MINUTES OF THE SPECIAL SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
OCTOBER 29, 1996
A public meeting of the Fountain Hills Town Council was convened and called to order by Vice Mayor Lawrence
at 6:00 P.M., Tuesday, October 29, 1996, in the Fountain Hills Town Hall Conference Room, Building C, located
at 16836 E. Palisades Blvd., Fountain Hills, Arizona.
ROLL CALL - Following the pledge to the flag and the invocation by Councilman Poma, roll call was taken.
Present for roll call were the following members of the Fountain Hills Town Council: Vice Mayor Lawrence and
Councilmembers Bill O'Brien, Sid Apps, Al Poma and Penfield Mower. Mayor Miles and Councilwoman
Wiggishoff were absent. Also present were Town Manager Paul Nordin and Town Clerk Cassie Hansen.
AGENDA ITEM #2 - CONSIDERATION OF THE SPECIAL EVENT LIQUOR LICENSE REQUEST
SUBMITTED BY BRUCE CONKLIN FOR THE AMERICAN LEGION LOCATED AT 16850 EAST
AVENUE OF THE FOUNTAINS. THE AMERICAN LEGION IS REQUESTING TO HAVE A "BEER
GARDEN" DURING THE NOVEMBER ART FAIR,FRIDAY,SATURDAY AND SUNDAY,NOVEMBER
8TH,9TH AND 10TH FOR A FUNDRAISER. HOURS OF OPERATION ARE FROM 10:00 A.M. TO 1:00
A.M. EACH DAY.
Town Clerk Cassie Hansen reviewed the request from the American Legion to sponsor a beer garden in a designated
mapped area. She stated the American Legion had assured that the area would remain secure and that alcohol would
not lead out into the fair area. Councilman Mower questioned the requested time period and suggested that the hours
be modified to coincide with the Art Fair hours from 11:00 a.m. to 6:00 p.m.
Councilman Poma MOVED to approve the Special Event Liquor License Request from the American Legion.
Councilman Apps SECONDED the motion. Councilman Mower MOVED to amend the operating hours for the
Special Event Liquor License request to 11:00 a.m. to 6:00 p.m. Councilman Poma and Councilman Apps stated
they would not object to a 10:00 a.m. opening time,but Councilman Apps suggested 10:00 p.m.be set as the ending
time. Due to a lack of a second to the motion to amend, the motion DIED.
Councilman Poma MOVED to amend the motion to stipulate the operating hours for the Special Event Liquor
License request from 10:00 a.m.to 6:00 p.m. Councilman Mower SECONDED the motion. Vice Mayor Lawrence
expressed his concerns regarding security matters and the safety of vendor's displays and that there were other
locations available if patrons were seeking a place to consume alcohol.
Bruce Conklin, speaking for the American Legion, stated the extended hours would assist their group in their
promotional efforts. He suggested the roped-off area might be eliminated after sunset and patrons and vendors from
the fair could use their facility. He reported scholarships and money had been awarded to persons in the community
as a result of their fundraising ventures.
Councilman O'Brien asked if the American Legion could sell alcohol after the hours specified in the Special Event
Liquor License request. Clerk Cassie Hansen stated the hours were specified for the Special Event Liquor License
request but that they could sell at their location under their Club License. Councilman Poma stated the Club License
would be suspended for the days that the Special Event Liquor License request was permitted. Vice Mayor
Lawrence sympathized with the Legion's request but stated he thought it was in the best interests of the Town to
limit the operating hours in an attempt to prohibit setting a precedent for extending the hours of the events of the

fair. Mr. Conklin appealed to the Council to approve the original request for operating hours from 10:00 a.m. to
1:00 a.m.
The motion to amend CARRIED with a 4-1 vote. Councilman Apps cast the nay vote. The motion to approve the
Special Event Liquor License request CARRIED unanimously.
AGENDA ITEM #3 - CONSIDERATION OF THE EXTENSION OF PREMISES/PATIO PERMIT
SUBMITTED BY BRUCE CONKLIN FOR THE AMERICAN LEGION LOCATED AT 16850 EAST
AVENUE OF THE FOUNTAINS. THE REQUEST IS TO TEMPORARILY EXTEND THE GROUP'S
LIQUOR LICENSE TO AN ENCLOSED AREA OUTSIDE OF THE BUILDING ON MONDAY,
NOVEMBER 11, 1996 TO ACCOMMODATE A GATHERING FOLLOWING THE VETERAN'S DAY
CEREMONIES.
Town Clerk Cassie Hansen reported that the Extension of Premises/Patio permit would be for members and guests
only, not open to the public and that this request was not for fundraising purposes.
Bruce Conklin,speaking for the American Legion,told the Council the operating hours would be for regular business
hours, beginning at 8:00 a.m. He stated this request was submitted to allow the American Legion to accommodate
more patrons than their building allowed under their Club License. Councilman Poma asked how many guests each
member could bring to the gathering. Mr. Conklin answered that each member could bring and was responsible for
up to four guests.
Councilman Poma MOVED to approve the Extension of Premises/Patio permit for the American Legion on
November 11, 1996. Councilman Apps SECONDED the motion which CARRIED unanimously.

AGENDA ITEM #4 - CONSIDERATION OF THE SPECIAL EVENT LIQUOR LICENSE REQUEST
SUBMITTED BY BRUCE CONKLIN FOR THE AMERICAN LEGION LOCATED AT 16850 EAST
AVENUE OF THE FOUNTAINS. THE REQUEST IS FOR A BEER GARDEN DURING THE
THANKSGIVING DAY PARADE ON THURSDAY,NOVEMBER 28,1996 FROM 8:00 A.M.TO 10:00 P.M.
Clerk Cassie Hansen stated this request from the American Legion would be for a fundraiser open to the public.
Councilman Poma MOVED that this request be continued to the Regular Meeting of the Town Council on November
7, 1996 to allow absent members of the Council to respond to this request. Councilman Apps SECONDED the
motion which CARRIED unanimously.
AGENDA ITEM #5 - CALL TO THE PUBLIC.
No one came forward to speak.
AGENDA ITEM #6 - ADJOURNMENT.
Councilman Apps MOVED to adjourn the meeting. Councilman Mower SECONDED the meeting which
CARRIED unanimously. Vice Mayor Lawrence adjourned the meeting at 6:30 p.m.
