AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HELLS, ARIZONA, AMENDING THE TEXT OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS,
ARIZONA AND PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HELLS, BY
AMENDING CHAPTER 1, INTRODUCTION, SECTION 1.06.PLANNING
AND ZONING COMMISSION, SUBSECTION D. QUORUM, VOTING., BY
ELIMINATING THE NECESSITY OF A MUMMUM OF FOUR (4)
AFFIRMATIVE VOTES OF THE PLANNING AND ZONING
COMMISSION AND REPLACING THIS REQUIREMENT TO STATE
THAT AN AFFIRMATIVE VOTE OF A MAJORITY OF A QUORUM OF
THE PLANNING AND COMMISSION IS NECESSARY FOR THE
PLANNING AND ZONING COMMISSION TO TAKE ACTION.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
® WHEREAS The Town of Fountain Hills desires to amend the minimum voting requirements
of its Planning and Zoning Commission to require the affirmative vote of a
majority of the quorum voting on an item, rather than a minimum of four (4)
votes, in order for action by the Planning and Zoning Commission to take place;
and
WHEREAS Public hearings advertised in the February 22, 1994, March 2, 1994, and March
9, 1994 editions of The Times of Fountain Hills and Rio Verde, pursuant to
Arizona Revised Statutes §9-462.04, for public hearings conducted by the Fountain
Hills Planning and Zoning Commission on March 10, 1994 and the Mayor and
Common Council on March 17, 1994.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Chapter 1, Introduction, Section 1.06. Subsection D. of the Zoning
Ordinance for the Town of Fountain Hills shall be amended as follows:

D. Quorum; Voting. Four (4) members shall constitute a quorum. The affirmative

be required for - passage of any matter before 'the 'Commission. A member may
abstain from voting only upon a declaration that he has a conflict of interest, in
which case such member shall take no part in the deliberation on the matter in
question.
