ORDINANCE 93-01
AN ORDINANCE OF THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA, AMENDING THE OFFICIAL ZONING MAP OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA AND THE
TEXT OF THE ZONING ORDINANCE FOR THE TOWN OF
FOUNTAIN HILLS, ARIZONA PURSUANT ARTICLES
XXVH AND XXXI OF THE ZONING ORDINANCE FOR
THE TOWN OF FOUNTAIN HILLS, ARIZONA, IN THE
AREA COMMONLY KNOWN AS "FONTANAS",
(MARICOPA COUNTY ZONING CASE #70-29), BY
REVISING THE MINIMUM SIDE YARD SETBACK
REQUIREMENTS TO PERMIT PORCH/PATIO COVERS
LOTS 120 THROUGH 148 OF PLAT 108 AS CLOSE AS
FIVE (5) FEET TO THE SIDE PROPERTY LINE.
® BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments to said zoning ordinance. Article XXVII, Section
27.3 permits Residential Unit Plans of Development. The text Residential Unit
Planned Development Case #70-29 of the Zoning Ordinance of the Town of
Fountain Hills is hereby amended by keeping all the regulations of Zoning Case
#70-29 except for the minimum side yard requirements for the four-plex section.
The minimum side yard setback for a patio cover (as defined in Section 4901 of
the 1991 edition of the Uniform Building Code Appendix) on a four-plex shall be
five (5) feet. The minimum side yard setback on all other structures shall be
fourteen (14) feet.
Section 2. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments to the Zoning Ordinance. Article XXV11, Section
27.3 permits Residential Unit Plans of Development. The Zoning Map of the
Zoning Ordinance of the Town of Fountain Hills is hereby amended to allow the
® amendments made in Section I of this ordinance to be applied to lots 120 through
148 of Plat 108.
