AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, ADOPTING A NEW CHAPTER 11, ARTICLE 11-1, SECTION
11-1-6 OF THE TOWN CODES OF FOUNTAIN HILLS CONCERNING THE CURFEW FOR
MINORS.
BE IT ORDAINED by the Mayor and Common Council of the Town of Fountain
Hills, Arizona that Section 11-1-6 of the Code of the Town of Fountain Hills is
hereby repealed and a new section 11-1-6 is adopted in lieu thereof which shall
read as follows:
SECTION 11-1-6 MINORS
A. It is unlawful for a minor, twelve (12) years of age or under, to be
in, on, or upon a public street, sidewalk, alley, right-of-way or other public
place in the Town between the hours of 9:00 p.m. and 6:00 a.m. It is unlawful
for a minor, thirteen (13) years to fifteen (15) years of age, inclusive, to be
in, on, or upon a public street, sidewalk, alley, right-of-way or other public
® place in the Town between the hours of 11:30 p.m. and 6:00 a.m. It is unlawful
for a minor, sixteen (16) years to eighteen (18) years of age, inclusive, to be
in, on, or upon a public street, sidewalk, alley, right-of-way or other public
place in the Town between the hours of 12:30 a.m. and 5:30 a.m.
B. It is unlawful for a parent, guardian or other person having legal
care and custody of a minor to allow or permit the minor to be in, on, or upon
a public street, sidewalk, alley right-of-way or other public place in violation
of the provisions of this section, except as expressly provided herein.
C. The provisions of this section do not apply:
1. To legally emancipated minors, whether the emancipation be
through marriage, military service or other legally sufficient
grounds.
2. To minors who are accompanied by a parent, guardian, or other
person having legal care and custody of the minor.
3. To minors who would otherwise be in violation of the terms of
this section when:
a. Their presence is reasonably required in the pursuit of
a lawful trade, occupation, work, business, or
profession, in which the minor is then engaged; or
b. Their presence is necessitated by an emergency, medical
® or otherwise, involving themselves or another; or
C. Their presence is occasioned by their attendance at or

return from functions sponsored by or related to
® religious, school, civic or nonprofit organizations,
including, but not limited to services, classes,
meetings, dances, social events, dramatic or musical
performances and sporting events.
