REGULAR SESSIONS OF
THE FOUNTAIN HILLS TOWN COUNCIL

PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the
Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in
the Council Chamber Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk
or the Mayor. At that time, speakers should stand and approach the podium. Speakers are
asked to state their name prior to commenting and to direct their comments to the Presiding
Officer and not to individual Councilmembers. Speakers’ statements should not be
repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have
waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion
of their time for a later time or (ii) transfer any portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during
the Public Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time
limits may be waived by (i) discretion of the Town Manager upon request by the speaker not
less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the
Mayor either prior to or during a Meeting. Please be respectful when making your
comments. If you do not comply with these rules, you will be asked to leave.

1.) ROLL CALL AND VOTE TO GO INTO EXECUTIVE SESSION: (i) Pursuant to §38-
431.03(A)(1), for discussion or consideration of employment, assignment, appointment,
promotion, demotion, dismissal, salaries, disciplining or resignation of a public officer,
appointee or employee of any public body, except that, with the exception of salary
discussions, an officer, appointee or employee with written notice of the executive session as
is appropriate but not less than twenty-four hours for the officer, appointee or employee to
determine whether the discussion or consideration should occur at a public meeting.
(Specifically,(a) for the purpose of interviewing applicants for their service on the Public
Safety Advisory Commission (PSAC), and (b) for the purpose of reviewing applications
submitted for possible service on the Planning and Zoning Commission for the purpose of
interviewing said applicants.)and (ii) Pursuant to §38-431.03(4) for the purpose of
discussion or consultation with the attorneys of the public body in order to consider its
position and instruct its attorneys regarding the public body’s position regarding contracts
that are the subject of negotiations, in pending or contemplated litigation or in settlement
discussions conducted in order to avoid or resolve litigation. (Specifically, Sklaw v. Town of
Fountain Hills and Save Our Small Town)

MAYOR’S REPORT –
(i) Introduction of Maricopa County Sheriff’s Office (MCSO) Lt. Brian Jakowinicz.
Assistant District Commander for Fountain Hills (District 7).
SCHEDULED PUBLIC APPEARANCES/PRESENTATIONS
(i) Presentation by Maricopa County Board of Supervisor Don Stapley and Erin
Dunsey, Media Specialist with Maricopa County Air Quality Department, regarding
air quality.
(ii) The Mayor will read a proclamation declaring August 2008 “Drowning Impact
Awareness Month”.
CALL TO THE PUBLIC
Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any such comment (i) must be within the jurisdiction of the Council and (ii) is subject to reasonable time, place, and manner restrictions. The Council will not discuss or take legal action on matters raised during “Call to the Public” unless the matters are properly noticed for discussion and legal action. At the conclusion of the call to the public, individual Councilmembers may (i) respond to criticism, (ii) ask staff to review a matter or (iii) ask that the matter be placed on a future Council agenda.

CONSENT AGENDA
1.) CONSIDERATION of approving the TOWN COUNCIL MEETING MINUTES from June 19 and 30, 2008; July 3 and 17, 2008.
2.) CONSIDERATION for approving RESOLUTION 2008-32, abandoning whatever right,
title, or interest the Town has in the certain public utility and drainage easements located at
the southerly property line of Plat 605D, Block 5, Lot 13 (15627 E. Mustang Drive) as
recorded in Book 164, Page 15, Records of Maricopa County, Arizona. EA08-06 (Gregory)
3.) CONSIDERATION of approving a LIQUOR LICENSE APPLICATION submitted by
David Link (Links Fine Wines Inc. dba GRAPEABLES Fine Wine), located at 12645 N.
Saguaro Boulevard, Suite #9, Fountain Hills, AZ. This is for a series 7 license – Beer and
Wine.
4.) CONSIDERATION of approving the ACQUISITION OF CONTROL-AND AGENT
CHANGE LIQUOR LICENSE APPLICATION to Andrea T. Noble, Two Step Enterprises,
L.L.C. for MLB Sports, L.L.C. dba Overtime Sports Grille, located at 16872 E. Avenue of
the Fountain, Suite 104-106, Fountain Hills.
5.) CONSIDERATION of approving the LIQUOR LICENSE APPLICATION submitted by
Carol Gregory (Gramato Enterprises, Inc., dba Mama Angelina’s) located at 16852 E.
Parkview Avenue, Fountain Hills. This is for a series 12 license - Restaurant.
6.) CONSIDERATION of a UTILITY DISTURBANCE PERMIT for “La Bella Vita at
Firerock”, at Parcel “B” of Firerock. Case #UDP2008-01.
REGULAR AGENDA
7.) CONSIDERATION of RESOLUTION 2008-31, an amendment to the Intergovernmental
Agreement (IGA) between the Town of Fountain Hills and Maricopa County Human
Services Department for special transportation services increasing the per trip rate from
$16.26 per trip to $38.25 per trip.
8.) CONSIDERATION of a CONTRACT with Salt River Project (SRP) to relocate a 69KV
Pole in the amount of $75,100 for the Shea Boulevard Climbing Lane Improvement Project.
9.) CONSIDERATION of Amendment No. 1 to the PROFESSIONAL SERVICES
AGREEMENT in the amount of $205,528.00 with HDR Engineering, Inc. for design of the
Shea Boulevard Widening Project during Fiscal Year 2008-2009.
10.) CONSIDERATION of approving a PURCHASE AGREEMENT through Zumar Industries in the amount of $36,450.00 plus applicable taxes, utilizing the City of Peoria Contract #ACON31006, for breakaway sign posts to be used for replacement and new install of traffic control signs.
11.) CONSIDERATION of renewing a PURCHASE AGREEMENT through Zumar Industries
in the amount of $77,775.00 utilizing Maricopa County Contract #03255-C, for new
replacement custom signs to include street name, regulatory and custom signs.
12.) UPDATE regarding the implementation of the Town Council’s 4th QUARTER GOALS by
the Acting Town Manager.

13.) COUNCIL DISCUSSION/DIRECTION to the Acting Town Manager.
Items listed below are related only to the propriety of (i) placing such items on a future
agenda for action or (ii) directing staff to conduct further research and report back to the
Council:
A. At the request of Councilmember McMahan, the topic of off-track betting has been
placed on this agenda for the purpose of placing this item on a future agenda for
discussion and possible action.

FR: Julie A. Ghetti, Finance Director RE: LTAF II Transportation Funds Update
The Town Council agenda for Thursday, August 7th includes the Intergovernmental Agreement (IGA)
with Maricopa County for Special Transportation Services at $38.25 per trip (estimated $150,000 for the
year). The agenda action form stated that LTAF II grant funding was uncertain, however, we now have
the information that specifies what that funding level is.
The Town was notified by Valley Metro that LTAF II (lottery) funding is available for cities and towns
for FY2008-09. Since LTAF II funds can only be used for transportation purposes the Town utilizes the
funds to subsidize the Special Transportation Services (STS) shuttle, providing trips for qualified
residents of Fountain Hills. The trips can be for medical appointments, social, educational, shopping or
other purpose. A qualified resident is anyone over 60 years of age, disabled or low income.
If approved, the Fountain Hills award for LTAF II funding for FY2008-09 will be $45,970.66. The
amount approved in the General Fund Operational Support budget was $90,000; the LTAF II funding
will be additional resources available for the program for a total of $135,971.
