ORDINANCE 96-10
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, PURSUANT TO CHAPTER 2,
SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN OF
FOUNTAIN HILLS, AMENDING THE OFFICIAL ZONING DISTRICTS
MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA BY
DESIGNATING 0.2717 ACRES OF LAND,AS GRAPHICALLY SHOWN IN
ATTACHMENT"A"AND AS LEGALLY DESCRIBED IN ATTACHMENT
"B", FROM THE "OSR", OPEN SPACE RECREATIONAL ZONING
DISTRICT TO THE "R1-6A" SINGLE-FAMILY RESIDENTIAL ZONING
DISTRICT, SO THAT ALL OF LOTS 33 THROUGH 41 IN THE
SUNRIDGE CANYON PARCEL "A" REPLAT SUBDIVISION ARE
LOCATED WITHIN THE "R1-6A" SINGLE-FAMILY RESIDENTIAL
ZONING DISTRICT.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and,
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning district
boundaries; and,
WHEREAS, Chapter 3, ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF, Section 3.02 Boundary Lines on the Zoning
District Maps establishes the "Official Zoning District Maps"; and,
WHEREAS, Public hearings were advertised in the March 13, 1996, March 20, 1996, March
27, 1996 and the April 3, 1996 editions of The Times of Fountain Hills and Rio
Verde, pursuant to Arizona Revised Statutes §9-462.04, and,
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on March 28, 1996 and by the Mayor and Common Council on April 4, 1996.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The "Official Zoning District Maps" shall be amended to change the Zoning
District Designation of 0.2717 acres of land, which is graphically depicted in
Attachment "A" and legally described in Attachment "B", from the "OSR", Open
Space Recreational Zoning District to the "R1-6A" Single-Family Residential
Zoning District, so that all of Lots 33 through 41 in the Sunridge Canyon Parcel
"A" Replat subdivision are located in the "R1-6A" Single-Family Residential
Zoning District.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 4th day of April, 1996.

ADDITIONAL ZONING AREA FOR SUNRIDGE CANYON PARCEL "A"
A portion of Section 9, Township 3 North, Range 6 East of the Gila
and Salt River Base and Meridian, Maricopa County, Arizona, more
particularly described as follows :
Commencing at the Southeast Corner of said Section 9, thence North
27 degrees 20 minutes 50 seconds West a distance of 1276 . 99 feet to
the POINT OF BEGINNING, said point being on a curve concave
northeasterly and having a radius of 651 . 00 feet, a radial line
passing through said point bears South 65 degrees 31 minutes 56
seconds West; thence northwesterly along the arc of said curve
through a central angle of 04 degrees 26 minutes 04 seconds an arc
Lir length of 50 . 38 feet; thence South 69 degrees 58 minutes 00 seconds
West a distance of 103 . 73 feet; thence North 84 degrees 20 minutes
