AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TEXT OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS,
ARIZONA AND PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AND BY
AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF THE TOWN
OF FOUNTAIN HILLS BY DESIGNATING LOTS 1-65, PLAT 513, FROM
"R1-35" AND "R1-10" TO "R1-10 PUD", SINGLE-FAMILY
RESIDENTIAL, AND BY AMENDING THE OFFICIAL ZONING
DISTRICTS MAP OF THE TOWN OF FOUNTAIN HILLS BY
DESIGNATING TRACTS "A", "B", "C", "D" AND "E", PLAT 513, FROM
"R1-35" AND "R1-10" TO "OSR", OPEN SPACE RECREATIONAL.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
® which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning district
boundaries; and
WHEREAS, Chapter 3 ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF, Section 3.02 Boundaries Lines on the Zoning
Districts Maps. establishes the "Official Zoning Districts Map"; and
WHEREAS, Public hearings were advertised in the October 19, 1994, October 26, 1994 and
the November 2, 1994 editions of The Times of Fountain Hills and Rio Verde,
pursuant to Arizona Revised Statutes §9-462.04, and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on May 12, 1994 and the Mayor and Common Council on November 3, 1994; and
WHEREAS, The Future Land Use Plan in the "Fountain Hills General Plan" designates Lots
1-65, Plat 513, as a Single-Family/Low area; and

® WHEREAS, The predominant character of the Plat 513 neighborhood where Lots 1 through 65,
Plat 513, is located, will be single-family residential on lots in the 10,000 square
feet or greater range.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The "Official Zoning Districts Map' shall be amended to change the Zoning
District designation of Lots 1 through 65, Plat 513, from "R1-10" and "R1-35" to
"R1-10 PUD".
Section 2. The text of the Zoning Ordinance of the Town of Fountain Hills shall be amended
to include the Planned Unit Development for Final Plat 513 Plat to reduce the
rear -yard setback from twenty-five (25) feet to ten (10) feet along only those rear
property lines of Lots one (1) through sixty-five (65) which abut Tracts "A", "B",
"C", "D", and "E" within Plat 513. Furthermore, this Planned Unit Development
reduces the lot width requirement for only Lots 7, 33 and 46 from eighty (80) feet
to twenty-five (25) to allow for a flag lot configuration for these three lots.
Section 3. The "Official Zoning Districts Map" shall be amended to change the zoning
district designation of Parcels "A", "B", "C", "D" and "E" from "R1-10" and "Rl-
35" to Open Space Recreational "OSR".
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 3rd day of November, 1994.
