MINUTES OF THE SPECIAL SESSION OF THE FOUNTAIN HILLS TOWN COUNCIL
JUNE 30, 1992
A public meeting of the Fountain Hills Town Council was convened and called to order by Mayor John Cutillo at
6:30 p.m.,Tuesday,June 30, 1992,in the Fountain Hills Town Hall, located at 16836 E. Palisades Blvd.,Building
C,Fountain Hills, Arizona.
ROLL CALL-Following the pledge to the flag and the invocation by Councilwoman Tibbetts,roll call was taken.
Present for roll call were the following members of the Fountain Hills Town Council: Mayor John Cutillo, Vice
Mayor Charlie Fox and Councilmembers Frank Clark,Peg Tibbetts,Mike Minarsich,and Bill O'Brien. Councilman
Wally Hudson was absent. Also present were Town Manager Paul Nordin, Town Attorney Bill Farrell, Town
Accountant Julie Ghetti, and Town Clerk Cassie Hansen.
AGENDA ITEM #2 - CONSIDERATION OF THE LEASE MANAGEMENT AGREEMENT WITH THE
CIVIC ASSOCIATION FOR MANAGEMENT AND LEASING SERVICES OF THE COMMUNITY
CENTER.
Mr.Nordin stated that staff had deleted the additional$2,000 from the Capitol Improvement account on the proposed
construction. He said that the budgeted amount would be$43,000 rather than the original$45,000. Councilwoman
Tibbetts made a MOTION to approve the lease agreement with the Community Center. SECONDED by
Councilman Minarsich. Councilman O'Brien thanked the members of the Property Committee for letting him express
his opinions at their meeting the day before. Ms. Myers, President of the Civic Association, stated that the
management fee was a fair amount. She said the job had been done for two years on a voluntary basis. Ms.Myers
stated that the volunteers in the community contributed so much and added to the quality of life. She said that all
the local help that the Civic Association members had given the community members could not be put in a computer.
Ms. Myers stated that the Civic Association hoped that it would all be considered. The motion CARRIED
unanimously.
AGENDA ITEM #3 - DISCUSSION OF PLACING AN ORDINANCE REGARDING THE DIRECT
ELECTION OF MAYOR ON THURSDAY NIGHT'S AGENDA FOR POSSIBLE ACTION. THE
ORDINANCE WOULD PLACE THE QUESTION OF DIRECTLY ELECTING THE MAYOR BEFORE
THE VOTERS ON THE NOVEMBER 5TH GENERAL ELECTION BALLOT.
Mayor Cutillo said the Council had received a memo from him that explained why he brought the issue back to
them. He said he had a petition from the citizens with over six hundred signatures collected in less than one and
one-half weeks. Mayor Cutillo stated that if the Council passed an Ordinance,it would save staff time and it would
save the Town money. Councilman Minarsich said he did not favor the election at the last discussions. He stated
that he had changed his opinion since that time but not based on a petition. Councilman Minarsich said that he
changed his opinion based on the fact that the Council had a split vote. He said that the split vote told him that it
was time for the decision to go to the public. Councilwoman Tibbetts stated that in the early years of the Town's
government it was the proper method. She said that she felt that the public had come to prefer to choose their Mayor
and since that was the indication, it was time to make that change. Councilman O'Brien asked how the initiative
would be costly. Mayor Cutillo said that it would be an initiative rather than an ordinance. Councilman O'Brien
stated that he had no problem with putting the issue to the public for a vote. Councilman Clark stated that he agreed

with what had been said and for the same reasons. He questioned the merits of continuing with the same method
of selection,however,preferred to wait until Thursday's meeting when Councilman Hudson was in attendance. He
said he wanted to hear Councilman Hudson's reasons for opposition to the public vote. Councilman Clark said that
Councilman Hudson was the most opposed to the issue and had the most experience with it. Councilman Clark
stated that he would like the argument presented again in a public meeting. Mayor Cutillo said that the issue would
be put on the agenda for action at the Thursday Regular session. Councilman Clark stated that he agreed that it
should be on the Thursday agenda. Councilman Minarsich asked if staff already had an ordinance drafted for the
issue. Mayor Cutillo said there was an ordinance drafted for the previous discussion of the issue. Mr.Farrell stated
that the Council would control the language, what year the direct election would start, and how many years the
Mayor's term would be if they adopted an ordinance.
AGENDA ITEM#4 - CALL TO THE PUBLIC.
Mayor Cutillo made the call to the public. Mr.Gendler complimented the Council and staff on their budget process.
AGENDA ITEM#5 - ADJOURNMENT.
Councilwoman Tibbetts made a MOTION to adjourn. SECONDED by Vice Mayor Fox and CARRIED
unanimously. The Town Council adjourned at approximately 6:48 p.m.
