PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the
Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in
the Council Chamber Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk
or the Mayor. At that time, speakers should stand and approach the podium. Speakers are
asked to state their name prior to commenting and to direct their comments to the Presiding
Officer and not to individual Councilmembers. Speakers’ statements should not be
repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have
waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion
of their time for a later time or (ii) transfer any portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during
the Public Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time
limits may be waived by (i) discretion of the Town Manager upon request by the speaker not
less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the
Mayor either prior to or during a Meeting. Please be respectful when making your
comments. If you do not comply with these rules, you will be asked to leave.

A.R.S. §38-431-03(A)(1), For discussion or consideration of employment, assignment,
appointment, promotion, demotion, dismissal, salaries, disciplining or resignation of a public
officer, appointee or employee of any public body, except that, with the exception of salary
discussion, an officer, appointee or employee may demand that the discussion or
consideration occur at a public meeting. The public body shall provide the officer, appointee
or employee with written notice of the executive session as is appropriate but not less than
twenty-four hours for the officer, appointee or employee to det4rmine whether the discussion
or consideration should occur at a public meeting. (Specifically, to review the youth
application and interview the youth applicant for the Parks and Recreation Commission.);
and, (ii) Pursuant to § 38-431.03(A)(3), For discussion or consultation for legal advice with

Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed
on the agenda. Any such comment (i) must be within the jurisdiction of the Council and (ii) is
subject to reasonable time, place, and manner restrictions. The Council will not discuss or take
legal action on matters raised during “Call to the Public” unless the matters are properly noticed for
discussion and legal action. At the conclusion of the call to the public, individual Councilmembers
may (i) respond to criticism, (ii) ask staff to review a matter or (iii) ask that the matter be placed on
a future Council agenda.

4.) CONSIDERATION of a TEMPORARY USE PERMIT for a farmers market to be located on
the east median of Avenue of the Fountains at Saguaro Boulevard. The farmers markets will

The Court has jurisdiction over civil traffic, criminal traffic and criminal misdemeanor offenses, and violations of our Town Code and ordinances. The Court has juvenile authority over specified juvenile offenses. In addition, the Municipal Court Judge has the authority to issue arrest/search warrants, orders of protection and injunctions against harassment. A “Teen Court” diversion program also convenes each month throughout the school year. As part of the Arizona State Court System, the Fountain Hills Municipal Court is subject to the authority and administrative supervision of the Arizona Supreme Court. The Fountain Hills Municipal Court has legal obligations and reporting responsibilities to the State, as well as to the Town of Fountain Hills.In addition to the Presiding Judge, the Fountain Hills Municipal Court has a Court Administrator and supporting court service specialists for providing the administrative, clerical, scheduling, record-keeping, and reporting functions of the Court. and operate on Thursdays from 12 noon to 6PM, through April 5, 2007, with the exception of February 22. This
event has been held on the median in the past, as well as other locations. This request is of the same nature as
previously granted permits. Zoning Ordinance 5.16.B.4 allows for Town Council to grant approval for recurring
activity up to 50 times per year. The request before you will total a maximum of 12 markets.

LOCATION: East median of Avenue of the Fountains at Saguaro Boulevard
REQUEST: For approval to hold a Farmers Market in the town median on Thursdays from 12 Noon –
6:00pm, January 11, 2007 through Apr 5, 2007.
DESCRIPTION:

