AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING MAP
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AND THE TEXT OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, ARIZONA
PURSUANT ARTICLES XXVH AND XXXI OF THE ZONING ORDINANCE FOR
THE TOWN OF FOUNTAIN HILLS, IN THE AREA COMMONLY KNOWN AS
"MORNINGSIDE H", CASE #S92-01.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments Zoning Ordinance. Article XXVH, Section 27.3
permits Residential Unit Plans of Development. The text of the Zoning Ordinance
of the Town of Fountain Hills is hereby amended for the Momingside 11 (Case
#592-01) by keeping all the regulations for a R-4 Zoning District, except the
following:
® 1. Minimum lot area: 4,500 square feet.
2. Minimum lot width: 45 feet.
3. Minimum Setbacks:
A. Front Yard: Eleven (11) feet.
B. Side Yard: Five (5) feet; except a garage may be located one -
foot, six inches (1.5) feet from one side yard.
C. Street Side: Ten (10) feet.
D. Rear Yard: Ten (10) feet.
4. Maximum Lot Coverage: Fifty (50) Percent.
5. Permitted Uses:
A. One single -story, single-family residential unit per lot.
B. Parks and recreational areas.

® C. Utility services, but not including public utility treatment and
generating plants or offices.
6. Privacy fences are to be built on the lot lines or within a lot. Privacy
fences shall not enclose land on neighboring lots.
7. Minimum distance between buildings is 10 feet.
8. No fence or wall may be located closer than five (5) feet from the rear of
that portion of any garage that is located less than five (5) feet from a side
property line.
Section 2. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments to the Zoning Ordinance. Article XXVII, Section
27.3 permits Residential Unit Plans of Development. The Zoning Map of the
Zoning Ordinance of the Town of Fountain Hills is hereby amended for the
Momingside II (Case #S92-01) in the area with the following legal description:
All that certain parcel of land in the County of Maricopa, State of arizona,
being a portion of Sections 14 and 23, Township 3 North, Range 6 East
of the Gila and Salt River Base and Meridian, more particularly described
® as follows:
COMMENCING at the most Northwesterly corner of FOUNTAIN HILLS,
ARIZONA FINAL PLAT 302, recorded in Book 156, Page 45 of the
Official Records, of said County. Said point also being on the Northerly
right-of-way of Tioga Drive being 60.00 feet in width; thence South 50
degrees 47 minutes 00 seconds East and along said plat boundary and
right-of-way 22.18 feet to the POINT OF BEGINNING to a point on the
Easterly boundary of MORNINGSIDE AT LAKESIDE VILLAGE,
according to Book 318 of Maps, Page 44, records of Maricopa County,
Arizona; thence for the next 7 calls along the said Easterly boundary;
1. thence North 39 degrees 13 minutes 00 seconds, East 320.00 feet;
2. thence South 50 degrees 47 minutes 00 seconds, East 66.83 feet;
3. thence North 32 degrees 40 minutes 10 seconds, East 85.56 feet;
4. thence North 42 degrees 01 minutes 18 seconds, East 160.20 feet;
5. thence North 34 degrees 56 minutes 18 seconds, East 87.56 feet;
6. thence North 48 degrees 43 minutes 51 seconds, West 57.31 feet;
7. thence North 41 degrees 16 minutes 09 seconds, East 372.04 feet;
thence leaving said Easterly boundary South 60 degrees 50 minutes 00
seconds East, 166.07 feet to the beginning of the tangent curve being
® concave Southwesterly and having a radius of 650.00 feet;
thence along the arc of said curve through a central angle of 33 degrees,
® 40 minutes, 37 seconds an arc length of 382.05 feet to a point on the
Westerly boundary of the Fort McDowell Indian Reservation;
thence South 06 degrees, 36 minutes, 08 seconds West, and along said
reservation boundary 760.77 feet to a point, being on the Northerly
boundary of aforesaid Plat 302;
thence North 83 degrees 23 minutes 52 seconds West, and along departing
said reservation boundary and along said Northerly plat boundary, 515.02
feet to the beginning of a tangent curve being concave Northeasterly and
having a radius of 585.00 feet;
thence along the arc of said curve through a central angle of 32 degrees
36 minutes, 52 seconds an arc length of 333.00 feet;
thence North 50 degrees, 47 minutes, 00 seconds West, 212.82 feet to the
POINT OF BEGINNING.
