PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the
Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in
the Council Chamber Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk
or the Mayor. At that time, speakers should stand and approach the podium. Speakers are
asked to state their name prior to commenting and to direct their comments to the Presiding
Officer and not to individual Councilmembers. Speakers’ statements should not be
repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to
have waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a
portion of their time for a later time or (ii) transfer any portion of their time to another
speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during
the Public Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time
limits may be waived by (i) discretion of the Town Manager upon request by the speaker not
less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the
Mayor either prior to or during a Meeting. Please be respectful when making your
comments. If you do not comply with these rules, you will be asked to leave.

Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed

subject to reasonable time, place, and manner restrictions. The Council will not discuss or take
legal action on matters raised during “Call to the Public” unless the matters are properly noticed for
discussion and legal action. At the conclusion of the call to the public, individual Councilmembers

Fountain Hills Great Fair.
4.) CONSIDERATION of approving a SPECIAL EVENT APPLICATION submitted by the
Town of Fountain Hills Parks and Recreation for the St. Patrick’s Day Celebration scheduled
for Saturday, March 17, 2007, from 9:00 a.m. to 7:00 p.m. The event will require the closure
of Saguaro Boulevard from Palisades Boulevard to Paul Nordin Parkway.
5.) CONSIDERATION of RESOLUTION 2007-02, abandoning whatever right, title, or interest
the Town has in the certain public utility and drainage easements located at the northerly
property line of Plat 401B, Block 6, Lot 32 (10232 N. Demaret Drive) as recorded in Book
155 of Maps, Page 12 Records of Maricopa County, Arizona, EA06-15 (Terry Diedrick).

Fountain Hills and the Fountain Hills Chamber of Commerce. The event involves street closures along with a
special event liquor license (approved 12/7/06), which require Council approval. Funding for this special event
was included in the Parks and Recreation Budget for the current fiscal year.

RE: St. Patrick’s Day Celebration 2007
In 2006, the Town of Fountain Hills and the Fountain Hills Chamber of Commerce partnered to coordinate
an expanded St. Patrick’s Day Celebration at Fountain Park. The result was an award-winning celebration
that approximately 6,000 residents and visitors attended.
The partnership came about for two main reasons: First, many residents and visitors do not have the
opportunity to see the fountain turn emerald green at the traditional noon hour and therefore miss out on a
truly unique experience, and secondly, the celebration had been relatively small in terms of activities and an
expanded event would be enjoyable for the residents of Fountain Hills, and for the visitors to Town as well.
Additionally, the 2005 Strategic Plan identified events such as the St. Patrick’s Day Celebration as one way
to help strengthen the community’s small town identity and bring people together.
The event was a success and was recognized by the Arizona Parks and Recreation Association with the 2006
Outstanding Program Award for Neighborhood/Community Special Event for communities with a
population under 25,000.
This year’s proposed celebration will begin at 10:00 a.m. and continue until 7:00 p.m. The world famous
fountain will turn emerald green twice in celebration of St. Patrick’s Day, once at the traditional high noon
and then again at 5:00 p.m. The Phoenix Scottish Pipe Band, The Knockabouts, Oceans Apart and Booya
are scheduled to entertain the crowd from the performance pad throughout the day. The Fountain Hills
V.F.W. Post 7507 is once again providing a beer garden (approved by Town Council on 12/7/06). Phil’s
Filling Station is set to provide the “real” Irish food; corned beef, cabbage and green potatoes, while other
vendors will provide hamburgers, hot dogs and more. Kids entertainment will include bouncers for all ages,
a climbing wall, a petting zoo, and Irish arts and crafts. The Fountain Hills “Leprechaun” plans to give away
Irish goodies to all the “wee folk” in attendance.
The Sheriff’s Office will be working closely with Parks and Recreation, the Chamber of Commerce,
Rural/Metro, and the local merchants to ensure that all aspects of traffic control, security, and public safety
are addressed.
Saguaro Boulevard, from south of Palisades Boulevard to north of Paul Nordin Parkway, will be closed from
9:00 a.m. to 7:00 p.m. to ensure pedestrian safety when crossing from the downtown area.
Along with the Town of Fountain Hills and the Fountain Hills Chamber of Commerce, several local
businesses have stepped forward to sponsor the celebration. The Town is appreciative of all the local
businesses for their ongoing support of this event. As always, additional sponsors are still being sought to
reduce the financial impact of the celebration on both the Town and the Chamber.
The special event application was submitted on December 21, 2006, and meets the conditions as outlined in
the Special Event Policy for Town-sponsored activities.
The Special Events Committee recommends approval.

