HomeMy WebLinkAboutOrd 1994-07ORDINANCE #94-07 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TEXT OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, ARIZONA AND PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, BY AMENDING CHAPTER 7, PARKING AND LOADING STANDARDS, Section 7.04. SUBSECTION F.3., TO ESTABLISH MINIMUM PARKING STANDARDS FOR NURSING HOMES, CONVALESCENT HOMES, AND HOMES FOR THE AGED. WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993, which adopted the Zoning Ordinance for the Town of Fountain Hills; and WHEREAS The Town of Fountain Hills desires to amend the text of Chapter 7, Panting and ® Loading Standards Section 7.04.17.3. to establish minimum off-street parking standards for nursing homes, convalescent homes, and homes for the aged; and WHEREAS Public hearings were advertised in the March 9, 1994, March 16, 1994, March 23, 1994 and April 6, 1994 editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and WHEREAS Public Hearings were held by the Fountain Hills Planning and Zoning Commission on March 24, 1994 and the Mayor and Common Council on April 7, 1994. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Chapter 7, Parking and Loading Standards of the Zoning Ordinance for the Town of Fountain Hills shall be amended to establish the minimum off- street parking standards for nursing homes, convalescent homes, and homes for the aged, with the shaded areas showing additions to the existing text and strikeout areas showing deletions to the existing text, as follows: u 0 L E CHAPTER 7 PARKING AND LOADING STANDARDS 7.04 Schedule of Required Off -Street Spaces. Farrell, Town Attorney ® ORDINANCE NO. 94-08 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AMENDING THE TOWN CODE CHAPTER 6, ANIMALS, ARTICLE 6-2 RABIES\ANIMAL CONTROL LEASH LAW BY AMENDING SECTIONS 6-2-1 DEFINITIONS, 6-2-4 POWERS, 6-2-5 LICENSE FEES, 6-2-10 IMPOUNDING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS: Section 1. That Section 6-2-1 Definitions of the Town Code is hereby amended to read as follows: Section 6-2-1 Definitions In this article unless the context other wise requires: n LJ P. "Vicious animal" means any animal of the order carnivora that has a propensity to attack, to cause injury to or to otherwise endanger the safety of human beings without provocation or that has been so declared after a hearing before a Justice of the Peace or a City or Town Magistrate. Section 2. That Section 6-2-4 Powers and Duties of the Enforcement Agent is hereby amended to read as follows: Section 6-2-4 Powers and Duties of the Enforcement Agent A. 3. That in addition to all powers granted to the State and the County the local enforcement agent may declare a rabies quarantine area within the Town's jurisdiction. When a quarantine area has been declared, the enforcement agent shall meet with the state veterinarian and representatives from the Arizona Department of Health Services and the game and fish department to implement an emergency program for the control of rabies within that area. Any regulations restricting or involving the movements of livestock within that area shall be subject to approval by the state veterinarian. I ® Section 3. That Section 6-2-5 License Fees for Dogs; Issuance of Dog Tag; Records; Penalties; Classification is hereby amended to read as follows: Section 6-2-5 License Fees for Dogs; Issuance of Dog Tags; Records: Penalties; Classification A. The Town Council shall set an annual license fee which shall be paid for each dog four months of age or over that is kept, harbored or maintained within the boundaries of the Town for at least thirty consecutive days of each calendar year. License fees shall become payable at the discretion of the town Council. The licensing period shall not exceed the period of time for revaccination as designated by the state veterinarian. License fees shall be paid within ninety days. A penalty not to exceed two dollars shall be added to the license fee in the event that application is made subsequent to the date on which the dog is required to b licensed under the provisions of this article. This penalty shall not be assessed against applicants who furnish adequate proof that the dog is to be licensed has been in their possession in the Town less than thirty consecutive days. Section 4. That Section 6-2-10 Impounding and Disposing of Dogs and Cats; reclaiming Impounded Dogs and Cats; Pound Fees is amended to read as follows: ® Section 6-2-10 Impounding and Disposing of Dogs and Cats; Reclaiming Impounded Dogs and Cats; Pound Fees A. That the Town has entered into an Intergovernmental Agreement with The Maricopa County Board of Supervisors to provide for impounding and disposing of dogs and cats at County Pounds. B. That all fees, charges, rules and regulations and procedures shall be as are authorized by Law and implemented by the rules and regulations of Maricopa County. Section 5. WHEREAS, it is the intention of the Town that the enforcement of this ordinance shall become effective immediately; it is necessary in orderto protect the public health, safety and welfare that an emergency be declared and this ordinance shall become operative immediately upon the affirmative vote of six of the seven member of the Town Council.
