HomeMy WebLinkAboutOrd 1993-18ORDINANCE 93-18 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING "THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS" AND AMENDING THE OFFICIAL ZONING DISTRICT MAPS OF THE TOWN OF FOUNTAIN HILLS, ARIZONA PURSUANT ARTICLE XXXI OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS TO CHANGE THE ZONING DISTRICT CLASSIFICATION OF 68.6 ACRE AREA LOCATED NORTH OF SIERRA MADRE DRIVE, EAST OF MONTEZUMA BOULEVARD, SOUTH OF GOLDEN EAGLE BOULEVARD, AND WEST OF CERRO ALTO DRIVE, IN THE AREA TO BE KNOWN AS FOUNTAIN HILLS ARIZONA FINAL PLAT NO. 512; FROM "R1-10" TO "R1-10 RESIDENTIAL UNIT PLANNED DEVELOPMENT #Z93 - 06/S93 -05". BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain Hills authorizes amendments to the Zoning Ordinance. Article XXVII, Section 27.3 permits Residential Unit Plans of Development. Article III, Section 3.2 of the Zoning Ordinance of the Town of Fountain Hills states that the Zoning Districts map, along with all the notations, references, and other information shown thereon, are a part of this Ordinance and have the same force and effect as if said snaps and all the notations, references and other information shown thereon were all fully set forth or described in the zoning ordinance text. The text of the Zoning Ordinance of the Town of Fountain Hills is hereby amended for Fountain Hills Arizona Final Plat No. 512 (Case #Z93 -06/S93-05) by keeping all the regulations for a R1-10 Zoning District, except the following: A. Minimum Setbacks: Rear Yard: Reduced from twenty-five (25) feet to ten (10) feet for Lots 2, 9, 10, 11, 17, and 48. B. Minimum Lot Width: Lot 12 to have a reduced lot width from eighty (80) feet to twenty-five (25) feet and Lot 48 to have a reduced lot width from eighty (80) feet to forty-five (45) feet. Pursuant to Article XXXI, Section 31.1 and Article III, Section 3.2 of the Zoning Ordinance of the Town of Fountain Hills; the Town of Fountain Hills, Arizona, amends the Zoning Districts map of the Town of Fountain Hills for Fountain Hills Arizona Final Plat No. 512 (Case #Z93 -06/S93-05) by changing the zoning district designations from "R1-10" to "R1-10 R.U.P.D, case #Z93 -06/S93-05" in the area with the following legal description: A portion of Sections 5 and 8, Township 3 North, Range 6 East of the Gila and Salt River Base and Meridian, more particularly described as follows: A. Beginning at a corner of said Fountain Hills Arizona Final Plat No. 507-A, said corner being South 31°47'00" West a distance of 69.20 feet from the intersection of the monument lines of Montezuma Boulevard and Sierra Madre Drive, and from which the northeast corner of said Section 8 bears North 88044'15" East 1,184.13 feet and the north quarter comer of said Section 8 bears North 88048'49" West a distance of 1,456.62 feet; Thence North 05°35'00" West along the westerly line of Montezuma Boulevard and said Plat No. 507-A a distance of 530.00 feet to the most southerly comer of said Fountain Hills Arizona Final Plat No. 507-B;
