MINUTES OF THE SPECIAL SESSION OF THE FOUNTAIN HILLS TOWN COUNCIL
FEBRUARY 20, 1990
A public meeting of the Fountain Hills Town Council was convened and called to
order by Mayor John Cutillo at 6:03 p.m., Tuesday, February 20, 1990, in the
Fountain Hills School District Administration Building located at 14605 N. Del
Cambre Ave., Fountain Hills, Arizona.
ROLL CALL - Present for roll call were the following members of the Fountain
Hills Town Council: Mayor John Cutillo and Councilmembers Harry Barber, Marti
Lemieux, Joe Bill and Charlie Fox. Absent for roll call were Vice Mayor Mike
Minarsich and Councilman Dick Haugen. (Vice Mayor Minarsich entered the
chambers at approximately 6:17 p.m.). Also present were Town Manager Mike
McNulty and Town Clerk Cassie Hansen.
AGENDA ITEM #2 - APPROVAL OF MINUTES
MOTION made by Councilman Fox to accept the meeting minutes of February 15,
1990. SECONDED_by Councilwoman Lemieux and CARRIED unanimously.
AGENDA ITEM #3 - APPROVAL OF SPECIAL USE PERMIT FOR THE BIRD CAGE RESTAURANT
Resident Bill Bird, the owner of the Bird Cage Restaurant, explained to the
Council what he wished to do at his establishment during the Great Fair on
Saturday and Sunday, February 24 and 25, 1990. He said that on the adjacent lot
,. next to the Bird Cage he proposed to put a barricade up with only one entrance
so all alcoholic beverages would be confined to the barricaded area. He
further stated that only beer would be sold and that a guard would be on duty
to make sure there would be no beer leaving the designated area. Councilman Fox
asked if tables and chairs would be available and Mr. Bird replied that there
would be and that they were going to make some sort of a beer garden
arrangement. Mayor Cutillo asked if Mr. Bird had already gone through the
Committee of Architecture to get his sign permits and Mr. Bird affirmed that he
had. The Mayor said he had received a verbal yes on the sign permits.
Councilwoman Lemieux asked how something like this was handled before we were a
town. The Mayor .replied that he thought they had to go through the county.
According to Mr. Bird, the State Liquor Department will approve but also
requires approval from the Sheriff's Department. The Mayor stated that getting
approval from the county, and the Sheriff's Department is county, then you're
getting both at the same time. Councilman Bill asked if there had ever been any
negative reactions from the community when establishments had done this before,
like the Pub. No one had ever heard of any negative comments. Councilwoman
Lemieux asked what requirements there are in getting a special use permit. Mr.
Bird said that according to the State Liquor Board, you are only allowed to
have one a year, that's an extension permit. The special use permit is for
charity only and the requirements are very simple - You (the council) have to
approve, the Sheriff's Department has to approve and then one will be issued.
MOTION made by Councilman Fox that the special use permit for the days of
February 24 and 25 for the Bird Cage Restaurant be approved by the Town Council.
SECONDED by Councilman Barber and CARRIED unanimously. The Mayor supplied Mr.
Bird with a letter to the State Liquor Department stating the council's approval
of Mr. Bird's request (attached).

