ORDINANCE 93-16
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING "THE ZONING ORDINANCE
FOR THE TOWN OF FOUNTAIN HILLS" AND AMENDING THE OFFICIAL
ZONING DISTRICT MAPS OF THE TOWN OF FOUNTAIN HILLS, ARIZONA
PURSUANT ARTICLE XXXI OF THE ZONING ORDINANCE FOR THE TOWN
OF FOUNTAIN HILLS TO CHANGE THE ZONING DISTRICT
CLASSIFICATION OF 96.9 ACRE AREA LOCATED EAST OF GOLDEN EAGLE
BOULEVARD, NORTH OF BAINBRIDGE AVENUE, WEST OF THE LOTS
FRONTING THE WESTERN SIDE OF GLENBROOK DRIVE, BLACKBIRD
DRIVE AND TEPEE DRIVE, AND SOUTH OF THE LOTS FRONTING THE
SOUTHERN SIDE OF JAMAICA LANE AND OVERLOOK COURT, IN THE
AREA TO BE KNOWN AS GOLDEN EAGLE ESTATES; FROM "R1-35
RESIDENTIAL UNIT PLANNED DEVELOPMENT #Z91-004" TO "R1-35
RESIDENTIAL UNIT PLANNED DEVELOPMENT #S93 -06/Z93-0711.
® BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments to the Zoning Ordinance. Article XXVII, Section
27.3 permits Residential Unit Plans of Development. Article III, Section 3.2 of
the Zoning Ordinance of the Town of Fountain Hills states that the Zoning
Districts map, along with all the notations, references, and other information
shown thereon, are a part of this Ordinance and have the same force and effect as
if said maps and all the notations, references and other information shown thereon
were all fully set forth or described in the zoning ordinance text. The text of the
Zoning Ordinance of the Town of Fountain Hills is hereby amended for Golden
Eagle Estates (Case #S93 -06/Z93-07) by keeping all the regulations for a R1-35
Zoning District, except the following:
A. Minimum Setbacks:
Front Yard: Reduced from forty (40) feet to twenty (20) feet.

B. Minimum Lot Width:
Lots 4, 5, 12, 13, 14, 23, 24, 31, 37 and 39 have a reduced lot width from
145 feet to that shown on the preliminary plat.
Section 2. Pursuant to Article XXXI, Section 31.1 and Article III, Section 3.2 of the Zoning
Ordinance of the Town of Fountain Hills; the Town of Fountain Hills, Arizona,
amends the Zoning Districts map of the Town of Fountain Hills for Golden Eagle
Estates (Case #S93 -06/Z93-07) by changing the zoning district designations in the
area with the following legal description:
A portion of Sections 4, 9 and 10, Township 3 North, Range 6 East of the Gila
and Salt River Base and Meridian, more particularly described as follows:
A. Lot 35, Block 2, Fountain Hills Arizona Final Plat No. 505-A, and Lots 16
and 17, Block 4, Fountain Hills Arizona Final Plat No. 505-A as recorded
in Book 158 of Maps, Page 40, records of Maricopa County, Arizona to
be known as Golden Eagle Estates: From 'RI -35 R.U.P.D. case #Z91-004"
to "R1-35 R.U.P.D. case #S93 -06/Z93-07"
B. Tracts "A", "B", "C", and "D" of the Final Plat of Golden Eagle Estates:
From the zoning district designation of "R-1-35 R.U.P.D. case #91-004"
to "Open Space Recreational".
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 19th day of August, 1993.
