AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING "THE ZONING ORDINANCE
FOR THE TOWN OF FOUNTAIN HILLS" AND AMENDING THE OFFICIAL
ZONING DISTRICT MAPS OF THE TOWN OF FOUNTAIN HILLS, ARIZONA
PURSUANT ARTICLE XXXI OF THE ZONING ORDINANCE FOR THE TOWN
OF FOUNTAIN HILLS TO CHANGE THE ZONING DISTRICT
CLASSIFICATION OF 68.6 ACRE AREA LOCATED NORTH OF SIERRA
MADRE DRIVE, EAST OF MONTEZUMA BOULEVARD, SOUTH OF GOLDEN
EAGLE BOULEVARD, AND WEST OF CERRO ALTO DRIVE, IN THE AREA
TO BE KNOWN AS FOUNTAIN HILLS ARIZONA FINAL PLAT NO. 512; FROM
"R1-10" TO "R1-10 RESIDENTIAL UNIT PLANNED DEVELOPMENT #Z93 -
06/S93 -05".
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain
Hills authorizes amendments to the Zoning Ordinance. Article XXVII, Section
27.3 permits Residential Unit Plans of Development. Article III, Section 3.2 of
the Zoning Ordinance of the Town of Fountain Hills states that the Zoning
Districts map, along with all the notations, references, and other information
shown thereon, are a part of this Ordinance and have the same force and effect as
if said snaps and all the notations, references and other information shown thereon
were all fully set forth or described in the zoning ordinance text. The text of the
Zoning Ordinance of the Town of Fountain Hills is hereby amended for Fountain
Hills Arizona Final Plat No. 512 (Case #Z93 -06/S93-05) by keeping all the
regulations for a R1-10 Zoning District, except the following:
A. Minimum Setbacks:
Rear Yard: Reduced from twenty-five (25) feet to ten (10) feet for Lots 2,
9, 10, 11, 17, and 48.
B. Minimum Lot Width:
Lot 12 to have a reduced lot width from eighty (80) feet to twenty-five
(25) feet and Lot 48 to have a reduced lot width from eighty (80) feet to
forty-five (45) feet. All other lots are to have the minimum required lot
width as required by the R1-10 zoning district.

Section 2. Pursuant to Article XXXI, Section 31.1 and Article III, Section 3.2 of the Zoning
Ordinance of the Town of Fountain Hills; the Town of Fountain Hills, Arizona,
amends the Zoning Districts map of the Town of Fountain Hills for Fountain Hills
Arizona Final Plat No. 512 (Case #Z93 -06/S93-05) by changing the zoning district
designations from "R1-10" to "R1-10 R.U.P.D, case #Z93 -06/S93-05" in the area
with the following legal description:
A portion of Sections 5 and 8, Township 3 North, Range 6 East of the Gila and
Salt River Base and Meridian, more particularly described as follows:
A. Beginning at a corner of said Fountain Hills Arizona Final Plat No. 507-A,
said corner being South 31°47'00" West a distance of 69.20 feet from the
intersection of the monument lines of Montezuma Boulevard and Sierra
Madre Drive, and from which the northeast corner of said Section 8 bears
North 88044'15" East 1,184.13 feet and the north quarter comer of said
Section 8 bears North 88048'49" West a distance of 1,456.62 feet; Thence
North 05°35'00" West along the westerly line of Montezuma Boulevard
and said Plat No. 507-A a distance of 530.00 feet to the most southerly
comer of said Fountain Hills Arizona Final Plat No. 507-B; Thence
departing said Plat No. 507-A and continuing along the westerly line of
Montezuma Boulevard and Plat No. 507-B, North 05°35'00" West a
distance of 175.00 feet to the beginning of a tangent curve concave
® westerly and having a radius of 208.00 feet; Thence northerly along the arc
of said curve through a central angle of 76000'00" an arc length of 275.90
feet; Thence North 81°35'00" West a distance of 175.00 feet to the
beginning of a tangent curve concave northeasterly and having a radius of
442.00 feet; Thence along the arc of said curve through a central angle of
38°30'00" an arc length of 297.00 feet Thence North 4305'00" West a
distance of 185.00 feet to the beginning of a tangent curve concave
easterly and having a radius of 442.00 feet; Thence along the arc of said
curve through a central angle of 30°00'00" an arc length of 231.43 feet

of a tangent curve concave westerly and having a radius of 20.0 feet
Thence along the are of said curve through a central angle of 84°37'34"

and a point of cusp and the beginning of a non -tangent curve concave
northerly and having a radius of 642.00 feet, a radial line passing through
said point bears South 07°42'34" East Thence easterly along the arc of
said curve and said southerly line, through a central angle of 14°17'26" an
arc length of 160.13 feet; Thence North 68°00'00" East a distance of
350.00 feet to the northwest corner of Lot 5, Block 1 of said Plat No. 507-
B; Thence departing Golden Eagle Boulevard South 22°00'00" East along
the westerly line of said Lot 5, a distance of 110.00 feet to the

beginning of a non -tangent curve concave southerly having a radius of

East, said point being also a comer of Fountain Hills Arizona Final Plat
No. 510; Thence departing Cerro Alto Drive northwesterly along the
easterly line of Alvarado Drive and said Plat 510 and along the arc of said
curve through a central angle of 90°00'00" an arc length of 31.42 feet to
a point of compound curve, said curve being concave easterly and having

zoning district designation of "R1-10" to "Open Space Recreational".
