AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING MAP
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA PURSUANT ARTICLE XXXI
OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, FOR
BLOCKS 3, 4, 5, AND 6 OF PLAT #208.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments Zoning Ordinance. The Zoning Map of the Zoning
Ordinance of the Town of Fountain Hills is hereby amended for Blocks 3, 4, 5
and 6, of Plat #208 to have the overlay zoning district described in Article XL of
the Zoning Ordinance of the Town of Fountain Hills, which commonly known as
the 'Planned Shopping Plaza Overlay District" with the following stipulations:
1. That within twelve months from the effective date of this ordinance, MCO
Properties, Inc. shall provide common area improvements for Blocks 4 and
6 of Plat 208. Common area improvements shall include grading, paving,
curbing, and landscaping. The landscaping shall be as stipulated in the
Planned Shopping Plaza Overlay District (Ordinance #92-09). The said
common area improvements in Block 3 of Plat 208, shall be completed
within twenty-four (24) months of the effective date of this ordinance. The
common area improvements in Block 5 of Plat 208 shall be completed
within thirty-six (36) months of the effective date of this ordinance.
2. A sidewalk on the southern side of Block 3 of Plat 208 shall be
constructed from Lot 2 to Lot 14 of Block 3 within thirty (30) days of the
effective date of this ordinance.
3. Within sixty (60) days of the effective date of this ordinance, MCO
Properties shall obtain a performance bond or other equivalent security
satisfactory to MCO Properties and the Town of Fountain Hills, naming
the Town of Fountain Hills beneficiary in an amount equal to or greater
than the Town Engineer's estimate of the cost of improvements referred
in stipulations #1 and #2 of this ordinance. Such performance bond or
equivalent security may be reduced from time to time as work is
completed, provided that the performance bond or equivalent security
remains in an amount at least equal to cover the Town Engineer's estimate
of the cost for the remaining improvements stipulated in this ordinance.