SUMMARY:
This request is for approval of a temporary use permit to allow an outdoor farmers market to be located on
the east median of Avenue of the Fountains at Saguaro Boulevard. The market will occur on Thursdays
from 12 noon to 6:00 pm beginning January 11, 2007 operating weekly up until April 5, 2007 except for
February 22, 2007. The applicant operated a similar market from November 2004 through May 2005 on
Fridays in the median area of Avenue of the Fountains. The applicant is looking to operate the same type
of market this season.
EVALUATION:
Temporary Use permits for Outdoor Sales are regulated by the Zoning Ordinance in section
5.16.B.4 as follows:
A time limit shall be established for each use conducted under the temporary use permit.
Unless otherwise approved by Town Council, the time limit shall not exceed seven (7)
consecutive days, nor shall there be more than one (1) temporary use permit issued for the same
use during any calendar year. The Town Council may grant permission for the same use to be
held more than one (1) time during a calendar year. Outdoor retail sales and similar uses such as
farmers markets, may be permitted under a single temporary use permit subject to the following:
a. The recurring event shall not exceed a maximum of fifty (50) days during a calendar year.
b. The event permitted under the temporary use permit shall recur within thirty (30) days of the
prior event held under such permit; if the period of recurrence is greater than (30) days, a
separate temporary use permit shall be obtained for each occurrence.
c. The Town Council shall approve all temporary use permits for outdoor retail sales recurring
more than once (1) in a calendar year.
As the applicant is asking for more than 1 market, Town Council approval is required. The farmers
market meets the criteria provided in Zoning Ordinance section 5.16.B.4 as they will be held 7 days apart
and there will be a maximum of 12 markets.
The farmers market will adhere to the Town Council recommendation from October 21, 2004 meeting
stating that the market will sell: “farm produce, fresh produce, vegetables, flowers, home made breads,
pies, jams and nuts.” The additional items the applicant would like to have approved for this permit are
homemade soaps and lotions, and French imported fine linens. Attached you will see a current list of
vendors. Staff would like to acknowledge that this list might change to accommodate new vendors that
conform to the farmers market approved products. This list of vendors is being included to demonstrate
the type of vendors the applicant is soliciting.
RECOMMENDATION:
Staff recommends approval of the temporary use permits TU2006-14, “M&M Events, LLC Farmers
Market,” with the following stipulations:
1. The M&M Farmers Market shall only be open to the public between the hours of 1:00 pm to
6:00 on Thursdays.
2. Each vendor shall be required to hold a current Town of Fountain Hills business license. A
list of vendors shall be submitted to the Town prior to the first event and amended as the
vendors change.
3. All items and equipment associated with the event shall not arrive prior to 12:00 pm on the
day of the event and will be removed within 2 hours after the end of the event.
4. All necessary approvals and permits with the Maricopa County Health Department will be
obtained prior to operation if applicable.
5. All temporary event activities must be located within the areas designated on the approved
site plan titled “Site Plan.”
6. The applicant and all vendors shall be required to adhere to the Town of Fountain Hills Sign
Ordinance, which prohibits the use of any banners, signs emitting sound, flashing signs,
balloons, streamers etc. See Zoning Ordinance 6.07.I.
7. If the applicant wishes to amend the permit to allow vendors to sell items other than those on
the approved list, the applicant shall first be required to receive the approval of Town
Council.

advertised since October 2006. Only one application was received for the position. Ms. Tricia DePanicis is a
junior at Fountain Hills High School and an active member of the Mayor’s Youth Council. Staff recommends
appointing Ms. DePanicis to the Parks and Recreation Commission.

Purpose of Item and Background Information: Currently the Town uses Microsoft Office
Professional 2000 for the package of word processing, spreadsheet, database and email programs. The
upgrade to the 2007 version of Microsoft Office Professional Plus was included in the FY2006-07
Information Technology budget and will improve functionality of the Town's computers and staff. Some

Currently the Town of Fountain Hills computers use Microsoft Office Professional 2000 for the
package of word processing, spreadsheet, database and email programs. Microsoft upgraded the
program in 2003 but the improvements were not significant enough to incur the cost of
upgrading 75 computers. However, the new 2007 version of Professional Plus includes
improvements that will increase functionality of the Town’s computers and staff. Specifically,
the upgrades include:
1. improved email capabilities
2. complete electronic form creation and routing
3. creation of PDF files from within Office applications without the need for Adobe Acrobat
Three price quotes were obtained pursuant to the Town’s purchasing policy; the three quotes are:

Attached is Requisition #AD12647 for the purchase through the competitive bid process for 75
license upgrades at a total cost of $22,875 plus tax. Once approved the licenses will be ordered;
the upgrade will take approximately 61.5 hours and will be scheduled during the months of
February and March, 2007.

Regular Agenda Wording: Consideration of approving a PROFESSIONAL SERVICES AGREEMENT with
Green Studio, in the amount of $81,975 for design and construction documents, construction administration, GPS
mapping and staking, and computer programming for Fountain Park - Phase 5 (irrigation system).
Staff Recommendation: Approve Fiscal Impact: Yes $81,975
Purpose of Item and Background Information: Green Studio's principal, David Case, has been the main
landscape architect for Fountain Park, from the Master Plan stages to the design and construction documents for
all previous improvements to Fountain Park. Green Studio is using Coates Irrigation, a well respected and leader
in the irrigation field, for the irrigation design. Coates Irrigation has worked with the Town previously on
projects at Four Peaks Neighborhood Park, Desert Vista Neighborborhhod Park and previous improvements to
Fountain Park. Both Green Studio and Coates Irrigation's knowledge of Fountain Park will be beneficial to the
overall success of this project.
Funds for this project have been budgeted under Parks and Recreation General Fund for Fountain Park in this
year's budget. The design phase of the project will begin in February and conclude in early May when
construction will begin. The $761,000 project will be complete in late September before the park is over-seeded.
Staff is recommending approval of the Agreement.
