AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT
CHAPTER 2, SECTION 2.01, AMENDING "THE OFFICIAL ZONING
DISTRICT MAPS" FOR THE REPLATTED PORTIONS OF PARCEL #7
AND TRACT "C-1" OF THE EAGLE MOUNTAIN MASTER
SUBDIVISION PLAT FROM "OPEN SPACE RECREATIONAL" TO "R1-
8A"
WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning ordinance; and
WHEREAS The Town of Fountain Hills advertised with public notices of a size that were one-
eighth page or greater in size, in the official newspaper of general circulation, the
Times of Fountain Hills, on November 27, December 4, 11, and 18, 1996, public
hearings held by the Fountain Hills Planning and Zoning Commission on
December 12, 1996 and by the Fountain Hills Town Council on December 19,
1996, to invite comments from the public; and
WHEREAS The property owner, Eagle Mountain Investors, LLC, desires to have a 43,392
square feet of the unused golf course in Tract "C-1" along the southern border of
Parcel #7 of the Eagle Mountain Master Plat rezone from Open Space
Recreational to "R1-8A"; and
WHEREAS Parcel #7 of the Eagle Mountain Master Subdivision Plat is zoned "R1-8A"; and
WHEREAS The Town of Fountain Hills desires to grant this rezoning request.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The Official Zoning Districts Maps is hereby amended to change the zoning
district designation as shown in Attachment "A", for Tract "C-1" and Parcel #7
of the Eagle Mountain Master Subdivision Plat from "Open Space Recreational"
to "R1-8A".

THENCE North 37°30'52" West, a distance of 206.85 feet;
THENCE North 13°28'21" East, a distance of 35.94 feet, to a point on the westerly line of
said Parcel 5;
THENCE southeasterly along said westerly line, South 33°53'45" East (measured), South
33°53'10" East (record), a distance of 131.89 feet;
THENCE continuing along said westerly line, South 41°20'32" East (measured), South
41°19'57" East (record), a distance of 441.71 feet, to the POINT OF BEGINNING.
