The primary purpose of work session meetings is to provide the Town Council with the opportunity for in-depth discussion and study of specific subjects. Public comment is not provided for on the Agenda and may be made only as approved by consensus of the Council. In appropriate circumstances, a brief presentation may be permitted by a member of the public or another interested party on an Agenda item if invited by the Mayor or the Town Manager to do so. AVENUE OF THE FOUNTAINS, FOUNTAIN HILLS, AZ PROCEDURE FOR ADDRESSING THE COUNCIL Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the Clerk’s position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Clerk or the Mayor. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Councilmembers. Speakers’ statements should not be repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her opportunity to speak on the matter. CONSIDERATION of ORDINANCE 06-12, extending and increasing the corporate limits of the Town of Fountain Hills pursuant to the provisions of Arizona Revised Statutes § 9- 471, annexing thereto certain State Trust Land located north and east of the existing Town limits, south of McDowell Mountain Regional Park and west of the Fort McDowell Yavapai Nation. Stancrest Drive Plat 111, Block 9, Lot 21 This item on the Town Council's agenda is a proposal to abandon portions of the twenty (20’) foot public utility and drainage easements located at the northerly property line of Plat 111, Block 9, Lot 21, (16274 E. Stancrest Drive) as shown in Exhibit “A”. The property owners desire the assurance that any future improvements made to the lot will not be infringed upon by the construction of utilities. All affected utility companies have been notified of this abandonment proposal and have approved the proposed abandonment of this public utility easement. The Engineering Department has reviewed the site to ascertain any drainage issues in addition to the Town's general interest in the easement. It is the professional opinion of the Engineering Department that there is no need for the Town to retain the drainage easement proposed to be abandoned, with the understanding that certain lots within this subdivision are subject to lot-to-lot drainage runoff. The property owners of Lot 21 are required to pass the developed flows generated by the upstream lots across their property. Staff recommends approval of Resolution 2006-26, subject to the following stipulation: • Grant a 10’ x 10’ public utility easement at the most southeasterly corner of the lot (along Stancrest Drive adjacent to Lot 21) for existing and future utility boxes. (98-28, Amended, 09/03/1998, New rates effective 1/1/99) ORDINANCE NO. 06-09 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, REPEALING ORDINANCE 98-28 AND AMENDING THE TOWN OF FOUNTAIN HILLS TOWN CODE, CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS, ARTICLE 7-8, COMMUNITY DEVELOPMENT AND ENGINEERING FEE SCHEDULE, RELATING TO FEE SCHEDULES FOR THE PLANNING DIVISION, THE BUILDING DIVISION AND THE ENGINEERING DIVISION. WHEREAS, the Mayor and Council of the Town of Fountain Hills (the “Town Council”) adopted Ordinance 98-28 establishing Community Development and Engineering Fees, on September 3, 1998 (the “Initial Ordinance”); and WHEREAS, the Town Council desires to repeal the Initial Ordinance and amend the Fountain Hills Town Code to update and approve a fee schedule for the Planning Division, the Building Division and the Engineering Division; and WHEREAS, a notice of intention to assess new development fees was given as required by ARIZ. REV. STAT. § 9-463.05(C); and WHEREAS, a public hearing concerning the adoption of the new development fees was held in accordance with ARIZ. REV. STAT. § 9-463.05(C) on April 20, 2006. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS as follows: SECTION 1. That Ordinance 98-28 is hereby repealed. SECTION 2. That the Fountain Hills Town Code, Chapter 7, Building and Building Regulations, Article 7-8, Community Development and Engineering Fee Schedule, is hereby deleted in its entirety and replaced with the following: ARTICLE 7-8 PLANNING, BUILDING AND ENGINEERING FEES The fees for services provided by the Planning Division, the Building Division and the Engineering Division shall be established by the Town Council as part of the annual budget process or as otherwise adopted by Town Council resolution. 632691.1 SECTION 3. That if any provision or any portion of any provision of this Ordinance is for any reason held to be unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such provision or portion thereof shall be deemed separate, distinct and independent of the remaining provisions of this Ordinance and shall be severed therefrom without affecting the validity of the remaining portions of this Ordinance. WHEREAS, a petition in writing, accompanied by a map of said real property, having been filed and presented to the Mayor and Council of the Town of Fountain Hills (the “Town Council”), signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property as would be subject to taxation by the Town of Fountain Hills (the “Town”) in the event of annexation within the territory and land hereinafter described on Exhibit A, attached hereto and incorporated herein by reference (the “Annexation Area”), as shown by the last assessment of said property, which said territory is contiguous to the Town, and not now embraced within its limits, asking that the property more particularly hereinafter described be annexed into the Town, and to extend and increase the corporate limits of the Town so as to embrace the same; and WHEREAS, the Town Council desires to comply with said petition and extend and increase the corporate limits of the Town to include the Annexation Area; and WHEREAS, said petition sets forth a true and correct legal description of all the exterior boundaries of the entire Annexation Area and had attached thereto at all times an accurate map of the Annexation Area; and WHEREAS, no alterations increasing or reducing the Annexation Area have been made after the said petition has been signed by any owner of real and personal property in such territory; and WHEREAS, pursuant to ARIZ. REV. STAT. § 9-471(L), the Town shall adopt a zoning classification for the Annexation Area that permits densities and uses no greater than that permitted by Maricopa County immediately before the annexation; and WHEREAS, the Annexation Area is currently zoned by Maricopa County as Rural 43, and the Town’s R1-43 zoning classification does not permit densities and uses greater than permitted by Maricopa County’s Rural 43 zoning classification; and WHEREAS, the provisions of ARIZ. REV. STAT. § 9-471, and amendments thereto, have been fully observed, including the required approvals by the (i) State Selection Board, a true and correct copy of which is attached hereto as Exhibit B and incorporated herein by reference and (ii) State Land Commissioner, a true and correct copy of which is attached hereto as Exhibit C and incorporated herein by reference; and 644028.2 WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on file in the office of the Town Clerk together with a true and correct copy of the original petition referred to herein, which is on file in the office of the Maricopa County Recorder. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS as follows: SECTION 1. That the Annexation Area, as more fully described and depicted on Exhibit A, attached hereto and incorporated herein by reference, is hereby annexed to the Town and that the present corporate limits are hereby extended and increased to include the Annexation Area. SECTION 2. That the land-use classification under the Town of Fountain Hills Zoning Ordinance for the Annexation Area is hereby designated as R1-43. SECTION 3. That the Town Clerk is hereby authorized and directed to file with the Maricopa County Recorder’s Office a fully executed copy of this Ordinance, together with an accurate map of the Annexation Area. SECTION 4. That if, at any time prior to the effective date of this Ordinance, any person (i) obtains from the Town Clerk of the Town of Fountain Hills (the “Town Clerk”) a referendum petition number and (ii) files in the office of the Town Clerk a petition for referendum of this Ordinance appearing to (a) be in proper form and (b) have the requisite number of signatures to cause a referendum, this Ordinance shall immediately become null and void and of no effect without further action of the Town Council. SECTION 5. If any provision of this Ordinance is for any reason held by any court of competent jurisdiction to be unenforceable, such provision or portion hereof shall be deemed separate, distinct and independent of all other provisions and such holding shall not affect the validity of the remaining portions of this Ordinance.
