AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT
CHAPTER 2, SECTION 2.01, AMENDING THE TEXT OF "THE
OFFICIAL ZONING DISTRICT MAPS" FOR THE R1-8A ZONING
DISTRICT TO PERMIT GARAGES ANGLED AT 45 OR GREATER
DEGREES FROM THE FRONT PROPERTY LINE TO BE LOCATED
FIFTEEN FEET OR MORE FROM THE FRONT PROPERTY LINE.
WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning ordinance; and
WHEREAS The Town of Fountain Hills advertised public notices of a size that were one-
eighth page or greater in size, in the official newspaper of general circulation, the
Times of Fountain Hills, on December 27, 1995, January 3, and 10, 1996 of public
hearings held by the Fountain Hills Planning and Zoning Commission on January
11, 1996 and by the Fountain Hills Town Council on January 18, 1996, to invite
comments from the public; and
WHEREAS The owners of over seventy-five percent of the land in Fountain Hills zoned "R1-
8A" have petitioned the Town to amended the text of the "R1-8A" zoning district
to permit garages that are angled forty-five (45) degrees or more from the front
property line to be located fifteen (15) feet or more from the front property line;
and
WHEREAS The Town of Fountain Hills permits side-entry garages to be located ten (10) or
more feet from the front property line in R1-8A zoning districts; and
WHEREAS The Town of Fountain Hills permits front entry garages to be located twenty (20)
feet or more from the front property line in the R1-8A zoning districts; and
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The text of The Zoning Ordinance of the Town of Fountain Hills is hereby
amended as follows:

c. AN APPROVED P.U.D.PERMITS LOTS NO SMALLER THAN 4,500 SQUARE FEET,PROVIDED THERE IS 1,500 SQUARE FEET OF USEABLE
COMMON OPEN SPACE PER LOT OR A COMBINATION THEREOF. LOTS LARGER THAN 4,500 SQUARE FEET MAY HAVE LESS THAN
1,500 SQUARE FEET OF COMMON USEABLE OPEN SPACE PER LOT IF THE COMBINATION OF LOT SIZE AND THE COMMON USEABLE
OPEN SPACE IS AT LEAST 6,000 SQUARE FEET PER LOT.
d. OR BUILDING HEIGHT,WHICHEVER IS GREATER.
e. A GARAGE POSITIONED AT A 45 DEGREE ANGLE OR GREATER FROM THE FRONT PROPERTY LINE MUST SETBACK AT LEAST 15
FEET.