AGENDA ITEM #4 - AUTHORIZING THE TOWN MANAGER TO EXPEND FUNDS FOR OFFICE
FURNITURE AND EQUIPMENT
The town manager supplied the council with a sheet (attached) of estimated costs
for furniture and equipment based on his conversations he had had with some
furniture houses on what these items could cost. He said 10 of the chairs
listed would be for the large conference table the town was receiving, 4 for the
town manager's office, 4 for the clerk's office and 4 for the waiting area.
Councilman Barber asked if fax machines could not be purchased for less than
$800.00 and Mr. McNulty replied that to get a fax machine to fill our needs
would be at least $800.00 to $1,000.00. Mr. McNulty said he did not address
side tables for the waiting area because there might be some in the other MCO
building which we have access to. He also said that his amounts were the high
end and he was hoping to come in less than the amounts stated, using the left
over funds for occasional tables, etc. He said that several of the furniture
houses have used furniture warehouses that he was going to look at and see if
there was anything presentable for the town hall.
Councilman Bill asked where that large table would be used and if it was
possibly too big for what our purposes were. Mr. McNulty said it would be
placed in the open area and could be divided off by the room dividers he was
getting from McDonald Douglas. The Mayor asked if the price for the dividers
was included in his estimate to which Mr. McNulty replied that it was not
because he was hoping to save enough on the furniture to compensate for the
dividers. Councilman Bill asked if the $1,100 for the dividers should be added
to the list and Mr. McNulty said it would probably be a good idea to give him
some breathing room. Councilman Fox brought up smaller equipment like adding
machines, pens, pencils, etc. Mr. McNulty said he didn't address the small
things because you can pick them up for not very much. Councilman Fox said he
was more concerned about things like typewriters. Mr. McNulty said he was
getting to that because there had been some discussion as to whether we should
go with PC work stations or smart typewriters. He said a PC, 10 mgh speed on
the clock could be had for about $1,500 where a smart typewriter could be had
for $500 to $700. Councilman Bill felt that a computer with word processing
software was the way everyone was going and we should as well. Councilman Fox
expressed concern over getting a computer with sufficient memory to handle all
of the records the town would need to be keeping. It was decided to gather more
information on the computer question and deal with the list at hand. Mr.
McNulty said everything had to be coordinated in regards to delivery dates,
installation dates, etc. He wants it to flow into one day so people aren't
sitting at desks with no phones to talk on. He said he could be ready to come
back to the council on March 1st with the necessary information on computers so
the council could vote then. Mr. McNulty said that once the council approved
spending limits on the listed items, he would need no other authority to go out
and purchase the items. He said there are no statutues on the books as to how a
town procures it's items. Councilman Fox asked what kind of bells and whistles
they would be getting for the money. Mr. McNulty said his copier price is based
on a Minolta copier which does 20-30 copies/minute, has a 10 bin collator, will
duplex (2 sided copying) and will do enlarging. He said his estimate list is
just what it will take to open the doors. When asked how soon we could get into
the office, Mr. McNulty replied that it was really hinging on the phone system,
that the lines could be hooked up on two days notice. He said the system could

be installed on one day's notice and that the one man he talked to said the
equipment was all in stock. Councilman Bill asked for a description of the
phone system and Mr. McNulty said it will initially take 5 lines and be
expandable, that we would start with 4 to 5 phones with expansion capabilities
up to more phone that we could ever use. Councilman Bill thought 4 chairs per
office was a bit much but that the chairs could easily be used in other parts of
the office. He said it was necessary to spend enough money on the executive
chairs and that it was important to get comfortable chairs for people who spend
alot of time in them. Councilman Fox asked for a time table to get into the
office and that it could be used for subcommittee meetings now. He offered to
be in charge of getting the conference table moved over to the office. The
Mayor asked who got the executive chairs and the town manager replied that they
went to the town manager and the town clerk. The Mayor asked Councilman Fox if
the estimates provided by the town manager were close to what he had allowed in
the interim budget for furniture and equipment. Mr. McNulty replied that
$21,000 had been figured in the interim budget and his figures were around
$19,100. He also said that some of the money in the town clerks budget could
cover some of the furniture going to that office. He also said the contingency
fund could be used for the computer work stations. Vice Mayor Minarsich asked
if the price on the copier included a service contract. Mr. McNulty said you
figure a servicq contract on a penney a copy made, if you run about 5,000 copies
a month your service contract would run about $50.00 a month. MOTION made by
Councilman Fox to give the town manager authorization up to these amounts which
are $5,110 on the furniture, $1,100 on the panels and the specified amounts per
the phone system, fax and copy machine. SECONDED by Councilman Bill and CARRIED
unanimously.

AGENDA ITEM 16 - ADJOURNMENT
MOTION made by Councilman Bill to adjourn. SECONDED by Councilwoman Lemieux and
CARRIED unanimously. The council adjourned at approximately 6:30 p.m.
