TO ALLOW THE TOWN TO ACCUMULATE MONIES FOR: (I) PURCHASE OF LAND OR BUILDINGS; (II) IMPROVEMENTS TO TOWN-OWNED PROPERTIES; (III) GRANT MATCHES ASSOCIATED WITH CAPITAL IMPROVEMENTS; (IV) PUBLIC SAFETY PROJECTS AND EQUIPMENT PURCHASES; (V) ECONOMIC DEVELOPMENT PROJECTS; AND (VI) SUCH OTHER CAPITAL PROJECTS AS DETERMINED BY THE TOWN COUNCIL. Staff Recommendation: Approve Fiscal Impact: Yes $25, 000 budgeted Purpose of Item and Background Information: Effective January 1, 1994, the Legislature changed the call and notice of election requirements to apply only to special district elections. Although cities and towns are no longer required by state law to adopt or publish either a call or notice of election, a call of election, in particular, remains a good way to inform the public about the election and to alert candidates to specific filing dates and deadlines. This resolution will establish March 14, 2006, as the Primary Election date where Fountain Hills' residents will be asked to nominate and or elect a mayor and three council members and will establish May 16, 2006, as the General Election date. This resolution will provide public notice of election dates and said purpose of elections, deadline for voter registration, and provide the location and deadline for candidates to file their nomination papers. Therefore, staff recommends approval of Resolution 2005-36. WHEREAS, it is provided by law for the holding of a (Primary/General) Election; and WHEREAS, the Mayor and Council has by resolution called a Primary Election to be held on March 14, 2006. NOW THEREFORE, BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows: SECTION 1. That March 14, 2006, is hereby set as the time for holding the Town of Fountain Hills Primary Election for the purpose of nominating candidates for the offices of Council Member and Mayor whose names shall appear on the ballot at the General Election, to be held on May 16, 2006. Early voting for the Primary Election will be held February 9, 2006 through March 30, 2006 during business hours of 8 a.m. to 5 p.m. Early voting for the General Election will be held April 13, 2006 through May 12, 2006 during business hours of 8 a.m. to 5 p.m. SECTION 4. That the Town of Fountain Hills will contract with Maricopa County Elections under the established intergovernmental agreement to provide such election services as required to conduct both the Primary and General Elections. Maricopa County (the “County”) registration and voting lists will be used for the Primary and General Elections. In order to qualify to vote at the Primary Election, individuals must be registered with the County by February 13, 2006. In order to qualify to vote at the General Election, individuals must be registered with the County by April 17, 2006. SECTION 5. That candidates seeking municipal office may obtain nomination papers and other materials that must be filed by the candidates with the Town Clerk beginning on Monday, October 3, 2005. Candidates must file all nomination papers and other nominating forms with the Office of the Town Clerk, located at Town Hall, 16705 E. Avenue of the Fountains, Fountain Hills, Arizona beginning November 4, 2005, and no later than 5:00 p.m. on Wednesday, December 14, 2005, in order for their names to appear on the Primary Election ballot.
