® ORDINANCE NO.92-08
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN CODE
CHAPTER 15 SUBDIVISION REGULATIONS, ARTICLE H PROCEDURES
AND REQUIREMENTS, SECTION 202 PRELIMINARY PLAT REVIEW AND
SECTION 206 FINAL PLAT BY ESTABLISHING NEW FEES; AND
DECLARING AN EMERGENCY.
WHEREAS, on May 16, 1991 the Town Council adopted Resolution 1991-16 establishing
fees for certain construction related activities; and,
WHEREAS, a portion of that resolution set forth fees for both preliminary plat and final
plat checking and recording; and,
WHEREAS, said resolution conflicted with existing sections of Chapter 15 Subdivision
Regulations as found in the Town Code;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of
the Town of Fountain Hills, Arizona, as follows:
® SECTION 1. That Chapter 15 Subdivisions Article 2 Subdivision Procedures and
Requirements Section 202 is hereby amended by deleting in entirety the last paragraph of said
Section 202 and amending Section 202 to read as follows:
The following fee schedule shall apply to the filing of preliminary subdivision plats with
the Fountain Hills Community Development Department with no provision for refund:
Base Fee - $700.00 plus $5.00 per acre for 21 acres or more
MAXIMUM FEE: $1,100.00
SECTION 2. That Chapter 15 Subdivisions Article 2 Subdivision Procedures and
Requirements Section 206 is hereby amended by deleting paragraph 3 and replacing it with a new
paragraph 3 to read as follows:
The final plat shall conform to the approved preliminary plat and any stipulations attached
thereto by the commission or council. One (1) polyester or linen print and eight (8) paper copies
of the final plat shall be filed with the Community Development Department. Polyester or linen
copy shall bear the original signatures of the owner or owners and be duly acknowledged. The
final plat application form, shall be accompanied with a proper fee as set forth below:

® First Review - $30.00 per page to 20 pages plus $15.00 per page for 21 or more pages
Second Review - no charge
Third Review - no charge
Fourth Review - $15.00 per page to 20 pages plus $7.50 per page for 21 or more pages
The final plat shall also have a letter of application addressed to the Council and
requesting their approval to accompany the final plat. The letter shall indicate the name and
address of the subdivider and the party responsible for preparing the plat.
SECTION 3. Whereas this ordinance corrects a discrepancy between previous actions of
the Mayor and Council and whereas the matter is purely administrative in nature and not
legislative an emergency is declared to exist and the health benefit and public welfare of the
Town and its citizens is best served by the immediate adoption of this ordinance upon the
affirmative vote of three -fourths of the members of the Town Council and as such is exempt
from the provisions of referendum.

TOWN OF FOUNTAIN HILLS, ARIZONA, THIS 3RD DAY OF SEPTEMBER, 1992.
