MINUTES OF THE SPECIAL SESSION
OF THE FOUNTAIN HILLS TOWN COUNCIL
JUNE 1, 1993
A Special Session of the Fountain Hills Town Council open to the public was convened and called to order by Mayor
Cutillo at 6:30 p.m., Tuesday, June 1, 1993, in the Fountain Hills Town Hall Council Chambers located at 16836
E. Palisades Blvd., Building C, Fountain Hills, Arizona.
ROLL CALL - Following the invocation by Councilwoman Tibbetts roll call was taken. Present for roll call were
the following members of the Fountain Hills Town Council: Mayor John Cutillo, Vice Mayor Bill O'Brien,
Councilmembers Peg Tibbetts, Wally Hudson, and Frank Clark. Councilmember Mike Minarsich came in at 6:35
p.m. Councilmember Charlie Fox was absent. Also present were Town Manager Paul Nordin, Town Attorney Bill
Farrell, Community Development Director Gary Jeppson, and Town Clerk Cassie Hansen.
AGENDA ITEM #2 - PRESENTATION BY MARTI LEMIEUX ON ESTABLISHING A SENIOR CITIZEN
ADVISORY BOARD AND POSSIBLE FUNDING FOR A SENIOR CENTER.
Ms Lemieux said she would like to establish a Mayors Commission on the Aged which would provide seniors with
a vehicle to identify needs in Fountain Hills. Possibly, in the future, the old library building could be used as a
church a seniors center.
Mayor Cutillo asked if this would conflict with senior programs sponsored by the Parks and Recreation Department.
Ms Lemieux felt there wouldn't be a conflict and it would be nice for the seniors to form a committee to investigate
and research their own needs. Parks and Recreation had formal activities. Mr. Mike Scharnow, Chairman of the
Parks and Recreation Commission, said there was a recreational sub -committee that would take on some of the
programs and suggested a separate panel be formed that would report through the sub -committee to the Council and
not go through the interview process. Councilman Hudson asked if there was a need for this now. Ms Lemieux
felt there was a need for a center to be available to seniors 100% of the time. She had contacted other senior centers
and was told when the seniors had their own center, they had a reason to get up in the morning and their medications
decreased
Councilwoman Tibbetts felt appointing a commission with an official title would give stature to the seniors and
would reflect the importance the community would give to the seniors, their activities and needs. Vice Mayor
O'Brien felt if we asked seniors what their needs were, we should also ask youngsters and parents. Perhaps in the
interim, regularly scheduled activities could be planned.
Mr. Nordin said staff would present options and recommendations to Council sometime in July.
AGENDA #3. - DISCUSSION DELAYING ADOPTION OF THE PROPOSED ZONING ORDINANCE IN
ORDER TO INCLUDE A NEW LAND DISTURBANCE SECTION.
Mr. Nordin said the Planning and Zoning Commission was working on a possible revision to the land disturbance
ordinance as a result of the Crystal Ridge discussion. Mr. Farrell rendered a legal opinion regarding correctness or
lack thereof in terms of the staff position taken in that case. It was felt the land disturbance and hillside ordinances
should be re-examined and suggested the Council delay the adoption of the planning and zoning ordinance in order
for the Commission to have more time to prepare a final recommendation. Mr. Jeppson said July 8 would be the
soonest for Planning and Zoning to hold a public hearing on the land disturbance ordinance. Vice Mayor O'Brien
asked if the amendment would be delayed if the zoning ordinance was adopted now. Mr. Nordin felt that would not

pose a problem. Mr. Farrell said that he and Mr. Jeppson were concerned about the issue of closure. He would like
to have closure and then explore the possibility of publishing the zoning ordinance, along with the zoning map, in
the paper. He suggested passing a resolution declaring the ordinance a public record and delaying adoption for a
period of time so that citizens and Council had time to review it. He suggested it be published as a special
supplement in "The Times" and include the zoning map. Council would have a 30-day review period with adoption
30 days thereafter. There were currently two courses of action - one, to adopt both Thursday night, or, two, adopt
the resolution and forestall the ordinance, put it into publication form and publish for two consecutive weeks in the
official newspaper and adopt the ordinance thereafter. Councilman Minarsich concurred with Mr. Farrell to adopt
the resolution and publish the entire document and zoning map. Councilman Clark said there were at least three (3)
interpretations of the ordinance and he felt it should be passed and then immediately go for corrections. Mr. Farrell
said the issue was which combination thereof was the majority view of the Council. Councilwoman Tibbetts was
concerned if the document was published, people would expect to perform under that version and the document
should be adopted particularly on the land development. Mr. Farrell said it would be less expensive and easier for
staff to publish it in a condensed format.
AGENDA ITEM #4. PRESENTATION AND STATUS REPORT BY FIRE CHIEF TOM KNAPP, TOWN
MANAGER PAUL NORDIN AND MARICOPA COUNTY PLANNER LEON WARE ON THE TOWN OF
FOUNTAIN HILLS EMERGENCY PLAN.
Mr. Nordin said the Intergovernmental Agreement called for participation in the county wide program and Fountain
Hills would be assessed between $1,100 to $1,200. He recommended positive action by Council.
Tom Knapp said the existing plan would need to be rewritten and he recommended it be replaced with a combination
of the Carefree and Goodyear plans. Where Carefree plan did not assume a lot, it was very precise and did not
accept a lot of unneeded responsibility, the Goodyear plan was very detailed. There was an extensive amount of
information that would be required to be in the plan. Mr. Ware outlined several other plans. The CBG1-8 stated
what the Federal requirements were. The Council would determine what other items would be necessary to
incorporate into the plan. The plan would need to state who would be in charge and make the decisions and if that
person went down, who would be next in line. The State also required the plan to meet certain standards and be
approved by the State. The final draft would be approved by the Council.
Councilman Minarsich asked Mr. Ware to explain what specifics the Council would make decisions on and what
the time frame would be. Mr. Ware said the Council would need to determine who would have the authority to
make the necessary decisions. It would take approximately three (3) to four (4) weeks to put together and would
then be presented to the Council. Councilman Minarsich asked if Mr. Ware would make recommendations in terms
of specifics and Mr. Ware said he would. Councilman Hudson suggested the Town Code should match the
Emergency Plan. Mr. Ware said there was a section in the Emergency Plan entitled "Authorities" which listed all
city, county, federal and state codes. The Fountain Hills Town Codes would be incorporated in that section. Mr.
Ware said a hazard analysis of the Town would also be incorporated into the plan.
AGENDA ITEM #5. - PURSUANT TO A.R.S. 38-431.03.A.3., VOTE TO GO INTO EXECUTIVE SESSION
FOR LEGAL ADVICE WITH THE ATTORNEY OR ATTORNEYS OF THE PUBLIC BODY.
Vice Mayor O'Brien MOVED to go into the executive session. SECONDED by Councilman Minarsich and
CARRIED unanimously.
The Council recessed to go into the Executive Session at 7:30 p.m.

Councilman Hudson MOVED to adjourn. SECONDED by Councilwoman Tibbetts and CARRIED unanimously.
The Town Council adjourned at approximately 8:36 p.m.