This item on the Town Council's agenda is a proposal to abandon portions of the twenty (20’) foot public
utility and drainage easements located at the northerly property line of Plat 401B, Block 6, Lot 32, (10232
N. Demaret Drive) as shown in Exhibit “A”. The property owners desire the assurance that any future
improvements made to the lot will not be infringed upon by the construction of utilities.
All affected utility companies have been notified of this abandonment proposal and have approved
the proposed abandonment of this public utility easement.
The Engineering Department has reviewed the site to ascertain any drainage issues in addition to
the Town's general interest in the easement. It is the professional opinion of the Engineering
Department that there is no need for the Town to retain the drainage easement proposed to be
abandoned, with the understanding that certain lots within this subdivision are subject to lot-to-lot
drainage runoff. The property owners of Lot 32 are required to pass the developed flows generated
by the upstream lots across their property.

RESOLUTION 2007-02
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, ABANDONING WHATEVER
RIGHT, TITLE, OR INTEREST IT HAS IN PORTIONS OF THE CERTAIN
PUBLIC UTILITY AND DRAINAGE EASEMENTS AT THE NORTHERLY
PROPERTY LINE OF PLAT 401B, BLOCK 6, LOT 32, FOUNTAIN HILLS,
ARIZONA, AS RECORDED IN BOOK 155 OF MAPS, PAGE 12 RECORDS
OF MARICOPA COUNTY, ARIZONA.
WHEREAS, the Mayor and Council of the Town of Fountain Hills (the “Town
Council”), as the governing body of real property located in the Town of Fountain Hills (the
“Town”), may require the dedication of public streets, sewer, water, drainage, and other utility
easements or rights-of-way within any proposed subdivision; and
WHEREAS, the Town Council has the authority to accept or reject offers of dedication
of private property by easement, deed, subdivision, plat or other lawful means; and
WHEREAS, all present utility companies have received notification of the proposed
abandonment.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, as follows:
SECTION 1. That portions of the certain twenty (20’) foot public utility and drainage
easement, located at the northerly property line of Plat 401B, Block 6, Lot 32, Fountain Hills, as
recorded in Book 155 of Maps, Page 12 records of Maricopa County, and as more particularly
described in Exhibit A, attached hereto and incorporated herein by reference, are hereby declared
to be abandoned by the Town. Certain lots within this subdivision are subject to lot-to-lot drainage
runoff. The property owner is required to pass the developed flows generated by the upstream lots
across their property.
SECTION 2. That this Resolution is one of abandonment and disclaimer by the Town
solely for the purpose of removing any potential cloud on the title to said property and that the
Town in no way attempts to affect the rights of any private party to oppose the abandonment or
assert any right resulting there from or existing previous to any action by the Town.

Staff Recommendation: Approve Fiscal Impact: Yes $100,000
Purpose of Item and Background Information: The McKee Branch of the Boys and Girls Clubs of
Greater Scottsdale submitted a request to the Town Council in the amount of $100,000 to fund teen
development programs to the youth of Fountain Hills. With the adoption of the final budget the Boys &
Girls Clubs of Greater Scottsdale is requesting release of the appropriation for fiscal year 2006-07.

Hills Branch
During the FY2006-07 budget preparation a proposal for $100,000 was submitted to the Town
from the McKee Branch of the Boys & Girls Clubs of Greater Scottsdale for funding support for
their teen development programs for the youth of Fountain Hills. Since the budget has received
final approval they are now requesting release of the appropriation.
