HomeMy WebLinkAboutOrd 1994-45® ORDINANCE #94-45 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE CHAPTER 2, SECTION 2.05, PLANNED UNIT DEVELOPMENTS OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS BY ESTABLISHING CRITERIA FOR PLANNED UNIT DEVELOPMENTS, PURSUANT TO CHAPTER 2; SECTION 2.01 OF ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS. WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993, which adopted the Zoning Ordinance for the Town of Fountain Hills; and WHEREAS Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, provides for a procedure to amend said ordinance, and WHEREAS The Town of Fountain Hills desires to establish criteria that a land owner, or his/her agent must meet in order to apply for a planned unit development zoning designation; and ® WHEREAS The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills has been followed; and WHEREAS The Town of Fountain Hills has rewritten the text of Chapter 2, Section 2.05 of the Zoning Ordinance of the Town of Fountain Hills and published these proposed text changes in the official newspaper of general circulation, The Times of Fountain Hills and Rio Verde on September 7, 1994, September 14, 1994, September 21, 1994, October 19, 1994, October 26, 1994, and November 2, 1994, and WHEREAS The Planning and Zoning Commission public hearings were advertised in the September 7, 1994, September 14, 1994, and September 21, 1994 editions of The Times of Fountain Hills and Rio Verde, and the Town Council public hearings were advertised in the October 19, 1994, October 26, 1994 and November 2, 1994 editions of The Tithes of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and WHEREAS Public hearings were held by the Fountain Hills Planning and Zoning Commission on September 22, 1994 and by the Fountain Hills Town Council on November 3, 1994. 11-3-9y .. C,1 o_FjL ® NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Revisions to Chapter 2 Section 2.05 of the Zoning Ordinance for the Town of Fountain Hills is amended as follows, with the strikeout areas showing deletions and the shaded areas showing new language: 2.05 Planned Unit Developments.
